    Unfortunately, I can't go to those links from work, they're blocked. Have to wait until tonight.

    Apparantly, breach of contract is common law, so there isn't necessary statue to support it. However, financial instruments are generally governed by the UCC, which has been adopted by California, so that is my next step.

    In case you can't see link, its a well-known foreclosure defense attorney giving the readers "gifts" of memos and motions that will shut down the foreclosure mills. Hopefully, there's something you can use in there.

    I also read an interesting article about option arms and tax stamps. People who are being FC'd on who have Option Arms may delay their FC and force the banksters to pay a hefty tax bill before the court will find they have standing. Don't know if that applies to yours, but it would be great to throw the b@stards a hefty tax bill. Here's the link:

    Filing my lawsuit today, hopefully nothing goes awry. Then will work on getting it served late next week after my vacation. I understand that I have 120 days to serve it on the defendants after I file.

    Also, I'm going to have to do some more research on these foreclosure mills... Definately John Kennerty has come up in my documents. He seems to be a major culprit of this crap. I've got a few other folks who I think are shady in my paperwork.

    Really, I feel pretty confident that my substitution of trustee paperwork was back-dated. They "executed" it on 3/6, but didn't record it until 4/22? Yeah, right. How to prove it, I'm not sure, but I'm pretty confident it happened.

    I Wish to follow your steps soon... right now i'm getting informed and learning from you guys to hopefully someday fight back..

    I haven't been foreclosed on yet.. i have couple of months to get up to speed and learn from you guys..

    I keep hearing about MERS and finding out who owns ur mortgage.. i would really appreciate if you guys can post up links to this MERS lookup page.. Also how would i follow the bread trails and see who owned and owns my mortgages.. i hear that Notes changed hands so many times the chances of not being recorded correctly are very high.. So high that lawyers in florida are been investigated by the AG for falsifying documents in order to foreclose houses...

    so my question is.. MERS website? and do i go to the courthouse and look up my property to find out who owns and owned my mortgage?

    Randolyn Logan signed as a Recontrust Officer
    Randolyn Logan signed as a Federal National Mortgage Association Officer

    This person sure does have a lot of jobs!

    They also recorded NOD's before SubOfTrustee.

    Read this. Unfortunately, I couldn't find any info on Randolyn Logan specifically - but that doesn't mean it isn't fraudulent - especially since she is an officer of too many corporations & what she did reeks to high heaven & screams fraud!!! How can she sign for so many??? Also, when did CW go defunct? Was it 2008 or 2009? Might want to check the dates on good old Randolyn's bogus claims...

    Sometimes these "people" also "sign" in MN, NY, KY, TX and CA at the same time or even the same date. How do they manage that? Are the airlines that efficient?

    Good for you for wanting to fight back! Try not to get foreclosed on first, then your options become limited and the foreclosure clock is ticking. The MERS lookup page is pretty worthless and not always accurate. Keep in mind MERS doesn't tell the truth. Here it is though:

    MERS - MERS for Homeowners

    You can go online to your county recorder or in person & request a copy of your deed. You should also have a copy of this in your loan papers. You would have an 18-digit MIN# on your deed. All you hear is true about the pretender lenders and their foreclosure mill attorneys generating fraudulent documents to steal people's homes. Not only did the deeds get transferred around like a whiskey bottle at a frat party, chances are no one has your note!

    Don't get too excited about that though - the mill attorneys/banks are fabricating them faster than you can blink & the judges are allowing them to go through the court system without batting an eyelash.

    Another mind-boggling thing to grasp is that these "securitized" notes probably never even got "securitized".

    I'm not sure how to search all the names, other than typing them in on Google and seeing what you come up with. Also their name and "assignment fraud" or "MERS" might help narrow the search. I think a couple of anti-foreclosure websites have a list of fraudulent assignment signatories, but I can't recall the names of the sites off-hand. If I come across, I'll post it.

    I don't know if you still frequent this forum, but if you do, what County have you found Randolyn Logan's signatures as you've described? Also, do you have the instrument numbers? I am familiar with a similar situation, except she is signed as an Assistant Secretary for MERS. So I need to be able to show a controversy as to the validity of the document due to forgery and fraud by showing other documents in conflict.
