We initially signed with Homeowner's Financial Group and the truth in lending they gave me one week prior to closing is completely different than what we signed. To ensure we didn't read what we were signing they had us come in just before the builder's closing time. I also don't have a copy of the right to rescission(sp?). They sold the note to Wilshire Credit Corp and they have not delayed the loan modification process but I want to see all of the paperwork they have compared to mine. If I only want copies of papers the lender has, do I submit a QWR? Or do I just write a letter requesting the info?" |

If this was a purchase then the Right of Rescission would not apply.............it only applies to refinances. The Truth in Lending is not normally given before a closing because it addresses particulars of the final loan approval and figures that would be compiled on the day of closing such as APR due to closing costs and fees..............a Good Faith Estimate is the disclosure that is usually given withing 72 hours after you make a loan application.
