Hello All: I recently sent my lender a RESPA "qualified written request" via certified mail and I have received all of the requested documents. The Initial Loan Disclosures show (2/15/05): 1. signed GFE for a 4.85% loan 2. no variable rate disclosures exist 3. signed Truth-In-Lending Disclosures indicate a fixed-rate loan The Closing Papers (3/1/05) 1. The signed GFE indicates a 5.85% interest rate but the amount of payment, etc. are way off from actual. 2. The only Application signed (on the closing date of 3/1/05) (1003) indicates a fixed-rate loan, not an ARM. 3. The rest of the paperwork I signed unfortunately, reflect an ARM Are their any TILA/RESPA defenses here to foreclosure? Thanks |
