When is 125 LTV available? for all investors?

My loan modification request from WF was turned down since I have NOT defaulted. But, all I was asking for was a lock-in of fixed rate. And I am underwater. Still WF refused.

Any case, the WF rep told me to wait and apply when 125% LTV is available (for all banks). Can some one help me answer the following.

1. Is the provision for 125% LTV under MHA/H4H in place yet? How do I know that this is in effect (any URL?)

2. Even when 125% LTV provision is in effect, will this be only for Fannie/Freddie loans ONLY? Any plans to open this provision for other investors since my loan is neither Freddie/Fannie

3. For these 105 LTV or 125% LTV, I heard that we do not need Mortgage Insurance. Is that right?
