Both have a 2nd what is the process of getting the second forgiven or combined w/ the 1st one? Would filing ch.13 bnkrpcy help us get rid of the 2nd on both rentals? 3. Should we hire an attorney? We have already sent all docs (8/19/09) for modification to lender. Any guidance would be appreciated. Previous economic situation: 2008 we miraculously made all pmts. My husband’s income declined significantly (self-employed truck driver). We borrowed $ from family, exhausted all our savings and used line of credit to make ends meet. 2009 no more $ resources avl. Stopped making pmt. Feb. 09. My husband hurt his back & was out of work 6wks w/ no pay. Putting food on our table took precedence over our impeccable credit score. Current qualifications: As of June 09 my husband’s income has begun to improve. We have the rental income to use as a good faith down pmt. I am working an extra job. We now have $200 surplus. Rental #1 owe $445,217/~$290,500 (current value) ·1stChase (wamu) 6.27% interest only to set in 2011. Balance $375,920 ·2nd BofA (countrywide) 8.26% balloon to set in 2011. Balance $69,297 **Would like a fixed low rate w/ 40yrs term. Ideally would like 2nd for be forgiven but would be happy if combined w/1st. Rental #2 owe $437,782/~$330,500 (current value) ·1st Chase 5.62% interest & principal 30yr fixed. Balance $388,861 ·2nd Flagstar 7.37% interest only for 8yrs. Balance $48,921 **Would like to keep same % rate but have our term be extended to 40yrs to make pmts affordable. Ideally would like 2nd to be forgiven but would be happy if it can be combined w/ 1st. |
