IS there a Notary in the house?

There was supposed to be a notary person along with the title company rep during signing? Both of mine took place at my kitchen table. And both state that they were done at the title company's office on the HUD!! Is this the oops I have been looking for?

Hello,
Notary Public can go to your house, your kitchen table anywhere to sign the Loan Documents that the lender or the banks requires you to have. They need your signature, but before they have you sign the documents they need proper ID from you and spouse with your picture and signature on it. They need to bring the log book so they can write your name and address and drivers license, date and your thumb print. They are paid by your bank probablu between $125 to $350 per loan documents. First and foremost they need you to raise your right hand and take an oath.
Notaries can only charged $10 but can charge extra fees, in loan documents the banks pay them and they charge the banks from $125 to $350.

Did you ask for their ID as a Notary Public? You don't worry about them because any violation they do they can be sued by anybody and the fine is too high for them to do a crime. They are careful and make sure that what they give you is good service and the truth.
How do I know it, I am a Certified Public Notary.

If you were uncomfortable signing the loan documents you should have not sign it and tell them that you prefer signing it in the office. They went to your house to make sure that you do not change your mind signing it. Also Notary Public are not allowed to answer questions from you because if you change your mind due to the information they gave you, the bank can sue them. That's why Notary Public are very careful because they can be sued by customers, banks, etc. The court can also subpoena them and the log book if deem necessary..

I'm not trying to fault the notary public, but by Wisconsin law are they required to be there? We did provide a copy of our driver's license, with out an oath. The title service company rep certainly didn't ask us for our fingerprints. I was hoping someone may have an insight on this as compared to TILA or RESPA, or a particular law. Noo blame on the person that the bank didn't call to set a time to be at mmy house for the signing. Thanks for the info on the notary's procedure, though.

Notary procedure in CA and Wisconsin is basically the same. I think the bank used a Mobile Notary Public in your case or the one that works for their company. Notary Public should be the one asking for an oath and fingerprints, that is his job. I think the title service company rep is there to see that you have signed the documents in front of a notary public which is required by law for loan documents and so he can get the documents to file it in the Recorder's office and keep a record for his office, they probably trying to save time. As far as TILA or RESPA violations you need to read the documents and read the fine prints or consult an attorney if you feel that there is TILA or RESPA violations.

that's what I'm gettin at, it was just me, my wife, and the title person. No fingerprints, no notary. I'll keep reading the statutes to pinpoint a violation. Thanks for your guidance.
