Nominated 0 Times in 0 Posts TOTW/F/M Award(s): 0 | Another QWR with no response My attorney wrote a QWR to my mortgage servicer (First Franklin) in the beginning of October of last year to which we received no response. I know I can file a lawsuit for this violation because I incurred damages due to them not coding my credit reports as in dispute and paid on time as required by section 6. Instead of filing suit I am considering to offer them settlement of showing me as paid on time for the last six months and forgiveness of the one payment they claim I am behind and all late fees. My damages incurred are about the same as the amount they claim I owe. Does anyone have an opinion of this idea, and should I write the letter or should I have the attorney do it. |

It happens to me everyday and all the lender reps say is, we didn't receive it, what number did you fax it to? Oh that's not the correct fax # and they give you a new # to fax to. How do you fight something or someone who plays dumb? |

They always like to play hardball and make home owners do as much work as possible while they do what seems like NOTHING!!! It just really comes down to talking to the right person on the right day... Find someone from your lender who is friendly and willing to assist you. Good idea is to be on the phone with the lender and get the nearest fax number and make sure that the person you are talking to receives it and puts in the system before the conversation is over. This is definitely a hard and time consuming process but just stay strong and be on TOP of where your modification stands!!!
