well I sent a certified letter to citimortgate for a copy of our loan documents because obviously they differ from the documents we have. We did receive the receipt from the post office signed by a citi emplyee dated 8/28/08 still no response.

I realize they have 60 days however they sent us a letter yesterday 10/30/08 stating our payment is adjusting December 2008 (our documents say clearly on the note December 2009). We called they said we cannot dispute this but won't send the copy of loan documents they have. They say the NEVER received our request which is bogus as we have a signed receipt! What can we do? Anyone?

The timeframe is 60 business days which would put you at November 20th.............if you do not receive or hear anything by then you would need to file a complaint with HUD.

under Section 6 of RESPA they are required to acknowledge your request within 20 business days and must try to resolve the issue within 60 business days.
