Thumbs up Read Occ Advisory Letter 2003/ And Hosa

I HAVEN'T BEEN ABLE TO WRITE VERY MUCH THE LAST FEW DAYS OR SO.
I AM TRYING TO PREPARE FOR MY ANSWER TO POPULAR MORTGAGE INC. FORECLSURE CLAIM.

AT THE SAME TIME I AM SEARCHING FOR A NEW ATTORNEY. I AM AMAZED AT HOW MANY ATTORNEYS REP THEMSELVES AS FOCUSING IN THE PRACTICE AREAS OF PREDATORY LENDING AND MORTGAGE FRAUD, ETC., WHO HAVE VERY LITTLE KNOWLEGE ABOUT THE SUBJECT. AND, I DON'T KNOW WHY THERE ARE NOT MORE GOOD ATTORNEYS GETTING OUT THERE AND LEARNING THIS AREA.

THAT BEING SAID, I MET ANOTHER PROSPECTIVE ATTORNEY TODAY, WHO FANCIED HIMSELF A PREDATORY LENDER ETC EXPERT. IN FACT, HIS EXPERIENCE WAS ONLY IN BANKRUPTCY. WITH MY CASE, AS MOE HAS SEEN, EXPERTS NEED ONLY APPLY. ALSO, NOT FOR THE FAINT OF HEART. HE DID LOOK A LITTLE CONFUSED. BUT HE DID BRING UP A GOOD POINT THAT BROUGHT ME TO A REALLY GOOD READ.

HE MENTIONED HOME OWNER PROTECTION ACT. MAYBE MOE CAN ANSWER WHETHER ALL STATES HAVE THIS. I'M NOT SURE. BUT PLEASE DO TAKE A LOOK. IF YOU ALREADY HAVE, LOOK AGAIN. I HAVE BEEN GOING BACK AND REREADING ALL THE REGS AND ACTS ON THE SUBJECT.

I WAS LEAD IN MY READING TO THE OCC ADVISEREY LETTER AND READ WITH DELIGHT. THIS LETTER WILL ANSWER A LOT OF QUESTIONS, AND SHED NEW LIGHT FOR SOME.

AS I SAID I AM GOING BACK OVER EVERYTHING AND BEING REMINDED OF ALL OF THE VIOLATIONS AND LAWS THAT HAVE BEEN BROKEN.

A GOOD REMINDER TO ME... IF YOU REALLY BELIEVE YOU HAVE A PREDATORY LOAN DO NOT LET ANYONE DISCOURAGE YOU TO PURSUE. ALTHOUGH I AM NO WHERE NEAR THE END OF MY FIGHT, BUT I BELIEVE I WILL BE TRIUMPHANT AND I HOPE ALL OF US WILL.

I WILL KEEP ALL POSTED OF ANY NEW WAYS TO LOOK AT OUR SITUATIONS.
I HOPE EVERYONE ELSE WILL SHARE ANY INFO, SUCCESS, EVEN THINGS TO AVOID.

Hi Moe,
Sorry I missed you. I am working on my foreclosure defense. I know I shouldn't worry, because the list is quite long. Still, I am looking for a qualified attorney in NJ has been very hard. Since I am realizing that the attorney I have used is not really, either, familiar with, or applying the knowledge of, the extent of the laws and regulations, ammunition, available to consumers, both state and federal, in my opinion. I just can't believe (when I read the available rights I do find) there is a way to beat these people.

I will agree with anyone who says the law is NOT adequate on the subject of predatory lending. But, for a keenly smart attorney the codes, regs, laws, could do more with what we have than is my experience.

I guess there is not enough settlement money gained to compensate the hard working attorney in the end. If only this could change in the civil courts, consumers would be better off. How is this changed? By really tough attorneys who fight for it? or in the legislation?

I really don't know much about all, any, of this, but I think if enough people were to fight for their rights we would all be in better shape as consumers as a result.

What is SOOOO important about this site is that we as consumers, though not expert law makers, or attorneys, we can help one another fight for our civil rights.

If enough of us do fight, maybe we can make a BIG difference. EXERT OUR POWER as AMERICAN CITIZENS.
