Forced Illegal Flood Ins.

Ok this is different than any other I have read about. My mortgage started with Option One, 3 year arm. I started paying 8.5%. At the end of the arm my rate jumped to 11.5%!!! Two months after my mortgage rate increased to 11.5% they started forcing me to purchase flood insurance. My home is on top of a mountain in NC!!! I built this home 16 years ago and have never had to purchase flood insurance. I looked up the FEMA map panel for my home and my home is in zone X, meaning that I am not in any flood plain and well outside the 500 year flood plain. Their policy letter said that I am in AO zone. I knew this was not correct. At the same time they forced me to purchase hazard insurance through them, even though I had my own insurance!!! I sent them copies of my policy and had my insurance broker send them copies and called them on the phone but they contuned to charge me their extreamly high insurance rates. They started charging me $500 a month on top of my normal (extremely high payment). They started an escrow account on my behalf! How nice of them, NOT!!!! The best part is that when I looked up the FEMA map panel number on the policy letter where they were requiring me to purchase flood insurance, it is an invalid number. I called FEMA and talked to a map specialistist, they said that the number I gave them, would be for a home in Florida!!! My home is in NC. The fact that the number is invalid showes that they did this on purpose, it is not a mistake. This happend when Option One was in a finical hardship. I have called their insurance department only to get the run around. I have paid AHMSI over $6000. a year extra for the past three and a half years, on top of my mortgage payments. I contacted AHMSI 12 times only to be told that I would have to have FEMA amend their map. I told them that the FEMA map is correct and that I am not in a flood plain. To have the FEMA map amended I would have to hire a civil engineer to do an elevation study. This has put such a strain on me that I have suffered a mini stroke and have been under two doctors care for the past three years. AHMSI has forced me into forclouser twice in the past two years. I'm tired of this. I'm ready to take it before a jury!!! I want them to feel the pain I have felt over the past three years. If they won't listen to my complaints over the phone, maybe they will listen in front of a judge. I am in the second forclouser now. Last time I payed them a lot of money, almost putting me in the grave. I had to sell my family land, my truck and the only enjoyment I had left, my motorcycle. I am paying 51% of my income to them!! I have a hard time buying food for my family and I have a special needs daughter. I sent them a hardship letter with no responce. Talking to them is like talking to the wall. They cant speak English!!! I ask for the number for their main office in Texas and was refused. I tried to make the normal payment before going into forclouser witout the escrow and was told that they would only accept full payments, partial payments would not be accepted. It's like they want my home. They have tried to forclouse on me very quick. Two weeks notice for forclouser and two weeks after that to sell my home. I think they want to move quickly before I have a chance to sue them!!! If at all possiable, I will sue them!!! Years have been taken off my life because of them, I want them to PAY!! I have been able to delay the forclouser but I have to act quickly. Any sugestions?

I am supprised that I have not gotten any responce to my post. This is the truth! I have documented proof. I have a hard time believeing it myself. I would like to know if anyone else has had problems with AHMSI charging false escrow payments.
Just look at it this way, AHMSI has 450,000 loans that they service. If they slide in $1.00 a month in false charges a month per loan, thats $450,000 a month. If they slide in $10.00 a month, just think. Let me know. I need to do something soon.

I am sorry...............
there may not have been a response because there may not be anyone going through this same thing ............the forum is mostly set up for advice dealing with loan modifications, short sales, and deed in lieu of foreclosure. From the post it didn't sound as though that is the direction you were wanting to take. For this matter you would really need to consult with a real estate attorney that understands this type of scenario and is able to help file a lawsuit if that is the direction that you wish to take.

If you click on the link and search by area of expertise, you can put in forced placed insurance and then North Carolina to see the attorneys that may be able to help advise you on what you would need to do in this case.
