Nominated 0 Times in 0 Posts TOTW/F/M Award(s): 0 | Starting the process with AHMSI I have been reading here for a few weeks now, and I thank you for the imput and commend those that have succeded. I got out of a New Century ARM, right before they fell, I got a fixed 8.7% with option one. I had no choice as my arm was adjusting to 11%. I have not been late with my mortgage until now, life happened ,and now things are tight. I tried to sell my car and truck to get out of the payments but only got offers below what was owed, i have sold personal items to keep the mortgage current. I will be asking for a rate reduction, and hopefully they will see that this will make all the diffrence, as my wife finaly graduated and started her new job. I have gathered all the needed documents, and I am fine tunning the hardship letter. I would like to overnight the packet to Jeanne Drake instead of faxing it. does anyone have a hard addy to send this to? |

I got a call from Amy , she told me to send the rest of the documents to her, which I have ready but she had a problem with my financial statement, as we have 3 car payments. I explained that the reason we have 3 cars is that I was a co-maker on a car for my son who decided not to pay for it so I got stuck with it and it was with my CU so any monies would be cross collaterlized onto one of the others plus a blackmark on my CR. She said that I should have let them repo my truck or the car, I told her that didnt make sense as I am trying to get my CR score up, not tank them, and I have tried to sell the car 3 diffrent times the last year a half but I was not offer within 1500 of what I owe, so I have paid the 178 monthly pymnt until I can at least break even which acorrding to the NADA I am very close. I told her if it would help I would put it up for sale again, but cars are like the housing market, things around here are setting not selling. I explained that a repo of any sort is out of the question. She said it would be a tough to get a mod with the 3 car situation, I told her I was only looking for a 5 year reduction, and I was serious, as after the 5 years I would be in a much stronger position to refi, as my wife just started her new job but it will take a while for her to complete her OJT to bring her to scale, and what I get from the VA and SSDI will remain the same as every increase I get goes to cover the insurance that icreases every year. I guess this may be a waste of time , but at least I know I tried. I looked to combine my loans at the CU, but after the numbers were crunched, the interest rate I would have, it would only save me 119 per month plus I would be adding extra years to the loans so in the end I would be paying alot more. Its a catch 22, pay on time no matter how you struggle in order to keep from completly killing your CS, and you get hammered for it, but I got myself into it and I will get myself out of it, in the mean time AHMSI may be eating another property. BTW.....the lady was very nice, no problem with her at all. |

But I got a mod....so it can be done. However, I had to hire an attorney to do my modification because of my husband's pay and all of our financial obligations. I just really felt I couldn't do it alone. When I reported the expenses, they asked me about why we had three cars and I just told them we have a ranch and needed a work truck to haul pigs & goats...they accepted that. But the main reason we got a mod was because we had violations in our loan documents and our attorney hammered them on it....without that, we'd probably be homeless. If you can't sell the car you can't sell it....why should you take a hit on your credit? It seems like total bull$hit that they want you to suffer even more than you're suffering right now....sorry for the mini rant....it just makes my blood boil!

It realy struck me that as nice as she was, that was even questioned to the point it was. I explained this in my hardship letter, and that I have tried to sell my truck or the car, the wifes car is off limits, her jeep ( or baby )got crushed in a wreck , and hers was her replacement. |

By what I watched today , it looks as though congress will turn this over to the FDIC Chairwoman as she was realy on the ball on this meeting, and the other 2 bums had no answer. |

I told them to check for a loan mod in the computer, and it was at least there, so after they did some more reaserch I was tranfered to another person(India)who again went over my financal's then tranfered me to Amy's voicemail, left message, so it it a waiting game. |

I have been following your story and I know Erika's Option One/AHMSI story very well also and one she and her husband fought for several months. So, just keep that in mind and also remember that you cannot sit back and wait too long and to make sure to keep on these guys. They are dealing with thousands and thousands of foreclosures. The system is in complete chaos and you are stuck in the eye of the storm. The only way out is to make your voice heard and to never let them forget that you wil not be quite until they save you. That right there, makes you stick out in the crowd. I wish you the best and will continue to follow your story!

I completely agree with what Moe said.....you need to make some noise so that you stand out amongst the sea of foreclosures.....start calling them once a week or every few days if you like, just to follow up......always be polite but persistent, remain calm, cool and collected......and most of all, keep tedious records of who you talked to on what date at what time and what the conversation was.... Have you done a QWR yet?

Not yet, right now I am going to wait and see how this plays out, if I get to a place where I request the QWR then I will retain a lawyer and get them to go over my loan docs as you did. |

I got a call from Amy today....Loan Mod Denied, she said that we made to much by 1100.00 took off things I still cant figure out, but I am going to go through and crunch the numbers again........would not give on any upkeep on property which I did not even put down ( was discussed during coversation) only the bare minumum on credit cards not what we pay and use again to get by, deducted things they said was not needed, and increased my wifes income even though they had last 2 pay stubs. I should have done this in may when she had to resign her position in order to get into her fellowship program for the new job (3 months no pay) but we would have been in the hole according to their figures by 900 per month so it would have been denied anyway. I need to calm down I think my PTSD is kicking in, realy just want to send them a fax telling them to eat the property. Crazy thing is, she mentioned a short sale.......I said ok, you will eat x amount on a short sale but no interest mod, no answer other than she could tranfer me to another department. I was only looking for a 5 year deal, by then I would be in a much better situation and would have several bills paid off. sorry to rant but Grrrrrrr. |

It's definitely time to do the QWR and ask for all of your documents associated with your loan... http://www.loansafe.org/blog/respa/q...ritten-request is a good place to start. I would go over the financials again with them and find out exactly what they have down that has you at an $1100 positive every month. If you made that much more per month, maybe you could afford to pay them !

DA, this happens often and homeowners are denied based on miscommunication and over inflating their numbers to make the loan modification work. Reapply and try fedexing the package in with a QWR that Erika suggested. Make sure your numbers are spot on and to only have a 100-$300 surplus max.

I can't advise you one way or another, but my experience was that having an attorney look at my loan docs really helped me out.....because initially, they told us to "pound sand". If it wasn't for the violations in my loan docs, my investor would have NEVER agreed to any sort of a modification.....so check it out.....it may be a good move for you.

Complete run around, we were only one month behind and they told us we had to certify mail a cashiers check, they lost it. We called daily since August, we were told the same old thing they would try to locate it. We even faxed their signature over signing for the check. Anyhow, after finding this site, we got Jeanne Drake's number. She started to make things happen. We would then speak with Amy, and she always was so kind and sounded promising. Saying she would get back to us with our new payment plan. Never would return the calls. She said we should not do a loan mod. because we are making interest only payments on a fixed rate of 5.75% (fixed for the life of the loan), our payment will adjust with principal two more years from now. So, she was going to tack on our backed payments. It has been a month and a half now and still nothing. I faxed over a basic demand today to Jeanne Drake, and then called Jim Davis, his assistant was amazing. Within 1 hour Jeanne Drake called me herself and spent 45 minutes on the phone with me. She was shocked that no one called to tell us, they found our check. She basically was mortified and kept apologizing. I told her I wanted copies of all my documents because our taxes were suppose to be impounded and were not. I told her I feel our docs were not correct. She went on to say that we own a motorhome so trying to get help right now is tough. I then told her we are 4 months behind on the motorhome and surrendering it. She said that is the best news and she all of the sudden had a great plan. They are going to take our now 3 months late, tack them to the end of the loan, keep our payment the same, and impound our taxes finally. She is getting back to me next Monday (due to the holiday), and said to make sure I call her if she has not called. It was crazy how great she was and willing to help me. WE have been very loud and annoying to them. Hang tough, Be LOUD!! We were denied back in October as well. |
