Hi All,

Its me again, RefusetobeStressed. Does anyone have the address to the Chairman and CEO, Wilbur L. Ross. He is the one who brought out Option One/American Home Mortgage Servcing Inc.

I have some mail that will be FedEx on Monday morning and I have decided to include him as well

Did something happen with your modification after you signed the docs?

I couldn't find any corporate address for Wilbur..........all I had in the post that you were referring to is this info...............




Put together a QWR (Qualified Written Request)

In that letter demand your Life of Loan History, Copy of Note, Deed of Trust, Riders, all Assignments of the Deed of Trust, TIL, Right of Rescission (if refi), Lender Final HUD-1, Copy of Initial Loan Application and Final Lender Loan Application, all Disclosures and all Loan Documents in your file, Copy of Appraisal.

There is a blank copy of the request in the Homeowner's Tool Box to the Left of the Forum

Make sure you send it certified mail return receipt required to address below:

Today I sent certified letter by FedEx a hardship letter to John A. Thain, the Chairman and CEO of Merrill Lynch. He will receive it tomorrow at noon. I can't do this anymore, I just can't. I thought I was stronger than I was but I've just received another tax payment that is due...AGAIN. And because they paid for my taxes and insurance last time the Step Program AHMSI have me in will not be the initial payments set out to be. Right now I am paying $4975.83 a month. It was $4196.82 at 4.7% up until April 1, 2009 which would have increased to $4773.16 at 5.7%; now it will be $5612.74; then effective 1 April 2010 it would have been $5410.27 at 7.0% but now it will be $6270.70 until paid in full.

I CAN'T DO THIS ANYMORE...I JUST CAN'T...I FEEL HELPLESS...JUST HELPLESS...I CAN'T THINK ANYMORE...I JUST WANT ALL THIS TO GO AWAY...JUST GO AWAY...But I know it won't unless I do something...I DO NOT WANT TO LOSE MY HOME.

I don't know who else to send the letter to. I can't think. I search for information here and I know it's here but my mind is racing a thousand miles not a minute but seconds and I can't find what I am looking for. I CAN'T CONCENTRATE!!!

Then to top it off I spoke with AHMSI today and she told me a letter was sent out today with intent to foreclose. I am only one month behind. I was told I could do a short sale but whose to say that will work and if Merrill Lynch will approve it. She told me if I make a payment it will give me longer to process a short sale...what did she mean?

WHAT SHOULD I DO?

Contact this Jeanne Drake at OOMC in California her info is below. Of over 10 emails and Faxes she is the only one who got the ball rolling in may case. Make sure you fax the docs over and then followup with a phone call the next day.

Thank you soooooooooooooo much. I sure will. I am going to fax it tonight from home and give her a call in the morning. I also contacted HopeNow on Friday. My counselor is Savannah Han****. Today she called me at work informing me that she has sent everything off to AHMSI and that she sent me a copy as well. It lays out everything, financial that we discussed on the phone. They also sent a copy to Acorn Housing here in Washington, DC and I received a call from them as well requesting certain documents so they can contact AHMSI. So we will see...

Hi there refuse....

That was the e-mail address that my attorney used for Jim Davis to help me get the mod we got from AHMSI....hmmm maybe they changed it because he was getting too many e-mails asking for help. Have you tried calling? I'll post his number and fax....

I resent the email from my .com email with attachment (aol account) instead of the .net email (verizon account) (I have two email addresses)

Jim Davis was instrumental in helping me to get my mod.....my attorney was in contact with him and my negotiator, Christopher Lindsey and they got it done. Hopefully, he'll be able to help you. I have to agree with the post above. Jeanne Drake was the one who assigned my file to a negotiator right away. If you don't get a response the first time you fax her a letter send it every day and then everyother day untill someone calls you. It will work. The best advice I can give anyone going through this is to be kind to the person who calls you. You may be frustrated and none of this is fair but if you are kind they respond much better to you. I found that my negotiator would just start talking to me about lilfe, and then since we had a personal connection I feel that she pushed just a little bit harder for me.

Recieved Phone Call today from Lost Mitigation

Hi everyone,

I guess my hardship letter worked....so far.

As I was about to leave from work my phone ranged and I usually do not pick up...try to avoid the traffic :-)
When I saw 904-996-9611, I immediately recognized the area code from the information given to me here...it was a gentleman by the name of
Mr. Roger Staggs who is the Manager of Loss Mitigation. He informed me that he had received the information from HopeNow that I submitted on 12 Sept 08 as well as the Hardship Letter I sent to Mr. Jim Davis last night by email addressed to Mr. John Thain, Chairman and CEO of Merrill Lynch that I FedEx on 10 Sept 08.

He informed me that he will be giving this information to one of his negotiators tomorrow and he will be in contact with me again sometime tomorrow. He also asked me did I have a buyer for the house and I told him the house will be going on the market Saturday (yes I finally found a reliable agent who specializes in Short Sales for my area and did not charge me one thin dime).

Mr. Staggs told me to write his number down as well as his name and if I had any questions in regards to the status to give him a call but he will stay in touch with me. He put me on hold twice but the strange thing is he was very apologetic telling me how sorry he was for doing that but he said he wanted to make sure I did not hang up. He was very nice.

So I guess we will see.

I also received this today by email from Lieutenant Governor Bolling office: I sent him a hardship letter as well. Please read below:

Thank you for contacting Lieutenant Governor Bolling to share your concerns with him regarding the situation with your mortgage company.



Unfortunately, there is little that he can do to assist you. This matter involves a private, contractual commitment and it would not be appropriate for the Lt. Gov. to try and intercede in such a matter.



The best advice that we can give would be for you to consult with an attorney or a financial advisor to assess your options.



I am sorry that we are not able to assist you in this matter. Please l do not hesitate to contact us in the future if we can be of assistance to you.

Make sure you stay proactive. If Roger does not call. Make sure you do. Ask for the name of who you should be expecting a call from once your assigned a negotiator. If he gives you the name, ask for the direct number. Ask for all you can upfront, it doesn't hurt -it helps.

Wathera, I will. I have a black book that I keep a log of every conversation, date, time. It's the same book I used for my 1st modification when I found this website. Should I call first thing in the morning when I arrive to work or wait until the afternoon...give them 4 hours :-)

I would give them a few hours and call in the afternoon, or maybe even 24 hours but I wouldn't give them anymore than that. If they said someone should call you today than they should keep their word.

I am hoping you get one of the good negotiators that have been named on the board.

Well, I can't believe it but I actually received a phone call back today from the Loss Mitigation. Mr. Staggs had a Samatha Green call me. She informed me before a negotiator can be assigned I would need to have the following documents sent in:

2-recent bank statement
2-recent pay stubbs
2006 and 2007 W-2s
Signed purchase contract Estimated Hud1
Pre-Approval Letter with no contingencies (WHAT DOES THIS MEAN)
Listing Agreement
Letter of Authorization
Hardship Letter (which they already have; Samatha told me to address it to the Loss Mitigation/Home Retention Team)

I've talked with my real estate agent today and informed him I receive the call and he is ready to get started but the sign will not go up until Saturday. I am so nervous and my real estate agent is so sweet and he keeps telling me not to worry; that it will work out.

Did anyone out here going through a short sale continue making their mortgage?

Hey Refuse - The pre-approval letter is meant to be from any potential buyers...not you. What AHMSI is saying is they will only consider offers that are accompanied with a pre-approval letter from the buyer's loan officer/lender. Your Realtor should be familiar with this...it's completely normal. Good luck!! I'm praying for a quick sale for you!

Thanks TxHomeowner I really appreciate it.

My real estate agent just left my house....he is the sweetest person and he knows what he's doing. He has explain everything to me in full detail including what you just stated. He also said I qualify for the new bill that goes into effect 1 Oct 08 and he is also going to help with that as well. He's going to start the process of trying to get us refinanced under this new bill.

I have given him all my documents...the sign goes up on Saturday and WE ARE READY!

Not stressing over this anymore...my husband and I are just going to sit back let our real estate agent do the work and see what happens.

Good evening refuse,
Were you able to get back your check from that real estate agent that was charging you before giving you her services? I hope you did. I see that you have another agent going. That's good if you did. Your real estate agent will be the one sending the HUD1, listing agreement to your lender. You send the w2's, pay stubs, financial hardship letter and the bank statements to your lender. Your lender is probably considering to approve a Short Sale that's why they are asking all these documents. You have to have a buyer that makes an offer to expedite the processing of Short Sale.

Refuse,
You need to give last 2 bank statements, last 2 pay stubs, Letter of Authorization from you and husband authorizing your lender to talk to your agent, copy of hardship letter to your lender first, then your agent will prepare the short sale package composed of
signed purchase contract both you and husband and agents and the Estimated HUD1, listing agreement, and a buyer's offer and the pre-approval letter of your buyer from her bank that she's approved to buy a house in the amount of whatever the selling price or the buyer's offer will be.

Make sure you put all the loan numbers on each document and mail it via certified mail, and also fax a copy for faster service.

Thanks for the response. The "FOR SALE" sign was placed in my yard this morning. I guess we will just have to wait and see what happen. I did get my check back as well as my mortgage statement I gave to her. Will keep you posted of the outcome...Refuse

Thanks elpjohnson...I will keep you posted. My real estate agent called this morning and he has two couples coming by this afternoon to look at the house...one at 5 and another at 6. That was fast..........

All,

I forgot to mention that my real estate agent on our first meeting asked me to request a Verification of Mortgage. He wanted to see and confirm who my investor was. I did this on line at AHMSI website and received it back through email. At the bottom of this form it indicates "Investor ID 448".

I did tell my real estate agent my investor was Merrill Lynch.

Has any of you ever seen this on your "Verification of Mortgage"?
