    Newbie Needs Help

    Hello, found this forum after searching for answers for help with the run-around I'm receiving from AHMSI. I've read most of the posts and everyone's situation seems so different, so I am seeking advice from those that have been there. Quick-n-dirty facts:

    • Fell one payment behind June 10. Applied for repayment plan Nov 10, was hospitalized due to high blood pressure in pregnancy, wasn't able to send in first payment of repayment plan.
    • After having baby Nov 10, called early Dec 10 to see if another repayment plan could be setup and was told no and no partial payments but I should apply for HAMP.
    • Familiar story here: faxed paperwork too many times to count. Kept receiving letters and kept faxing as instructed.
    • Received letter dated January 31, 2011 that all paperwork had been received and was being considered for a mod. Letter notes that home will not be referred for foreclosure.
    • Receive court papers dated February 2, 2011 that foreclosure lawsuit has been filed.
    • Promptly freak out and call AHMSI. Am told modification is in process and foreclosure will not continue but case won't be closed. Told I should wait 30 days to hear something about mod.
    • Wait 30 days and hear nothing. Call in. Told to wait one week.
    • Wait one week, call in. Told to wait another week.
    • Process repeats until 60 days have passed since paperwork was accepted.
    • Talk to someone who tells me my escrow is being calculated. Sounds like progress, so I'm pleased.
    • Still nothing, now at 75 days past when paperwork has been accepted.
    • Continue to call for status updates and get the same song and dance.
    • Finally get fed up and talk to someone who tells me he will get a status update on the mod and also a possible workout plan and he'll call me in a week.
    • He calls and mentions nothing of the mod but tells me I can pay $3,000 to reinstate the loan but can't seem to give me specifics on what the workout payment will be. Reinstatement amount is almost $12,000 and I am certain we can't afford the payments.
    • Am also told that since I requested a HAMP mod on my previous call (4/2/2011) the process will start over. I did no such thing. Apparently I was in for a traditional mod and not HAMP. This is news to me as in the 12 previous phone calls I was told I was in for HAMP.
    • Ask to speak to a supervisor, am told one will call me back by the end of the day.
    • Wait two business days and call back and go round and round with a rep before he lets me speak to a supervisor.
    • Explain all of the above to her and am told that a) my HAMP case was closed on 4/12 because of lack of paperwork and b) the reinstatement for $3,000 is total fiction and she has NO IDEA why the rep gave me this amount or where his information is coming from because we aren't eligible for a workout. (Sounds EXTREMELY fishy to me)
    • Freak out on this supervisor (highly emotional person here) and start to think my house is going to be lost because of their incompetence.
    • She tells me I was missing the year on the 4506-T and that's why my case was closed. I asked why no one bothered to tell me I was missing a date in all my previous phone calls or why I never received another letter informing me of this. She doesn't know.
    • She offers to help me with my new HAMP application and I can fax it directly to her. I tell her I will fax on Tuesday and she says if I don't hear from her by Wednesday to call. I call Wednesday and leave a voicemail. I call Friday and leave an voicemail. I call today and leave a voicemail. Still nothing.
    • Monday we received notification from AHMSI's attorney that a default judgement was being requested.
    So, that's my story. I've gathered here that I need to hire an attorney but would like some advice first.
    • My husband and I want to keep our home and have the means to do so. I am concerned at the rate the foreclosure case is moving. The house is not upside down, in fact we may still have some equity. Does this help or hurt?
    • It seems some have had success getting modifications but the pending foreclosure worries me that we don't an extended period of time to wait.
    • What experience does anyone have with foreclosure in Ohio? I see the Ohio Atty General filed a lawsuit against AHMSI. What bearing does this have on me?
    • Tell me briefly about the show me the note. What things do I need to look for on my paperwork?
    • I am crafting an email to Jim Davis. What other options do I have?
    • If I hire an attorney, what exactly should they be doing for us? I live in a fairly small town that probably lacks an attorney that can handle something like this.
    Thanks in advance to anyone that can give info, no matter how small.

    Hi Buckeye,

    I think you should call your Attorney General about this and then follow up with a detailed timeline of everything that has happened, supported by all documents you have. They have clearly given you the runaround and as they are being investigated then the AG may be intersted in all this information.

    I suggest you call Hope and give them all your information. They were very helpful when I called and can be a advocate for your case.

    Jane, thank you. What exactly can the Attorney General do? Is this simply filing a complaint to add to their growing list or can they actually help with this case? And I will also call the Hope hotline.

    Update: I did send an email to Jim Davis that was promptly replied to this morning with a promise that someone would call me in 24 hours. We'll see.

    The first thing you must do is request the lender to put a hold on your foreclosure judgement. Try a google search and see what the process and laws are for Ohio.

    You can also go the your county's Clerk of the Court website and see if you can do a search and look up what motions have been filed against you, and if they already have a sale date. You could also call the AHMSI attorney and get some more information on the timeline.

    Hopefully the contact with Jim Davis office will get some results. I recommend that you stress that you were turned down because they didn't receive ONE piece of paper, which you were never informed about.

    Thank you again Jane. I seem to have made some progress with Jim Davis' office. A Monica called me yesterday afternoon, we had a nice long chat and she promised she'd stick with me the rest of the way. She told me she works in the Office of the President and basically they don't take lame excuses or no for an answer. This was encouraging I re-faxed my paperwork yet again last evening and she called me this morning to say that she walked it over and within the hour a negotiator had been assigned. She informed me this meant the foreclosure would be put on hold and she would follow up on that on Monday.

    I'm cautiously optimistic. And I'm so glad I found this forum for the contact information for Jim Davis. I'll update with any progress!
