Jeanne Drake AHMSI VP FAX:866-642-4196 Jim Shaw AHMSI SENIOR VP FAX:904-996-9653 I was told by the Wells Fargo in house attorney that these two people are the ones to pressure. So lets pressure!!!! We need to jerk these investors off their high horse and let them know we are not going to stand for it!! Here is my letter. July 21, 2008 Attention: Jeanne Drake Fax: 866-642-4196 Re: American Home Mortgage Servicing Inc Loan Number XXXXXXXXXXXXX Ms. Drake, I have been trying to get our ARM modified for the past several months. I was originally told that Wells Fargo (the investor) was not allowing any modifications. I was then called about three weeks later and told that Wells Fargo was doing modifications on a “case by case” basis. I wired $500.00 and the process began. On July 18th I was called and told that my case wasn’t “escalated” enough for a modification. I couldn’t get a clear reason as to what “escalated” meant. I found out that the true reason for my modification denial was that I had not contacted the California State Attorney General and/or the local media. This is the most utterly ridiculous reason I have ever heard. How can they base a mortgage modification off of the exposure of media? I have a perfect pay record and a good credit score. I am not able to refinance due to the property values being down, so therefore modification is my only choice. We deserve a modification. I will not be ignored by the investor. I have talked with Mr. James Loushin the in house attorney for Wells Fargo. He gave me your name as a contact person. Can you please help me with this situation? I am ready to do whatever it takes to get this taken care of. I have my package with all correspondence ready to go to the Attorney General. I have a friend that works for KTLA in Los Angeles, and a phone interview set up with the Inland Empire Consumer Reporter Gary Mills set for 7:30pm Tuesday 7/22/08 so getting the media involved is not going to be a problem. As you know, I too have an investor that is unwilling to modify my loan my investor is Citigroup Trust and they are claiming there is a "legal" clause that won't allow them to modify my loan.....I can't really say what my attorney is going to do about it but hopefully he'll be able to get through to them. Which is way so many banks are in trouble anyway? I'm not to clear on that whole process but why should we have to pay for something we had no control over. I think you hit the nail on the head......the fact that our loans have been sliced and diced does have a lot to do with whether or not they will modify the loans. I think it's stupid and there has to be more than one way to skin a ***....I think there has to be a way to get it done.....it''s just finding that way. Ever since I received the rejection my husband and I are talking about an exit strategy just in case they refuse to modify even though we have violations in our loan docs.....I am still hopeful but not stupid....I realize that there is a great possibility we may lose our home in the end......I'll still fight but we're coming up with a back-up plan so we're not rushing to find a place to live.....

I have been trying to do more research on this because it all sounds confusing but a company shows that there can be modification on these types of loans. I mean seriously I would say 85% to 90% of all sub primers have probably had this happen in the height of the housing boom to their loan and not even know it. Your in my thoughts, hang tight and fight. I know thats a whole hell of a lot easier said than done, but you deserve to keep your house!! I wish you the absolute very best!!!! |

I submitted my loan mod paperwork a few weeks ago and was told to call back in November since my rate is not due to adjust till December. Judging from your perspective, does it sound like a legit response or a reluctant one? I was trying to find out what could happen to me and my home before the rough times but I guess they are not willing to do anything until the rate adjustment. I didn't get any more info from my so called "negotiator." He simply asked me to call him back in November. Anyone out there, do you think it is worth of waiting. In the mean time I have to make a payment on my hoemowners' insurance of $900 and $1,800 2nd property tax installment by November. I would hate to find out later that my loan mod cannot be approved and that I wasted my "cash" for nothing. The negotiator assured me that I am in good standing with them but didn't want to go into any details about my eligibility for a loan freeze or rate adjustment. i am seeking any advise b/c at this point I am not sure on what to do. The more I wait the worse it gets with the economy and stuff. Today's article on yahoo about the economic crisis and how much worse it is compare to what was predicted even a month ago puts wrong thoughts about may be.... foreclosing on my house? Anyone any ideas on this thought? |

Start now, there are some people that have been fighting for months and months to try and get what they want. Be very persistant. I have found out that each person you talk to at these mortgage companies are all different. Keep calling until you get someone to listen to everything you have to say. A loan can be modified at any time, not just because its getting ready to adjust. I feel your pain. But no matter what they tell you don't give up!! There is always someone else that can help you!! Guys....just got a call from the VP at AHMSI. I will update you all on that tomorrow when she calls me back to let me know how they are going to help me!!!!VERY INTERESTING and guess what?????? THEY ACTUALLY DON'T WANT THE MEDIA COVERAGE!! HOLY COW!! I am not getting my hopes up but this is the first actual action I have seen since this whole nightmare began. I can't wait to see what happens tomorrow.....I'll definitely stay tuned! Good luck by the way, I'm pulling for you! Is30mv.....steph is right, don't listen to that negotiator start TODAY! I've been at this since December 2007 and my rate doesn't adjust until August....I received a denial but at least I'm working on it (with an attorney) Whatever you do document everything, write the QWR, and apply for the loan mod or push for the loan mod asap. Well don't give in because im in line behind you...jose our negoitiator was suppose to have an answer last friday and now he is saying he needs to call me shortly to discuss my case before it goes to approval...well he is messing with the wrong "girly"...Ive been in this process since frickin December....i have already been in the paper here locally...so if its more coverage they want...they will get it..i will have every paper thru this little valley of mine and if need be i will post every email and document i have on U-tube until i have a response from these soo called people trying to help....this is crap...illegal crap and we have to stand together and not let this happen....

So far, AHMSI has been accustomed to deal with people who were either unable or unwilling to defend themselves. The tide is turning. The stronger "rear guard" is now coming into action. Tables have been turned and I (and others) are now receiving numerous calls daily from AHMSI & WF, calls which remain unanswered. The main reason being: you cannot trust what they say on the phone. We must continue to send letters make sure you copy then fax them to home retention. Be sure to send them CMRRR. Certified Mail Return Receipt Request. This way should you need to go to court you have documentation that shows the court you were trying for a mod. Keep good records. Remember any phone conversations mean nothing. Get everything in writing. I also think it is a great idea to find out who your investors are. Remember AHMSI is just the middleman. They just do the paper work. We all need to send a written request to AHMSI to find out who is the investor for our loan. They will not tell you over the phone, but I believe they are required by law to furnnish you with the investor name if you so request? We may need an attorney to confirm this but I believe I read where they are required. So get the name of your investor then work on them. Good luck and keep the pressure on them. acesfull |
