As I can see, a lot has changed around here......but it looks good Moe I was really excited that AHMSI pre-qualified me for the HAMP program but that turned to crap when I found out today that my A hole investor is not participating in the program nor are they doing conventional modifications AT ALL !!! (same thing I was told when I got my first modification). And for those who never read my success story, 10 months of drama, I had to hire an attorney to get that modification done. So here I am....my husband is on workers comp, we are in debt and are having a hard time with our house payment (still huge) again. I just don't know what to do since my investor doesn't do modifications......any suggestions? Nice to be back!

We were declined today for a HAMP and were told that our investors are not doing ANY modifications at all. What recourse do I have? I am trying to do the right thing and continue making payments but I cannot afford the payments and was hoping for a lower payment plan. I want to stay in our house and am sick with worry right now. I am currently 3 months behind. |

All I was was told is that my investor is not doing ANY loan modifications at this time. Do you guys think going through NACA will help? I am running out of options. AHMSI offered a repayment plan but it just added my late payments to it and made my monthly payment go up another $300. Obviously, I can't do that if I am already behind right now. Seems like the mortgage company wants me to default so they can take my home. Can anyone recommend my next action? |

Luis Trejo is my negotiator and I'm back in the loop of not being able to get a hold of anyone, including my negotiator. I wish you good good luck again. Maia |

I am back too after losing 40% of my income and putting our son in O/T for his learning disabilities. I would rather live in a shoe box than forego his treatment. Here is my story: I stopped making my payment in September...now 60 days behind. I just received a loan modification trial period plan approved under the HAMP program which shaved a mere $160.00/month off of my monthly payment. I am upside down about $800.00/month so $160.00 is pathetic to say the least. They forgot to tell me where to scrounge up the other $640.00!!!! All I needed them to do was lower the interest rate to 3.5 or 4% over the next five years to get me out of this pickle. The house value is upside down by almost $300k...I just don't get it. My investor is Wells Fargo Trust AFBC whatever... I am not sure what to even do now. I also received a letter from an attorney stating that they had been contracted by AHMSI asking me to pay the back $12k that I owe...laugh! laugh! One more note...My modification trial which arrived in my mailbox USPS was dated 10/26/09. But, I also got a letter from AHMSI dated 10/27/09 requesting more information so that they could evaluate my situation. Does anybody know what that's about? Which is which? I don't understand how they would rather take my worthless house back than reduce my interest rate a lousy 2.99%. But then again, that's why we're all here. Once again, we'll keep each other posted. |

Then we have got to develop a plan of attack. Sometimes I wonder if it's the banks just passing the buck. In any event, if they say the investor doesn't participate, I would definitely send them a Qualified Written Request. They need to "produce the note" if they are going to foreclose.

Do you just fax a request and if so, where do I fax it to for AHMSI and what exactly am I requesting?? New to the modification process.... or is it an official form I can find online? I sent an email to Jeanne Drake/Jim Davis asking for assistance since my investors won't modify my loans, but no response yet. I know they read my email just not sure if they will do anything. Also sent email to my State Senator asking for assistance....not sure if it will do any good but I figured if I made enough noise long enough, someone will pay attention. Just worried as we just hit our 90 days late mark and I know our credit is just so bad right now. I am also worried because my husband is looking for work and some of the jobs he applied are for military contracts which require a credit check, so that ruins his chances. Feel like we are going in circles with no solution in sight. Sorry for ranting..... |

I am sooooo sorry to hear things are not going well as far as your loan with OOMC/AHMSI is concerned. They are nothing but a bunch of a**holes!!! See my thread about their response to my letter of recission; they're denying that they're in violation of TILA even though I was NOT provided with two copies of my right to cancel as required by law. GRRRRRR! And my foreclosure trial is a week from today, and i'm getting a bad case of the stressies now, especially since I don't have a lawyer :-( My lawyer dumped me earlier this summer, after a year of representing me. His area of practice is bankruptcy and he basically sat on his !*^$)!# hands the whole time; the only thing of value that he did was get me continuances (which of course I was grateful for), but that is it. What you and the others can do about finding out who your investor(s) are, look at the foreclosure papers you were served with, and then Google the trust series it is in. My loan is under Option One Asset-Backed Series Trust 2007-4 or something like that (I don't have the foreclosure paper right at hand here) and I Googled that, and found a letter online between two banks and my loan was listed in their securities portfolio right there! So if you do that, chances are you may find out something about your investors. Good luck and please tell me if you find anything! Hugs to you all! Sally |

I decided not to reapply for the HAMP modification because I was happy with my traditional modification. I also see so many more problems with the HAMP I am noticing a trend of seeing"trial payments" and then all of sudden people being denied. I applied for a traditional modification in February '09 right before the HAMP loan mod became an option. I would contact your negotiator to see if a traditional modification would be an option if you can not be approved for a HAMP mod. |
