Any One moved out of there home and then moved back in with the intention of Keeping home?

Hi, I am new to this website, I have been reading posts but none appear to have the answers i am looking for. I am 19 payments behind, My original servicer was AMC, I had given up because of Lack of information. In Oct 08 have missing so many payments and being served with Lis Pendens documents decided to move out thinking that they would Foreclose immediately. After a few months my loan was sold to AHMSI, they began calling me, which I found strange because of the previous documents served. They asked whether I would like to keep the home, I advised that if payments were affordable we can look at it. In August 09, i filed a HAMP application which at the time I told them was not living in the home but that because of the mold i could not go back unless i repaired it. They said it was fine and that not living there should not create a problem. After about 60 days they advised that the application was denied because I did not live there. "DAH" anyway, that they would consider a Traditional modification. Today is November 2nd, 2009, I was told that it is still under-review. My 1st mortagage is $234K, second $69K - value on last property tax bill $157K - My regular payment is $1838 1st, and 2nd $639 excluding property taxes and insurance. My husband would really like us to keep the house and is advising that we move back in the house and then re-apply for HAMP again. He feels that I should file BK 13 if its not approve and then try to keep the home. Can anyone give me some ideas or suggestions of how they would deal with this or if there is someone in a similar situation. AHMS keeps telling me there is a Sale date that keep moving forward but I have not gotten any paperwork to this effect. Also one last thing my husband income is maybe 1000K a month and mine is $3700K per month if that helps with ideas? Which means my payments would have to be about $1500. I await any responses. Welcome
1st thing look's like you need the HAMP why you are way under water like most. Try to re-apply for HAMP (Yes), but you will need to have hardship that they will accept. If it were me I would make it look like I live in the house because of the mold, plus unless you have very little luggage that might be quit a bit of work for a short ending! You need to work with the 1st mortgage the 2nd will wait for now. Most here will use BK-13 to strip the 2nd because you are now unsecured and you can also deal with your CC.

Thank Badbob for your input. I applied before for the HAMP, apparently they send someone out to do a field inspection. What do you know about NACA? Do you think thats an option?
