Nominated 0 Times in 0 Posts TOTW/F/M Award(s): 0 | Hi, We are dealing with AHMSI3. Several yrs. ago we refinanced with AMC. (Bad idea) After a rate chg. in mortgage payment, it became difficult to make the payment. Three years ago we fell behind in our mortgage payments so the only way to stop the foreclosure was to file Chapter 13. With $17.000 in arrears, a few other debts included, we started back making the mortgage payments. Until Feb. 09 we had been making the payment, still at 10.6%. Now we are four months behind & in May submitted a loan modification package to AHMSI3. Two weeks after submission we get a form letter with a check mark next to the statement: Not enough income to cover household expenses. So after reviewing the financials, we discovered that I (the wife) had made some crucial mistakes in our expenses. Our Chapter 13 payment covers a car payment, which I listed again. Also my husband obtained a week-end job since applying so we have more income now. In mid-June we faxed the package again to the fax # AHMSI3 gave us, we called to confirm, the operator told us to wait a week to ten days to get it assigned to a negociator. We called for two weeks & finally someone told us they didn't receive any package. So Carolyn ( an operator) told us to fax it to her. We faxed it to her & the AHMSI3 general loan dept. on June 25. On June 29, the package was first assigned to a guy named Ruselyn ?. We waited the week to call back with any updates on our file & were then told that the package had been re-assigned to Nancy Thomas. I left her a voicemail on Thurs. July23 with our concerns. On Sat. July 25, we received a letter from Brock & Scott attorneys stating that if the payments due from March, April, May, & June were not made current within fifteen days, foreclosure proceedings will begin. In our Chapter 13, the trustee gave Brock & Scott the right, if we fell behind on our payments, to pursue securing their assets. We cannot come up with those payments, we can make a 5% loan payment, not 10.6%. I have contacted our Chapter 13 attorney by email this week-end. I will likely hear back from her tomorrow. We are desperate to save our home. Our two teens go to school here, our elderly parents live here, as well as other family members. We have put every penny we have into this house to keep it. We have no other funds besides some equity in this house. If we lose it in a sale we will be broke & ********. We are at a loss as to what to do next. Who can we speak to at AHMSI3? We just need some kind of answer before this goes to the point of a sale on our house. If they won't mod. the loan, will they let us know soon? It seems someone has had our package since June 29, I guess, who knows, we can't speak with anyone to make sure they are even looking at it. We just want to do everything we can to save our home, so even if we don't, we know the ball was not dropped by someone & we tried every avenue. Any advice from anyone at this point would be welcome.
