AHMSI horror story my home is gone

In October 08 I knew I would be in trouble making my mortgage payments very soon so I contacted American Home Mortgage Servcing Inc...(remember they say they are a bill collector)....and I was sent the loan mod papers. Filled them out, sent them in and within 10 days was contacted by a Brian, very nice guy. He said, due to my debt load (substantial at that time, I had lost a business in 06 and still had about $30K in debt) they could only reduce my payment about $50. On my $10/hour salary that wasn't enough. He suggested that if I was able to reduce the debt load things might look better. I told him I was considering bankruptcy. He said again a reduction in debt would help.
I filed bankruptcy in February 09...I resubmitted modification papers in April, as AHMSI indicated they couldn't evaluate anything until the bankruptcy was discharged. My trustee sale date was scheduled for June 1. I was unable to actually speak to whoever was working on my loan mod, just people in the call center (who remarkably were from the USA).
In late May, having heard nothing, I called to follow up and was told that the process takes 30-60 days (funny in October it took 10 days) and is no guarentee that the sale won't take place.
My bk was discharged on June 1. I immediately called AHMSI and asked where we were in the process now that the bk had been discharged. The call center people said they had no information on the discharge. I told them that's funny I have the letter from the court in my hand. They said as soon as they had notification in hand they'd be moving forward.
About ten days later I got a letter stating that a new trustee sale date was set for July 13. I called them again and said I have papers in process where are we! Again NO information...just a rude woman telling me just because i filed papers didn't mean I would save my house...AND then she said, if the person looking at the loan thinks there is a chance they put a hold on the sale. Since there is no hold on the sale, it is not likely the loan will go through.
I waited another week called again and this time I was really upset and got transfered to leave a message with a supervisor. I'm pretty sure there wasn't a supervisor just some answering machine they dump you into so they don't have to deal with you.
On July 6 with only a week to go, I went to my local bank (they happen to have a second mortgage on the house) and asked if they could help get some answers. My banker got on the phone and waded through the call center, I gave verbal confirmation that they could talk with him and he went round and round with the call center woman who just couldn't seem to find any information, except that the person reviewing my case (ms Black) had been "let go" and it was now with a Ms. Chapman. He asked to speak to her and of course wasn't allowed to do that...apparently these people are so completely insulated that I doubt they exist at all.
I had to go back to work and he stayed on the phone. He called me about an hour later to tell me after about 45 minutes on the phone the woman he was talking to said my loan modification had not been approved due to lack of income!!!!!!!!!!!!!
I have the exact same amount of income as i did in Oct 08 when i was approved for a slight reduction. The big difference is I have NO DEBT. Yes it was thru bankruptcy, but for crying out loud, it was the only avenue I had and I thought it would help save my home! The next day I called AHMSI and talked to a guy in the call center called "Billy". He said my only option for not having my house sold at auction was to get a reinstatement to pay all that was owed from the date of foreclosure to the present. I asked what that figure was, and of course he said he didn't have it. I asked for the paperwork and he said it took 48 hours for it to be faxed....so I said well that would be Thursday so please fax. Since I figured this would not go well I called the Housing Authority for help.
I went to the local housing authority office who went thru my paperwork and told me exactly what the loan officer would be looking at. In the housing authority's opinion declining the loan mod would be appropiate given my income (or lack of), he couldn't explain why i was approved in October with a huge debt load. He tried calling AHMSI and was put thru to Ms. Chapman's voice mail (these people do not answer their phones) and asked for a hold on the trustee's sale as there was a possible buyer (there was in fact).
July 13 comes and my house is auctioned off. I call the next day to find out what happens next and am told AHMSI doesn't have information on who bought the house (oh please).
On July 15 I start getting 800 numbers coming up on my cell phone...not recognizing the number and thinking it's a telemarketer I don't answer. Finally after the 5th call I pick up and it's a recording from AHMSI telling me to call another number. This time I get a woman who says the house was sold (and no she doesn't know who) and I need to contact the "EVICTION Attorneys". That really makes me mad as I know I have to leave, but I don't feel it calls for eviction attorneys. We get into a bit of a heated exchange as I asked where my requested paperwork to get a reinstatement was. She says she doesn't know. I get really mad at this point and hang up.
About three hours later the phone rings again and it's AHMSI and a very nice pleasant woman says cheerfully, "your trustee sale date is on hold, and we're just wondering where your reinstatement paperwork is". Amazing, I say, you need to check your facts...my home was auctioned on Monday. She says she has no information on that, puts me on hold for about three minutes, comes back and apologizes for the misinformation and yes my house is gone.
So I say, it amazes me that you guys have no idea what is going on with anything, no wonder no one is being helped. And, further more I never got the paperwork that I requested. She then loses her nice attitude and suddenly has a bunch of information. She informs me that I waited until the last minute to ask for the papers. I inform her that I only waited because I did not know my modification had been turned down until one week before the sale date and then I wasn't told, it took my banker to get the information. She then said, well AHMSI called me earlier in the day and I got upset! Duh! This amazed me because she had called to tell me the sale was on hold and seemed to be clueless that I had been called.
I then said, "yeah, I was kind of upset that my house was sold out from under me, when i was trying to save it, sorry. I just need to know who bought it and how long I have to get out."
She says I have to call the eviction attorney and they tried to give me that phone number but I hung up on them. And I said, 'yes I did, because I'm a little emotional". She gives me the number. I hang up, call them and guess what I get an answering machine with a vague message to leave my name/address etc and they'll get back to me. I ask them to make any phone calls directly to my lawyer and leave his name and phone.
A week goes by....I hear nothing. I go to the lawyer and says it's been ten days since the sale and I'm not hearing anything. He hasn't either. He calls and of course gets no answer. He writes an email and informs them that it is likely the foreclosure was fraudulant and they need to contact him immediately.
That evening I come home to find an envelope taped to my door from a realtor. It was my 'Hi, sorry your lost your home, I'm going to be helping you through the process of leaving on behalf of AHMSI and they will give you money to help you. The letter further goes on to say that eviction proceedings are in process and that it is better that that doesn't happen as it is stressful on the day of lock out. (I just would never have thought that...duh).
I call the realtor and tell her all further negotiations are going thru my attorney and give her his phone number. She says, fine she'll let the "bank" know. I resist telling her AHMSI is not a bank, but apparently a bunch of loan sharks who do a pretty good job of shaking people down.
So that's where it stands.
I live each day in fear that I will be locked out of my home. My attorney has told me to have no further contact with them. However he did encourage me to give my state's attorney general's office the story as well as all our legislators. (I have no faith in them, but what the hell).
There is a special place in hell for these blood sucking jerks at AHMSI...I just find it amazing that my income was the deciding factor, and that in October it played no role what so ever.
Oh, and big surprise, American Home Mortgage Servicing now owns my home (they bought it for $108,000....wow, such a deal....I coulda sold it for $130K).
Good luck to anyone dealing with this company. For me, where I live, having a bankruptcy AND a foreclosure and a low wage, means I'll be ********. I can't wait.

Thanks for the Story and welcome, this seems to be happening to many folks and not just your bank but others as well, that is 1 reason I will not do any Forbearence or deals for mod untill in writing, and no I do not believe bankers are this dumb, its all there game flip any property to new owners make a profit even if they take a loss they still gain, WRITE OFFS, biggest for the rich to keep getting richer..

I am so sorry to hear about your story. I am dealing with AHMSI myself and I can vouch for it being a NIGHTMARE!
However, I am determined to fight for our home and have even gone to the Circuit Court to file a complaint against the company.
We need to lobby to our Congress to get more HELP! Why the heck are they bailing out the banks instead of the people who really need it, US?
I shall keep you in my thoughts and prayers and give you strength to continue and recognize that although it may seem like there is nothing left to do, there is ALWAYS something left to do. There is a way for you to get your house back, you just need to find what that is. The realator who bought it perhaps will negotiate it back to you?
I don't know the answer, but I do say to you. Allow yourself to be open to the possibilities. EVERYTHING IN LIFE IS NEGOTIABLE! Don't give up, you have me in spirit by your side fighting with you.

OMG.. that is HORRIBLE!!! You have my deepest sympathy, MKH and hope you can find a way to fight back and hold to your house because it seems to me that the wholel thing was/is riddled with fraud. What did your attorney say about your loan terms and so on and so forth? I would bet you dollars to donuts that your mortgage is chock-full of deliberate errors, falsehoods and whatnot.. I got my mortgage with these bloodsuckers when it was Option One back in 2006 and I've found this and this and that in the papers (falsified income for one thing) and intend to fight back with everything I have in me. They are NOT going to take my house from me -- NO WAY!!!! You hunker down and give 'em hell!

You've got my blessings too, as does everyone on this forum. No matter who our lenders are, we're all in the same boat and fighting mad!

TO ALL CONCERNED WITH AHMSI

This collection agency has wormed its way to a "lender" status by wheeling and dealing with some financial institutions but they have kept their mode of operation and their lying practices.

Any attempt to deal with them in an ethical manner is doomed to failure. They will pretend to work with you only to bury you deeper in debt and wrap you up like a spider prior to suck you dry. Their only goal is to foreclose on your home for profit, for themselves and for their patrons, the rogue banks which are helping them under cover. The millionaire who "officially" owns this agency would not have the power to break the law so blatantly and continually, unless he too was bolstered by more powerful crooks.

There is only one remedy to this monstrous destruction machine: A Class Action Lawsuit.

It is under way.

Thanks a bunch for the contact info for the lawyer handling the class action! I've just sent him an email asking for details and what I need to do to join in.
On what grounds is this class action being filed? Do you know if the litigation will stop any and all foreclosure action until the litigation is over? (I sure hope it does -- my nerves can't take much more of this, even though my foreclosure trial isn't until late November. I can just hear the slow and inexorable ticking of the clock).

By the way, that is just unbelievable that they would refuse your offer to pay off the mortgage so that you could have the house free and clear..... geeeeeeeez! So they don't want the money, but the house itself? Un-be-liev-able! There's just no rhyme or reason in these !#*%!!^$)& crazy schemes these lenders have us innocent homeowners ensnared in, but I can tell you one thing: I WILL NOT let those vermin pluck me from what is rightfully mine.. HEAR ME ROAR!!!
