AHMSI Is Back for More Money

Hi Everyone,

It's been a while since I have been here but AHMSI is at it again. Not sure how many of you have read my issues in here but I received a a call on New Years Eve day from my negotiator informing me that my modification request had been approved, that I would received the paperwork for signature sometime in January 09 for my husband and I to sign and return. We received, we signed and returned. First payment which included taxes and insurance (which is exactly what we wanted) was due 1 April 09 (could have been March 09). Anyway, I made the new payments with no problem and on time as usual.

Last month, June I called in my payment and was told me payments had increased by $2000.00. I asked why and they stated because they paid by property taxes on 23 May 09 but I never received any notification that it was paid and I informed the person on the other end of this. A week later I receive a letter stating the property taxes had been paid on the 23rd of May 09.

The young lady on the other end told me that my negoitator should have told me that my mortgage payments were going to increase. I told her I asked that question when I was informed of my approved modification and was told by my negotiator that my taxes would be paid but put on the end of the $300 and some odd thousands of dollars that is just sitting somewhere.

I asked her could I pay my approved modification amount and she stated she could not take that payment because it did not include the increase of $2000.00. There is more, much more but to long to go into. The young lady stated she was going to send my negotiator an email informing her to get in contact with me. Have not heard from her. I have tried calling and leaving a voice mail and nothing.

On 1 July 09 I called to try and make my June and Juily payment and they will not accept either. I called again yesterday and some supervisor told me my modification was disapproved in February 09 and I told her that was not possible when I have the documents sent to me informing me it was approved. She then stated "O, I'm sorry I made a mistake". What the ????? She told me I needed to contact my negotiator and hung up.

THIS IS IT!!!!! I am not going thru this anymore. ENOUGH IS ENOUGH.

I contacted a Mr. Steve Giannini with Chase Residential Solutions which I got from this website. Does anyone know if this is a legitimate company? Does anyone have any suggestions of what I should do. This time I refuse to stress out especially when I have the money to pay.

Re: AHMSI Is Back for More Money

I am sorry to hear that you are STILL getting the run around. As far as the Chase residential solutions, I am not too sure about this firm. But they are not a true law firm and I would be a bit concerned on using any non-attorney ran firm.

It seems like this would be the perfect time to send a qualified written request??

Qualified Written Request | Home Loan Forum - LoanSafe.org

Quote:
When you contact your servicer in writing, make sure to document and include your account number. You’ll want to clearly explain why you feel your account is incorrect. Make sure that you send this separate from your payment and don’t send it to where you send your monthly mortgage payments. You’ll want to send it certified mail or fed ex to your mortgage servicers customer service address.

Within 20 business days of receiving your letter, your mortgage servicer must send you a written response acknowledging it. Your servicer the has 60 business days, to correct your account or determine that it is accurate. Your servicer must then send you a written response of the action it took and why, along with the name and telephone number of someone you can contact for additional assistance.
Whats this do? Places your file in front of the real decision makers and if abuse is spotted, you will get help. I would send it fed ex with signing by recipient.

Moe,

Thanks for the quick response and advice but I am just tired of dealing with all this. Can you suggest a good law firm? I think I just want to put the house up as a short sale.

Re: AHMSI Is Back for More Money

Sorry for the late reply. The best law firm that I know of is in California and that is Fransen and Molinaro. They have two great Realtors that handle the short sales. If they are out of your area, they can refer you or work with you in locating a suitable local Realtor and help manage the process.

I don't blame you for being at your wits end and you have to do what is best for your mental health. Stay strong and please focus on yourself and future. You'll make it out of this stronger and wiser. I promise!!!

Re: AHMSI Is Back for More Money

Moe,

Update! I received a call from American Home Mortgage today, Home Retention Team informing me that there were some errors on my account. I guess they called because what happened on Friday.

I spoke with a supervisor by the name of Flo, ID #FF1. She did not tell me there seems to be quite a bit of errors on my account but she would need to research it further. She also stated it seems since 1 March 09 I have been paying to much for my mortgage based on the modification they have on file.

She told me to hold on to my mortgage payments (June and July) which I have been desperately trying to pay since June 1.

She wants me to call back on Friday. She also stated she will provide a letter to me in regards to June and July payment stating I tried to pay but was unaware of the errors due to their fault in the account relating to the increase of $2000.00 for property taxes paid in May 09 for over $6,000.00 She also stated I will not incur the late fees for June and July.

Something smells fishy!!! What do you or anybody who reads this think? When I call on Friday I am also going to ask about the Obama Plan.
