    file submitted to WF from naca

    Quick question my request was sent to Wells Fargo on the sixteenth of feb. I was working with a company for a modifacation during the summer of 2010 which I paid $3000.00 and they turned out to be a scam!!! If their company is still on record (which I told WF to take them off). Will wells fargo recognize that I am now working with NACA? I also had to work with hope for homeowners from the start. I started my remod consideration in june of 2009 it has now been twenty months of trying to get them to work with me. It has been nothing but a joke but I'm not laughing can somebody please help me!!

    I am glad you came to this forum with your questions. It is a great resource for our members.
    Wells Fargo will recognize NACA and that you are working with them. If you should call them to be sure they have your file, please ask for loss mitigation or home retention departments, then ask for a representative that specifically works on NACA files.

    as your figuring out you don't need to pay a loan mod company you can do this on your own.

    it really comes down to who owns your loan which will determine which path you will take

    I have a question. Ever since WF recognized that I had a file with NACA, they have gotten completely horrible. Not that they weren't before. My home is actually a Wachovia Pick a Pay and I was finally making some progress, but since they found out that I have a file with NACA, they have escalated my file, which I thought was a good thing - WRONG!!!

    I am on social security and they asked for a benefits statement that I will receive on the 20th of this month, but I have a sale date of August 26th, which Ms. Lopez reminds me in each and every email, WILL NOT be postponed, nor will I receive a trial payment offer. So what exactly are they doing? I was under the impression that they had to postpone sale dates while you were in review for a HAMP mod., but it seems that they are not willing to do anything at all, and are only wasting my time. Does the fact that I am working with NACA make them more determined to foreclose? Also, I haven't received any notice of trustee's sale except through email. Nothing on the door, nothing through certified mail. The NOD was filed in 2008, and I reinstated. But I checked the trustee's website, and there is a sale scheduled. I know that's not legal!!!!

    I guess my question would be, does WF really hate NACA and anyone who works with them?

    Wells Fargo does not want to modify anyone and only modifies a few to remain under state Attorney General's radar. Sounds like you have them pissed and they have created a negative file on you. I know this as I am known within the President of Wells Fargo on a first name basis.

    Unfortunatly your chances of getting anything done is slim. I was with naca for over a half year and the same thing happened to me. I fought for my house for over two years and was just fed lies and misleading info. At least with naca it is proven that they get all your docs. But it all depends who your investor is wells fargo will tell you your investor is participating in mod programs when their not. I believe it is a ploy to string you along for a couple of years, so even to file chapt 13 becomes tricky. Because your so far behind. Chances are their not going to do anything. Your last line of defence is to file bankrupcy to keep your house. Your credit id already destroyed from their "trial periods" and help so why not file chpt 13. Plus if your house is underwater and you have a second loan on the house you can get it stripped off. Bankruptcy sounds scary but it is the only avenue left to keep your house

    Any suggestions, other than ch. 13? I'm sure I do have a negative file with them. I have always gotten my docs in on time. They know that I reinstated, in addition to the fact that they have no idea where the actual deed is. I have also started having a family friend fax all doc's from her work, the title company where my loan was first originated, and have begun a forensic audit. Not that I think any of this is really going to give me my house free and clear, but maybe just push them into doing what they should have done 2 years ago, give me a modification!!!!

    I live in Utah, like Jeffrey, so none of that really matters. I know that they are required to post the NOT on the door and advertise it, and they have done none of these things. But I have heard that this has happened and nothing has been done about that either. I think my best bet is the NOD. It was filed in 2008. Since then, I did pay the reinstatement, but they never rescinded and there have been about 8 Trustee's sales scheduled, all of them cancelled. Shouldn't they have to file a new NOD? Or am I just grasping at straws here? Really, not willing to just give up, they are liars and crooks and I am not going to quietly give up my house just because I asked for help from NACA because I was getting nowhere with them.

    Remember if you reaffirm on a house in bankruptcy you must ask yourself one thing. Will this bank abuse me after bankruptcy. They wanted to give me another HAMP trial and I told them I already paid for one and was not going to pay for another one.
    I do have them for an unnotarized Substitution of Trustee. Read Utah Title 57-1-22 , 57-1-23, 57-1-24, and 57-1-25. They do not have to file another NOD unless they rescinded the other one.
    I have an Order before the Judge for the immediate return of my property to me.

    They still haven't ruled on that? Is there a time limit on how long the judge has to rule? I pray you win that, for everyone here. You need that win, and so do the rest of us.

    I don't know. I have thought about it bk, and with the amount rent is, its a catch 22. To rent a house, and that's if I could qualify seeing as how my credit is completely wrecked, I would be paying twice as much as the neg. am. payment was on my mortgage. But I can only do that if they will modify, because there is no way that I can make up the past due. I do know that WF are crooks, so no, I cannot trust them to do the right thing.
    I looked at the NACA file today, seeing as how I applied for one over a year and a half ago and forgot about it, and the person reporting from WF is reporting that I have not submitted any doc's, that I have been unresponsive. Its complete lies. I did ask that because I had minutes on my cell phone that we not have to talk every other day long distance about the same thing. But never unresponsive. Since using email, I check in every day! These people are wacky. And they've been reporting this junk to NACA for over a year. Does NACA really help, or does it just make things worse?

    If you file chapt 13 you have a 5year window to pay back the arrearage unfortunately you have to pay back any fees on their end including foreclosure/attny fees any late fees and usually 10% of what you owe for bankruptcy fees. Our credit is already shot because of their lies. I had an A credit rating and I was not behind on my payments. 2years later my credit was junk and I owed all these late charges. ONLY BECAUSE I DID EXACTLY WHAT WELLS TOLD ME TO DO. I don't know if utah is a recourse state or not. It all depends how bad you want to keep your home ALWAYS have a backup plan because they will LIE to you right to the very end I never thought in a million years I would have to file bankruptcy but things are under ny control now and getting back on track good luck and I'm sorry you are going through this. Keep your head up!!! There is a special place in he!! For these mortgage companies

    Hello: I just wondered how everything worked out with Wells Fargo. We have been dealing with these idiots since 2009. Similar story to yours;They put us in HAMP then took us off with no notice ("the investor does not participate") right after the trial. The investor is supposedly FHLB. They don't "do this" they don't "do that". We are in foreclosure now because we so sick of their crap. I saw your post and wondered how you came out with them. Please advise when you can. Thank you!!
