Nominated 0 Times in 0 Posts TOTW/F/M Award(s): 0 | PETITION TO THE U.S. GOVERNMENT FROM AMERICAN HOMEOWNERS We the undersigned strongly advocate that the Federal Government create immediate, transparent and more equitable regulations for the banking industry regarding loan modifications and pending foreclosures, particularly in regards to HAMP and 2MP. Tens of thousands of homeowners across this nation have spent hundreds of hours dealing with mortgage servicers who have little incentive to actually help them/us achieve permanent loan modifications; while in the process of obtaining a modification, many homeowners have been lied to, misled, foreclosed upon or threatened with foreclosure. We propose an immediate halt to all foreclosures until new, mandatory guidelines are established and that these guidelines be overseen by a new Consumer Protection Agency, which was recently recommended by President Obama and endorsed by Sheila Bair, chair of the FDIC. We also demand that these guidelines include not only a simple 31% of the borrower’s gross monthly income, but that the Net Present Value (NPV) test: (a) be created and administered by the government, not the banks, (b) have its data, assumptions and formula published so that they may be verified by the public, and (c) be made available at www.makinghomeaffordable.gov in a calculator form so that people can learn immediately, with the other eligibility questions available there now, whether they're eligible for HAMP. We are also strongly advocating that additional guidelines be formulated that would open the door for modifications at an even a lower rate in significant hardship conditions and for rightdowns of principal when homes are severely underwater . We propose there be clear and enforceable guidelines regarding the time between the initial request for a modification and the achievement of a permanent modification, and that there be no reward to the bank for a trial modification. The rewards, if any, should be only for successful permanent modifications. There is documented evidence that the current system is not working, as reflected in the rising foreclosure rates across the nation and the thousands of people who attend NACA “Save the Dream” events in an attempt to get their loans modified. There is ample evidence that the current HAMP and other modification guidelines are being interpreted differently by each bank, reflected in many places including the scenarios described by the 20,000+ members of the loansafe.org community. Additional evidence can be found in hundreds if not thousands of complaints and requests for assistance sent by struggling homeowners to their Senators and Congressmen across the country, as well as the Office of the Comptroller of the Currency and other agencies that have been instituted to regulate these banks. Mr. Bryan Bolton, SVP of CitiMortgage, has stated that “modifying within HAMP guidelines is in the best interests of our borrowers, our country and our company. With or without fees, it’s almost always in the best interests of the servicers to modify.” Unfortunately, these are empty words. Mr. Bolton, like so many other CEO’s, tells Congress one thing, while he and they continue to do quite the opposite. Tougher mandates need to be placed on these banks that are simply not modifying loans at the rate they could or have been perpetuating to Congress and the media. Homeowners are not the ones not complying with the rules. The banks are creating their own set of rules and regulations and are consistently “losing” paperwork during the application process, denying modifications for unjustifiable reasons after the trial payments have been successfully completed, and proceeding with the foreclosure process. This is often happening unbeknownst to the homeowners who are still faxing, mailing and e-mailing reams of duplicated documentation as requested by their lenders. The American Dream has now become the American Nightmare courtesy of the banking industry, which is taking a cavalier approach to the stress, heartache and despair caused by the current lack of oversight, transparency and enforcement of loan modifications. It is of the utmost importance that action be taken to correct this travesty in order to preserve home ownership for the thousands of Americans that are and will continue to be struggling in this economic time. Do you want to see a change????? It won't happen unless we PUSH. I know alot of the signators are my friends who are NOT on loansafe. So pleaaassse loansafe - get on these! You have gotta get this out there and sign it yourselves.Sorry for the bolding, but I'm a bit annoyed. What is stopping anyone from signing these? We haven't made a DENT. |

Afterall, I was completely ignorant in this journey when I began in March, 2009. I voted for the President because he had a plan “for change”, remember? Change my ass. He said he would have a moratorium on foreclosures. Right on I say. He will put a plan in place that provides homeowners the ability to stay in their homes by modifying their loans. What? You are awesome. Just what we need. I will definitely vote for you because your opponent is only offering SSDD. I have had enough over the past 8 years of the previous administration and I do want A CHANGE. TARP funds was introduced. Finally, I thought. A cut and dried process to modify my loan. After all, I met those requirements listed on the makinghomeaffordable.gov website, right? I am suffering now because the GOVERNMENT did NOT regulate the financial industry that created this mess in the first place. I ask the government now, “Where the hell were you when I saw prices double practically overnight?” No where. That should not have happened. How did a “fly by night” mortgage company set up shop and do business without regulation? I believe that was your job, Mr. Government and you were asleep at the wheel. Or should I say shoving your pockets full of money? Should be only a month or so and I will get a payment that is sustainable. Oh. Wrong again. I have spent over 600 hours educating myself on this issue. It should be a part time job but I am not getting paid. A lot of good that does. It only adds to my disastrous financial situation. This is political people. No two ways about it. I hate politics. I started voting only two years ago. I educated myself before going to the polls instead of the ennie, meenie, minnie, moe method. I felt like a real true-blooded America. Did my duty. Educated myself. Voted for the candidate who was most qualified. Yeah, right. I living in Vegas at the time of the real estate boom and I saw the prices of real estate double in just a matter of months. At that time, I knew something bad was going to happen. Me, a layman could figure that out. Granted, I am no expert economist, but I knew “something that goes up, must come down.” Not too hard to figure out, right? Where the hell was the government with the resources to retain the best economists to tell them something bad is on the horizon? They were there. They told the politicians about the impending doom. The government ignored them. My income over the past umpteen years has been a result of the real estate market. It appreciated at a comfortable level and I was able to enjoy a comfortable lifestyle. Fast forward to 2009. Broke. Completely broke. Who do I blame? Myself. For believing in the American dream and land of freedom and opportunity. This is political. Whether we want to think so or not. It is. The change has to be at the Senate/Legislature level or nothing can be done. We can all sit here and whine about how we are not receiving our mods when we are entitled to them, but it doesn’t do a damn bit of good. Read the stories here. How many people are successful? You need to shit or get off the pot. I am sick and tired of the oxymoron “career politician”. If the Americans are not willing to change the way this country is run, by electing officials for ONE TERM, AND ONE TERM ONLY, then I will find a way to own my house outright and be responsible only for taxes, insurance and utilities and escape this crap until I can save enough money to leave this country altogether. You are either in this or you’re not. If you are not willing to sacrifice your minor inconveniences in life, so be it. Tell your grandchildren you did everything you can when you know you could have done more by, I don’t know, maybe closing your accounts at the big banksters (although it is an inconvenience because your kids have an ATM attached to that account or whatever your reasons are), when you know down deep down that you could have made a difference. Political? Sign a petition? The choice is yours. |

If we stand alone, we do not have a chance. I would not want to think everyone must sign the petition but if you are tired of the way things are being handled right now, I cannot fathom why you would not want to sign a petition demanding the government change the status quo.
