I wish I knew whats out there for me so I can weigh my options. I was already approved once for a crappy modification. If this is the only offer available to me I will have to accept it. I want to stay where I'm at. This is my first home and I am proud of being able to accomplish this dream. If the payments aren't going to change, o well...at least I get to keep my home. I just need to get caught up and start fresh. I can live check by check for the next 15+ years. Maybe in between those years I will hit the lottery and pay this house off! ( If I decide to buy lottery ) Who knows.... God will take care of me. Let him lead the way... |

He made me feel like crap and I cannot believe they have a jerk like him working there! This was an appointment to make corrections on my budget and didn't even get to do that. I was trying to understand how they figure out my income. I asked him to explain to me how their system works cause he was saying the income they have documented is what I sent in. It's still showing that I am and will be negative if they do not make the corrections. He said they take the current pay stub and times it by how many times you get paid monthly and then divide it by 12. If this is the case, people that had no income at the beginning of the year will show that they will not meet their monthly obligations because the income will average out. I also have a 401k loan I took out a few years ago and it's $135/ pay period. Gotta go for now. Will continue |

I still didn't understand why they couldn't change my income to reflect what I am bringing home now. So he tells me he has other members that are waiting in line and he can't continue to beat up a dead horse. I was really furious at this time. I said why would you want to move on to another member if I do not understand what is going on? Am not important? Is it quantity you want to meet or quality? I asked for his name: Sheldon Jones and asked for his team leaders name. He gave the phone to the Keith, one of the supervisor. He was really nice and made the situation a little better. I explained what happened and told him about the denial letter. I told the counselor this too. Keith said this was out of their league and I would need to speak to the negotiator. He said he is emailing the negotiator and they should be contacting me. That jerk could've said that when I told him I received a denial letter. Keith said he will handle it from here and advised me if I had the time I should go to the SAVE THE DREAM EVENT in Atlanta. I could get a solution there. I asked him to guarantee me, I will leave now. He couldn't. I also told him about a site (didn't say the name) about how their experience was at the event. He told me I need to stop going on the internet and experience it for myself. I told him, if it weren't for that site I wouldn't be talking to you right now. I believe the stories they tell, they have educated/help me during this process and speak very highly of NACA. He did say not to worry about the letter cause that doesn't mean anything to him. It just means that they will fight harder to get me a solution. Should I believe him? |

Haven't heard of anything like this out of them. I have heard this and a lot more from the regular CSR's. If you have Keith's phone number I would keep bugging him until you hear something from neg. Oh....I see ...I think you are talking to NACA. If this is NACA try calling Kevin Winn at 617-250-6222, ext 254. He is a supervisor also. If you don't get what you need from them then call David L. at BofA at 866-806-2434, ext 8676. One of those should help you adjust your income. I will be thinking of you and good luck.... |

I was so furious I couldn't remember what was important. I get this way sometimes. I have already adjusted my income with Bank of America advocacy. My income now shows that I can support my debts but I am behind. I don't know if I will get the solution that NACA is proposing with the budget information I supplied. Keith said I can contact the negotiators myself but they probably won't respond promptly because they are at the Save the Dream Event. He didn't give me their numbers, just email addresses. I'm not sure what to say in my email ....advice anyone? |

Since you updated your income with David are you now set for the negotiator to re-examine your file for the NACA solution? I'd follow rkel's advise too about contacting the NACA supervisor. That is just nasty and that person seems to be speaking out of turn. Maybe if you can email the negotiator you can just explain how things have been mixed up and what you are hoping for. Are these the NACA negotiators or the BofA negotiatores? |

Last I wrote, I thought I had three different mod requests in the works for my Fannie Mae loan - one through the Hope Dept at CW/BOA, one through Barbara Desoer's office, and one through NACA. On July 13, I received a terrible offer from Hope, basically keeping our current terrible interest rate of 10.375% (a stupid refi), extending the terms from 28 to 40 years, and increasing the monthly payment by $150.00. Now, I am not a math whiz, but this seemed to add $500k to the life of my loan, for nothing. I spoke to a Hope counselor on July 18, and she said I would be crazy to take this. She noted my account that we were requesting it be reviewed again, and sent it back to the negotiator. Then, on Aug. 3, I received a letter from OOP - my senior negotiator - Jennifer Hall, who has been MIA for 2 months, has "researched" my account and sees that I have a "good" offer from MHA (it was not MHA, it was Hope). She feels we should take it, and has closed my file in the OOP! She evidently did not see the HOPE notes that I had requested it be reconsidered. So, I e-mailed the OOP again, and Sergio called me today. His call raised a number of concerns for me: 1) He could not see any mention of a NACA proposal on my account, even though my NACA status has said Submitted to Investor since July 9. 2) He said that the HOPE mod was not resubmitted for review, but listed as refused, and I now had to start the mod process all over again with him. 3) He said - CW/BOA has NO POWER in determining modifications, Fannie Mae (or rather the investor) makes all decisions. CW/BOA is only the servicer. This makes no sense, if that is the case, why aren't we applying directly to Fannie Mae? 4) Fannie Mae is not following the MHA 31% guidelines. 5) I could make a payment to BOA through him. This after I explained that I had tried several times to make a payment and been refused each time. He claimed that no where on my account is it marked not to receive my payment. He also claimed we are not yet in foreclosure status, yet I am receiving letters from scamming attornies every day telling me foreclosure has been filed at our local court. I am so confused. Now, the only active mod request I think I have going is with NACA (even though he said there is no mention of it). I have called NACA many, many times for updates (and e-mailed) but never get a response back. I have to start the mod request with BOA all over again in the morning. I plan to make Aug. payment to him tomorrow, and Sept. at the end of the month, so I can show Fannie Mae I do intend to pay. Has anyone here dealt with Sergio in OOP, is he trustworthy? Can he accept a payment even though no one else could? Is it true that BOA really has no power to suggest lowered interest rates in mods and that Fannie Mae does not have to follow MHA guidelines? We can now afford to pay our mortgage, but it will be tough. I would really like a market interest rate, fixed for the remaining 28 years of our loan. I do not want to extend to 40. Any ideas? |

He called back and left a message. I was in a meeting and missed his call. He said he looked at my file and researched the denial letter I faxed in. He doesn't have any records from Bank of America about their offer being declined. They should've been contacted before I was. He said the letter didn't look like it came from their department. ( I guess he means the NACA team at Bank of America. ) He shot out some emails and said to give it about two days. I am really confused right now. I'm nervous about waiting for an answer with NACA. I feel if I continue to wait I'm at high risk of going into foreclosure. I really don't want that to deal with on top of everything else. If I didn't have an FHA loan I would hang in there. Their budget has me negative and that makes me believe I have no chance. I have updated my financials on my own. But Kevin wants it to be according to NACA guidelines. Too late for that unless you submit the corrections. I get a call from a rep from the office of the chairman and she wants me to fax the statement she asked for last week. ( That I have canceled NACA. ) I really want to hear from Kevin before I move on. But how long will she allow me to ignore her? Here's a question I hope someone will have an answer to...If I chose to work with the bank and drop NACA, will I be able to use NACA again if the bank offers a bad mod and I decline? |

Some Mod is better than no Mod. Who knows, They may give you a decent Mod not being with NACA. If you have a FHA loan, then they are waiting til after 8-15 to do it. Anyways, good luck and keep us posted...... |

He told me NACA submitted my mod request on July 10 to CW/BOA (which I thought) and then again on July 28. He did not know why they had to resubmit, but said it was CW/BOA's request. he told me to check back in a couple of weeks. I told him that the OOP rep - Sergio, said I did not have a NACA submission, only the HOPE one that I turned down. He suggested I call the Advocacy dept. to check. I called Advocacy at CW/BOA and spoke to a wonderful woman - Peggy. She could see that NACA had submitted (yay!) and that it would be sent to the investor soon. SHe also told me my HOPE mod was so terrible because they had my financials all messed up (I showed a $2000 surplus)! So she updated my financials for me and told me to fax in new pay stubs, etc. to both her and NACA. She agreed that our interest rate (and that of the HOPE proposal - 10.375%) was ridiculous, and she felt good about the information now submitted on my behalf. Finally, she told me that Sergio was wrong, I was locked out from making a payment, but since my NACA submission (July 10), we were in workout, not foreclosure anymore. She recommended I try to make at least this month's payment, plus a bit extra if we can, to show Fannie Mae we are serious about paying. She told me to call Sergio and have him process the payment, since she doubted any other call center person could take it. I assured her we will pay Aug. 27, when I get paid. Later, Kevin Winn also called from NACA to follow up. I finally feel like things are improving. For a while I was so afraid all three attempts had failed. Thanks for the suggestions to call Kevin Winn and the Advocacy Dept. |

I currently have a Freddie Mac loan being serviced with BofA. I last paid in 10/08 & have heard nothing from then until late 6/09 when they started to call. Once I mentioned I was working with NACA (since 3/09) they have only called occasionally for an update on my status with NACA since nothing has been submitted as of yet. I am not in foreclosure as of yet & hope to also keep my home with an affordable payment. I am so thankful for this site & all the contributing parties of information & encouragement. I will keep us all in prayer for God's Favor to keep us in our homes. |

She would call me. I tried call her today because I had not heard from her. customer service rep told me my case is closed I don't qualify for mod or MHA. MHA is only for people with ARM loans. My only options are a short sale in deed in leui of foreclosure. Has anyone else been told this. I made an appointment with NACA counselor for tommorrow |

I told him that I had been told to fax them to Peggy in Advocacy and NACA, after Peggy confirmed receipt of a NACA request and updated my financials over the phone. He put me on hold for some time, then came back and confirmed that yes, Advocacy did have a mod request from NACA for me. He did not know why he could not see it on his screen. He also confirmed that Jennifer Hall, my original OOP contact had somehow entered my financials in incorrectly, showing a surplus of $2000/month (as Peggy had said). He said unfortunately, he could not work with me on the mod, since I am with NACA. He urged me to find out who my NACA negotiator is (I don't know how to find this out) and to get a contact number for him/her. Also to find out who in Advocacy is assigned to my account (perhaps Peggy, he wasn't sure) and to check in with that person. He said this has dragged on too long, I need to be more aggressive. He also promised to take a payment on Aug 27 for me (my first in 7 months!). So, tomorrow I have some phone calls to make. Anyone know how to find out who your NACA negotiator is? I have a NACA phone appt. scheduled for Thursday, just in case I need it. Hopefully things won't stall out again. |

He is amazing! So nice, helpful, what a great guy. First I called the new NACA number, and got right through, no wait. I spoke to Bruce, a very nice guy who assured me that NACA had sent my mod request three times, 7/10, 7/28 (requested by BOA) and 8/16 (requested by me). He also told me my NACA negotiator will be Janice Rucker (sp.) and that I should hear something in 2 weeks or less, as they are moving much more quickly suddenly. He also said that I should update my financials, which I will do in the morning. Then, I called David L. to get my CW/BOA negotiator's name (Sergio in OOP had told me to do this). He too answered right away. I called at 4:10 pm Eastern Time (right after lunch for him?) He told me only one NACA request was showing, the other two got canceled out by the 8/16 one. He also saw that Peggy from Advocacy had updated my BOA financials, and that I had turned down the terrible HOPE dept. proposal. He said it appeared that Sergio in OOP had requested the HOPE proposal be reviewed for an MHA mod, but since I was with NACA, that would be canceled. He felt NACA was the best way for me to go given the previous errors with OOP and HOPE. He immediately requested a NACA negotiator be assigned to my account and closed all other open requests. He assured me this was the best way to go for me (even though I have a Fannie Mae loan). I asked him about making my Aug. payment through OOP, and he agreed that was the only way for me to make a payment, but that it would not post to the account, it would go into a holding account until the workout was done (so it wouldn't mess up the numbers). He also said making a payment would be a positive, it would show we do intend to pay. I felt so relieved that he took the time to help me, even though I was not one of his clients. He too said I should hear quickly, 2 weeks at the most, since the financials had been fixed and we obviously met the MHA requirements. He warned me that my online BOA account might show a mod request canceled first (that is the HOPE proposal) and then say "closed", but within a day or two, it will change back to active processing, under review, and that will be the NACA request. I just don't understand why only one person in all of CW/BOA seems to know what is happening. I had two different negotiators in OOP, and neither one could explain the process to me or confirm the NACA proposal was there. When all of this is done, I want to write a letter thanking him to Ms. Desoer. He really goes above and beyond to help people. |

I freaked out this afternoon when my husband called to say we received a Fedex package from BofA. I thought it would be the NOD. It turns out it was a letter stating BofA wants to help as we maybe eligible to HAMP. I quickly called Kevin @ NACA & was surprised that he actually returned my call at 8:30pm Eastern time. I explained to him what happened & he scheduled me for a NACA phone appt. for 08/27 for what hopefully is my final. They should have all my docs by then & hopefully my modification will follow shortly. Had it not been for this website I would not of had come across Kevin's number. I will keep you posted. |
