Nominated 0 Times in 0 Posts TOTW/F/M Award(s): 0 | Loan Servicer lost out mortgage papers Aurora loan lost our loan papers as stated in the summons for our foreclosure lawsuit. They do not have any signed copies of the promissory note and state that they cannot possible obtain any copies of the note except that they believe the defendants (us) have a copy. What difference can this make in the process. We are filing our answer to the court this week stating to the court that we are trying to work out a loan modification and that we believe that there are irregularities in the loan papers. (What irregularities I do not know at this time but we will have our paper work checked. Although I don't know what ALS can say, since they do not have most of the paper work. |

The questions of what this will do for you or what exactly it would mean for the court case would need to be addresses by an attorney that is familiar with the laws of your state.
