Nominated 0 Times in 0 Posts TOTW/F/M Award(s): 0 | Previous BK & tax credit ?? I filed bankruptcy in '05, all debts including 1st & 2nd mortgages were discharged. I continued to make monthly payments to stay in the home, bank never talked to me, like I didn't exsist, i got regular payment statments from servicing company that mortgage lender transferred the note to for "servicing", never missed payment and got 1099-int at tax time, the home was a 30 yr old mobile home not on a permanant foundation, not able to be refinanced due to not considered "real property", balance owed was more than property worth, credit report shows $0 balance and closed due to BK, 2nd shows same although it shows open, no clue why that is, we have oppurtunity if I buy a new home, are BK attorney actually said we had option to walk if we wanted to, said since discharge we are under no obligation to clear the default, what I am wondering and I guess I could ask the attorney to look into, but I thought perhaps someone here could answer, we are wondering if we buy a new home and just walk from the discharged mortgage, can I qualify for the first time home buyer credit next year? Just wondered since technically we haven't owned the home since the discharge. Thanks in advance, |
