Emergency Chapter 7

Our house is set to go to auction this Monday March 9. We hired an attorney back in Nov who promised that we could at least expect to buy time. He did not deliver and gave us the news this monday that countrywide denied our request for modification. We are now set with the question of to file bankruptcy or not. We do not qualify for chapter 13 because we have secured debts over the limit...we have two other properties in foreclosure. In approx 30 days time we will be able to file for chapter 13, but of course our house will have already been to auction. We are wondering if we do an Emergency chapter 7 this will buy us time to work with countrywide and then do a chapter 13 to get rid of the second. Any help is greatly appreciated!

Re: Emergency Chapter 7

I am so sorry that this is happening to you................but unfortunately.......to see if that is a possibility, that would be a question that you would have to ask a bk attorney.
