question about filing chpt 13 & erasing 2nd mort

hi. i was wondering if anybody in here has a story similar to mine and had a successfull outcome.

i live in lathrop, ca. my house is to be auctioned off on 12/22/08. my first and second mortgages are with EMC, and they are original purchase loans ($453 first & $112 second). i was behind 8 months in payments and emc was really hard to deal with, they denied our modification application and just want us to pay them the past-due amount. the value of my house now is around $320k.

i'm having several sleepless nights and did not know what to do, except that i want to save our house. i googled law firms that deal with foreclosure & BK. i talked to one on the net yesterday, and their fees is $2900 + $500 for loan modification. their number is a 1-800 # but when I called, it went thru a dispatch and got my name & number so my call can be returned. a gentleman returned my call, he is a consultant and work with the lawyers. he told me about chapter 13 and if i filed, my 2nd will be erased since the value of my house is less than the 1st mortgage.

i have not signed up with this law firm yet, i want to make sure that this is not a scammer. does anyone of you know of any legit law firms here in CA that I can help me.
