Nominated 0 Times in 0 Posts TOTW/F/M Award(s): 0 | Loan Modification after Ch 7 discharge? Hi... We filed Ch 7 last year...it was discharged on 5-15-09. We had a first mortgage with WAMU for $239K and a second with B of A for $49K. Our home appraised for about $139K. Our attorney told us to stop paying on the 2nd when we filed for BK, so we did. We didn't sign reaffirmation agreements on either loan. We're still in our home, and have never missed a payment on the first mortagage, throughout the whole BK process. They've been happily collecting our money and sending us 'receipts', but not actual monthly statements. We're now having trouble making the payment on the first mortgage and are one month behind. Is a loan modification possible at this point? We're afraid that signing the documentation to apply for the modification could cause problems with our discharge...it's worded such that it seems like we could be agreeing to 'reaffirm' the loan just by signing the loan mod application. If a loan mod isn't possible or workable for us, does anyone know whether the foreclosure process would happen more quickly since the debt has already been discharged? We'd definitely appreciate any info... Thanks! |
