I'm filing for Chapter 13 and including my first mortgage.

I stopped paying my mortgage back in April.

Should they have foreclosed on my by now? Can they not find my "Note"?

My original 1st I required back in 03. I refied in 05 with a new company and then they sold it to another.

I think they lost the "NOTE" in the mix lol

Not likely they lost the note ...... although that would be nice
Were you asking for a loan mod since April? That would halt F/C proceedings.
Also; they are so backlogged, and F/C is very expensive for the bank to undertake.
In our area, to not have a glut of properties on the market, banks are holding F/C properties in inventory - also very expensive for them.
If you are still living in the house, they would rather keep the house occupied.
Their priority is to first address abandoned houses, as those can get to a state of disrepair very soon.
