    Wells Fargo Home Loan Specialist calls me from his home after hours to ask for docs

    I applied for a HAMP in Feb. after having my income reduced by 2/3. At the end of March,with my file complete, my "Home Preservation Specialist" kicked it out of the system instead of sending it to underwriting. Two other random "specialists" I spoke with said it looked like a mistake, since there was no notation as to why it happened. Two weeks later, my guy says I was on a payment plan and didn't pay. And that's why it was closed.This is not true, but it is now the notation he has added to my file. He refuses to remove it, and will not send me what he claims is my signed payment plan. At first he claimed someone else put the notation in, then he said he did it.
    Fast forward to the present. After faxing him my complete file 3 times and sending 3 hard copies certified, my application is still with him. Tonight he called me from his home, after hours. He told me he was calling from his home, and the number showed as "private" on my phone. He said, "I'm not supposed to be doing this, but I wanted to go the extra mile for you. I hope you aren't recording this, because I could get fired and then I would need a Home Affordable, yuck, yuck." He also said, "Since I'm calling from home,I don't need to go through the verification process." So he goes on to ask me to fax him pieces of the file AGAIN, claiming he never got them. He said many times he wanted to get this done for me. He also stated, "I do need other documents from you, but I can't remember which ones right now, so just fax me the ones I ask for and I will call you tomorrow from work and let you know what others I need." This is very strange, because Friday he said his manager was working on my file.

    This creeps me out. I do not know this guy. For one thing, why call me from home? What is he doing with my info. at home? What is happening that he doesn't want this call routed through the Wells Fargo "This phone call may be recorded or monitored for customer satisfaction..." And why did he discuss my loan without verifying who he was talking to?
    Yesterday I faxed him a summary of the past few months and cc'd it to the Attorney General's office. Maybe that has something to do with his behavior.

    That is inappropriate of that rep to contact you from their home after hours and not directly from the WF office during hours. If it were me, I would contact the executive team and let them know this has happened and also ask where in the process your file is at.

    Here's what happened so far....I called and immediately was able to speak with a rep. She was very concerned when I got to the part about the specialist who called me from home. The Executive Team member, Deanna, said, "We don't do that. That really concerns me." She asked me to repeat the conversation I had with the guy and asked me what he said the reason for his after hours call from home had been. I explained he said he needed docs, but I knew my file was complete. Deanna pulled it up on her end and told me it was in fact ready to go to underwriting on March 30. The complete file was there in front of her and she didn't know why the guy kept asking for more copies of docs that were already in the system.

    She said she was taking notes and would include them in an email to my specialist (I really don't claim him as mine, but he has my file), his supervisor, and his supervisor's supervisor. She also said she was demanding my file be removed from that guy, reassigned and escalated.

    I asked her how I would know if any of this had happened and she said if someone didn't call me Monday with information, I was to call the Executive Team back and tell them I want them to take my case.

    I did tell her I filed a complaint with the AG and was going to notify everyone I could think of in an attempt to get this modification.

    I am so glad that the executive team was able to listen and prompt a look at your file, hopefully this will prompt them to escalate your file and get it approved. Please keep us posted on how it works out for you.

    ,I have been trying to get a hamper mod since Nov 2011 with Wells I have sent multiple docs crazy requested docs they sent me a letter in March stating I would have a decission by 14th well fast forward to last Thursday when I phoned for the third time in same weeks to be told they needed my non borrower to sign a new contribution letter because he has a lein on his corporations building? ???What the dkfjffjthf dxoes that mean so upset I emailed all the executive team with my complaint! I received a call on Friday stating that my case is now with a new person Adam and he will take it from there. I called Adam on Tuesday to see if he had everything and he said he did. About an hour later he called me back and said he needed all new docs. So yesterday I faxed all new docs but this time he sent me a list. My non borrower spouse only contributes monthly and has never paid any of the expenses just supplies money each month. I sent them bullet point explinations on everything has anyone else had this happen?how long does it fake once all docs are with the executive team for escalations?

    Be careful with WF. Just because your application is with the executive team, doesn't mean anything good will happen. From what I understand they have a time limit to process your file. But from my experience, you have to watch them carefully to make sure you don't get screwed. I tried for over 2 years for a HAMP, and escalated it to one of the offices of the president. All docs in, all OK, trial payments made, and they were supposed to send me a HAMP. They sent me an in house that INCREASED my payments from 1900 to 2365.Same interest, increased to 40 years. 2 years worth of late fees, deficiency fees, loan mod fees added to the back of the loan. No one would return my calls in that office and I had 10 days to sign, or I would lose my house. I signed and sent back the docs. Funny, the very next week, the office of the president started taking my calls again. When I asked where my HAMP was, they said, "Oh, you qualified, but you already signed the in house papers and we can't help you." So, here I am 1 year later. Couldn't pay the original payment, WF raised them, couldn't pay that. Don't give them time - call to make sure something is happening so you can deal with immediately. I actually got copies of my WF file by subpoena (for a different issue) and they included internal emails which verified the HAMP was supposed to have been sent to me. But, can't afford an attorney, don't have time to wait - I just want to get this over - for the millionth time.

    I also have a non-borrower on my application who supplies money each month. I had to fax in his tax returns for the past 2 years, all of his bank statements, a letter stating he does not own a business. They swear he owns a business, and he doesn't - they can see it on his tax returns. He has had to give them as much info. as I have - and he's not even on the loan.

    How long is it taking to get some kind of an HAMP approval or denial from Wells now ? Just faxed in a "package" April 12th…Of course they are missing 3 items that were faxed in..Must have missing paperwork in by May 19th…What if I only fax in 2 items instead of all 3? I am trying to delay the process as long as possible by playing the "Hampster Wheel"..

    Update: yesterday I faxed the 95 pages of my file to the executive team guy. They don't give you much time. He said they need all docs by the 10th. And they have until the 18th to do their thing. So now I wait, I guess.

    Two days ago I found out I was denied. No reason in the system. My Executive Team guy will not return my calls. I was routed to collections who told me no reason was given and that I had to contact the guy who had my file. And if he was not available to leave a message. Which I have been doing. I don't have a lot of time, the sale date is June 14th. No one offered any kind of forbearance or payment plan. I wasn't even aware I was denied until I logged into my status on line and found it wasn't available. I'm stuck and trying to figure out what to do now. The first guy used up all of my time.

    Their fax machine is hooked directly into a mega dumpster. This is why you were denied. They look at nothing you fax.

    Christyhaz,

    I hope you make that call today to WF & please let us know what happens ok….I am so sorry they denied you…My sale date is JUNE 6th & understand your stress !!

    Where do you go online for your status ? I'm sure you will get a hold of someone at WF that will give you an answer…Can you ask for a manager of the executive team people ?? I hung up during my 1st "interviews" with 2 different specialists…The 3rd guy sounded so much more friendly…knowledgeable and eager to give me some tips on getting an approval…He then called me back within a week to tell me he had my sale date delayed until JULY 23th…….47 DAYS………….I WAS SOOOOOOO RELIEVED !!!!!!!!!
    (It still doesn't show up "postponed on" Foreclosure Radar….so I can't celebrate just yet…ha ha ha !!
    By the way…both my loan mods are in review with WF….One a primary residence & other one a rental…Don't even think they know about each other….what a ridiculous way to run a business !!

    I have posted this same question on the Hampster Wheel thread…Does anyone here have any experiences with WF mods ??

    I am currently "under review" for my primary & rental properties, both with Wells Fargo…Was waiting for the new Hamp Tier 2 program for rental properties that was supposed to start in May…Looks like the 'In House' mod called "MAP" will apply to my rental property at this time …Hoping can switch to the Tier 2 program now rolling out in June…(maybe??)
    Faxing in "half baked paperwork" as advised by my friends on the "Hampster Wheel"

    Question:
    When they mail you the "Immediate Attention" letter saying to fax in missing documents by a certain date or mod request will be considered WITHDRAWN…
    (1)Is it better to fax in all 3 documents with pages missing…mistakes..no signature…wrong dates etc…??
    (2) Or fax 2 of the 3 documents requested?

    I have been playing this game so long and want to keep playing for a lot more time…thanks for all the info on new bills pending on our issues...Many people are saying bank's may slow down recording NOD's and NOS's until after the election…Who knows…its a game of musical chairs..changes each day...

    Any encouragement or advise would be greatly appreciated..

    FYI, ForeclosureRadar is notoriously slow in updating its trustee sale calendar. I might suggest you visit the trustee's site or call them.

    Actually you can challenge this yourself as this is a suit under equitable estoppel as with the internal emails that show HAMP eligebility and you got their rip of in house mod. They can be sued for so much money and you may even be able to get your house too. Knowing most can't file suit because of no money for an attorney, if you are in a nonjudicial state you can challenge any foreclosing trustee by writing them a letter and attaching these emails show negligence and tell the trustee they will be negligent in foreclosing and are barred under equitable estoppel from forclosing on you. First though I would write the bank and tell them you want the HAMP mod you were elegible for and was inappropriately denied. This is soooooo wrong and they should not get away with this. This is an EVIL bank with the OPP as their fraudulent beautiful side. Actually this is an unconscionable act under equitable estoppel.

    I thought I'd update here, since I've been spending time on the NACA thread. I joined NACA as a last resort, with not much time left before the auction of my house. I had also joined NEDCO, and thought they were the same, but they aren't. In about 3 weeks I had an offer from Wells Fargo for HAMP. I have my first trial payment July 1. The auction has been postponed to Aug. 13. I thought they had to suspend it if you were on trial payments, but I will need to look into that. NACA has been a lifesaver for me!

    My Wells Fargo guy was Fred.
