    Do you need a subpoena to get copies of your "communications with servicer" if you requested it in a QWR citing inconsistencies in communication and inaccurate information?

    Sent a QWR to GMAC. Got a response givng me some info(stuff I already had) and leaving large gaps in materials provided for quite frankly the important stuff. I asked for documentation of communications regarding my loan both to me and internally between departments (someone's always passing buck) and was told I need a subpoena. Is this true?

    Are you trying to obtain information regarding your original loan documents, or information regarding the loan mod process?

    Both in fact. I am currently in foreclosure with an auction date set. This despite the fact that I was awarded and closed an EHLP loan from HUD. Upon receipt of the response to my QWR I found discrepencies in dates, signatures, and companies purported to have my note...MERS was listed on the Deed but transferred it to GMAC mortgage a few days before GMAC filed with the public trustee. My request asked for the documentation because I feel there is a very strong possibility that paperwork is being generated now and backdated to fit the situation..
