Quick recap: modified our loan in January of this year and began paying according to new terms in March. Paid according to terms on time every month never late. Story: In early May we began receiving calls that we were behind on mortgage payments. I kept explaining about new terms, etc. They'd tell me to ignore the calls they'll fix it, blah blah, etc. This went on for about seven weeks, receiving calls 2-3 times/ week. Like I need the stress. I kept calling various departments to get it fixed, being told multiple reasons for the mixup, but it wasn't getting fixed in the quoted time frames. It took a complaint to the BBB to get any real action. It was finally determined that it was BOA's error. I had made a double payment on accident in April and they credited one back to me, but failed to make the necessary adjustments on there end to indicated we made the monthly payment. Their records just said we didn't pay. They reported us as being 2 months late on our mortgage payments. Anyway, on June 30, I get a call from BOA lady apologizing, telling me she's sending out a personal letter apologizing. We get the letter a month later - dated June 30th. In the mean time, two of my credit cards were canceled claiming late payment history - not with them, on my reports. And one of my husbands cards just got the credit limit lowered because of the same reasons. Though we make all those payments on time. What the hell do we do? It's certainly not fair that we suffer because of BOA's error. I figure I need to call the other creditors but suspect they won't give a flying fudge about what we have to say. Any suggestions at all?? Thanks c. |

In some cases I have seen the lenders right letters to the credit bureaus and have gotten the late charges removed from their reports. This will be difficult to do and won't be guaranteed but it is worth a shot. Just call call and call again until you get someone on the phone who is actually willing to help.Ask to speak with supervisors/managers as much as possible because most of the time they seem to be a bit more professional..

BOA has sent a correction to the reporting agencies, but it took so long, that our other creditors took action. Its most frustrating because from the moment we received the first phone call we told them there was an error. I have my bank records to prove we made the payments. Despite that, they still reported it late. 60 days late! I intend on writing letters and sending a copy of BOA's letter, where they apologize for their mistake, along with it and hopefully we can make some corrections. |
