My mother and brother excepted power of attorney. My GF is 100% percent mentally. But paralized on his left side. In order to pay his room and board at the home, they ...my mother and GF started sell his properties. Well with this last property....I don't think my mother was all there... They agreed to sell for 100K,with the understanding that if the buyer could not make payment in full by a certain date he would give my GF/mother another property. He did not disclose that two other parties already had a lien on this other property. The other property was foreclosed upon... My Mother died in Nov.('08) Trying to sort all this out my brother retained an attorney. we discovered Mr.Klahr has sold My GF's property. He never paid one cent for!!!!!!!!!!!! Trading it for another property that seemed to have been in foreclosure. What is this fraud called? Sorry my thoughts are scattered and I'm late for a dinner so no time to put together a decent post. Just wanted to get this out there. I hope we figure out what to do. Thanks. |

Maybe try posting on the attorney site just above this thread. Did you put a call into the attorney general from your state or legal aid, what did the attorney hired have to say, did anybody do title searches b4 sales, was there title insurance?.... Just thoughts. Good luck keep us informed. |

The atttorney my brother hired kinda goofed..I think. He mailed a dated notice(June 5) to Klahr giving him 10 days to pay up with an option to return the property...the attorney stated at that time the title had not changed hands...I guess Klahr did not respond. My brother spoke with the attorney yesterday at which time his attoney stated Klahr had sold the property (quit claim deed) to another party on/about May 20th. I'll say here I'm kinda on the outside looking in,my brother and the attorney live in the Sacramento area. He's up for a visit now,so we can figure this out. I've seen the document/contract my mother signed and it seems legit. As I recall Klahr agreed to pay her $1500 for six months with the balance due in Febuary,if he could not or did not pay in full by Feb.he gave her this other property with an equal value. He made no payments, not one cent! Before my mother passed we spoke: Khahr agreed to pay the 1500 for six months until his financing come thru. The other property would be used if it fell thru. Of course she was not completely in her right mind (alcohol and the stress trying to figure out how to pay for grandpas care) and she had not run the details by my brother or I before she signed. I assume no title search. As I stated in my previous post we discovered the other property already had 2 liens on it,and was foreclosed upon while we tried to sort things out. My bother and I drove by my grandfathers old place yesterday...the property is occupied and has had repairs/inprovements done We just drove on...... How can a person do this? How can this be done....in America? This man is nothing but a horse th_ef!!!! Remember what they used to do to them? My grand father is crushed. He worked so hard all of his life....now he has nothing..... living on Medicare/caid. Thank you. | |

Probably a real estate salesman/vulture. He knew exactly how to play this. Another family devastated. So sorry for you. Yes, I heard about what used to happen to horse thieves. |

I am very sorry for what you and your family has gone through and I am sorry that your mother passed away last year. Please extend my sincere sympathy and condolences. There’s a lot of mortgage fraud scrams, and people that you think can help you is the one who will steal your money without you even knowing it. It is very important that before you hire a lawyer that you searched them in your State Bar Association to see if he is licensed to practice law and has many complaints. As it is I’ve searched Keith B. Klahr on Idaho Bar Association website to verify if this lawyer is licensed to practice law, but this lawyer’s name does not exists in your area. Here’s the link for it. Attorney Roster Search When you hire a lawyer make sure that he is licensed, he is a Real Estate lawyer and knows the laws of Loan Modifications, Short Sale, Bankruptcy Laws .You need to ask him up front how much he is going to charge and what he can do for you. Klahr Mortgage scam prevention Do's and don'ts: Don't fall for promises like "We'll save your credit"; "We'll buy your house 'as is'"; or "We'll get you a new mortgage with low monthly payments Don't sign away ownership of your property (sometimes called a "quit claim deed") to anyone without the advice of lawyer you trust. Check your lawyer's license with the State BAR Association to see if he is license to practice law. "When people get behind on their loan payments, they get a bit desperate, but the answer is not putting someone else on your title Beware of any home sale contract where you aren't formally released from liability for your mortgage. Also, make sure you know what rights you're giving up and that you agree to giving them up. Don't call for assistance from one of those ubiquitous signs on telephone poles that advertise help. Chances are, that's not where help lies. Do proceed with caution, if a company or person: Describes itself as a "mortgage consultant," "foreclosure service," or something similar; Collects a fee before giving any services; Advertises to people whose homes are listed for foreclosure, including anyone who sends fliers r solicits door-to-door; and says you should make home mortgage payments directly to them or to their company instead of your mortgage lender. Don't sign anything that has any blank spaces. Information could be added later that you didn’t agree to. - Yes, it happens. Never sign a contract under pressure. Always know exactly what you're signing. Take your time to review the paperwork thoroughly — ideally with a lawyer who only represents your interests. • Cast a jaundiced eye at deals that sound too good to be true. Lately, some scam artists promise they'll wipe out or pay off your home's debt for you (so-called "debt elimination"). Some flustered homeowners bite. Just remember the free lunch rule: There isn't one. A final thought: Remember, if you can't fix your finances, selling your house (on the normal market, that is) may not be the end of the world. Sure, you'll be a renter again. But given how much homes around the country have appreciated in the last several years, chances are you've made some money, which you can use to get back on your feet. Don't panic. Get full information on the foreclosure process in your state. Make sure you know ALL deadlines — for court, for document filings, etc. States usually have associations that can offer free advice.
