If I may second Karen's amen. Karen by any chance while watching the Globes did you take note of one dress that looked very much like my Grandmother's cut up bathrobe? LOL, it's fun to play fashion police. Professor Shays you provide such a valuable service in educating so many of us that felt lost, but now found. Thank you for letting me know I made you laugh. I have missed having moments in my days to laugh until you cry. Speaking of which. My husband's truck has of last week started having a small water leak. After work I took it to the dealership playing the dumb blond to ask the mechanics to take a quick look. I read the meter there seeing those guys once a month. The water pump needs to be replaced. Next time we buy a HD GMC Sierra diesel it may be a good plan to inquire the cost of repairs. You guys should have seen the look on my face when the repair cost was 900.00!!! A WATER PUMP?? I called around ewwwwwwwwww found a shop who will replace it for 620.00. Still? What happened to the days of duct tape, bailing wire and super glue? I had a POS 67 Camero I saved to buy in high school. All I needed was a big screw driver to pop the hood and fire it up. I know, focus on the positive. I have the funds to get the repair done. Plus there was no mention of a sagging rear end or low pressure in the front, but a 900.00........ water pump?? Laugh until I cry My question for this day is do we ignore that certified letter? Will that push the timeline off at all? Take care of each of YOU, Catherine

Nope. I don't think ignoring it will push timeline off. If you ignore it, it just eventually will go back to where it came from, and they will use it to show they attempted to send you the letter. I think it will still go forward. That certified is just to show proof that you got it. But I think some people had their foreclosures go through without ever receiving a certified letter.

And yes, I saw a few dresses like that, but I think actually most people behaved themselves this year. There was nobody dressed absolutely horrible.

Why does it post like that? Anyway I inquired what would happen if I filled a B/K. I know they won't answer that, but I put it out there. I am so fed up with the run around and being jerked around by these guys. I am half tempted to file one for another 45 days. Wait 45 days and have my husband join me. If I am correct unless I follow through it won't show up on my credit report???? The person today was rude. I wanted to say I will be calling back PMS week. The 80 degree weather sounds great. I love the warm weather. Why I still live here is a surprise with the weather.
Regarding the rejection of the certified letter, I accepted mine. The rejection possibly would add reservicing fees or something.
I never tried to dodge the letters from either HLS/FF/National City Bank or from one of my petty 1k personal loan notices. I believe it would be served again in a few days.
The package probably has the exhibits for your loan and what their claim is. The copy that I had included the loan for the 80% with the pre-payment and adjustable rate mortgage rider.

As an off note, there was some activity on a thread related to HLS serviced loans. They are amazing on how dirty they go. Apparently they find any weakness and keep biting at the same spot.
One person had equity in the home on the first loan. He ended up with the house auctioned and was stuck with the secondary loan.

Currently you would have the ability to pay back the missed payments over 5 years. The conditions of the loan would still be the same. If the laws that I mention do go into effect, you may be able to get a loan renegotiated to the current appraised value, at the current conventional rate with a reasonable risk premium.
I did discuss with HLS regarding the probability that I would be filing BK. I originally intended on filing Ch 7 and jettisoning all but my wife's car. I told HLS that I probably would do a 7 but may go for a 13.
They seemed to discuss calmly with me regarding the issues. They confirmed the same deficit in income for our bill load as the credit counselor (for pre-bk certificate) and what our schedules confirmed.

Now back on track, filing BK will stop all legal actions and can give you more time. The lender will then have to get a release from stay to foreclose. If you surrender your home in full satisfaction of the debt, they would still have the delay of the release from stay.
No release from stay was filed yet in my case, so I am not sure how long it would take. I believe it is about 20 days you have to answer the request from stay and then it may batter back and forth each way for awhile.
I don't know about houses but one repossessed vehicle from GMAC tried to and I told the lawyer not to. The lawyer was trying to convince me that GMAC was just trying to get permission to sell the car. I read the release from stay and it would have financially ruined me. I submitted my view to the judge and the release from stay was denied. Later another release from stay was submitted by GMAC that had in full satisfaction of the debt that the judge allowed and that I felt comfortable with.

You know, for nine hundred bucks, I'd be willing to drive out to Kalifornia and put that water pump in the truck for you!!! I could probably stay at the Ritz Carlton at that rate. Also, do you really think a 1967 Camero is a POS??? If you still had it you could auction it at Barrett-Jackson and pay off the house with it!!! OK Maybe not, but it would be worth more than my vehicle.

It is before 5am (I know twisted) my friends, Waking up to start my day having the gift of a smile, and laughter, support we give each other I have to say makes each day facing this sooo much easier to survive. The train wreck I was a few months ago is a far cry from where I am since finding this site. Cactus, if you leave your house before mine come on out you don't have to stay at the Ritz it's free here I learned how to fix that Camero by working on the engine A LOT, back then it was much easier. The trunk used to fill with water in the winter time with a wave coming when you applied the brakes. I know now a hole drilled would have fix that. Drop the pressure in tires and it was a blast to do 360's on the beach to Steve Miller's Jungle Love. Gawd, I am dating myself. The list of traffic tickets for driving that car was endless. You name it? I got it. Not that children my have ever been told. Here is a perfect reason to come out to Cali. You can add to the times I have slapped myself for selling it to replace it with a ..................................Pinto LOL! Why do I have to be so honest?

I read the posts you made reference to. Had these horrible treatement from HLS stories not been shared it would have taken me a lot longer to realize fighting for my house on their terms was a complete waste of time because their bottom line is NOT keeping us in our homes in fact quite the opposite is occuring. I agree they need to be stopped. Too bad a law wasn't in affect to shut them down for cruelty and lies that seem to result in foreclosure for the majority of us that have them for a lender.

One of the best gifts we can give each other for facing this is making each other laugh. I know for me I have shed more than enough tears. For myself, I have found that living in the moment is the best medicine. Acceptance is the road, perseverance the guide and support from our fellow human beings is the food for the journey. I agree that this forum is of great help and comfort.

Whatever the outcome, it is only a house. It is a thing. As much as I will miss my home, a home is where you are and as long as there is laughter, it will be a pleasant place to be. Keep on moving, moving targets are harder to hit. God Bless

Thank you, the tears that touch are the best!!! I had another thought to share. No one here will be the first to accuse me of being a "Chatty Cathy" I have never spent time on my space, but my children have. I wish we could post pictures to give a face to our names so if any lenders or loan servicers come here to read we are not a loan number we are people who lives no matter what walk of life we came from we are facing this together. The families with little ones I wish they could see who they are affecting. I know it a business decision, but take a good look at this little one or that elderly Grandparent or anyone here today to say how dare you think of us has a $ sign, it's personal!!! I read the posts you made reference to. The trouble that I have is the way they make the customer think they are a bunch of "Barney Fife" characters, they play that role so well.
I'm still trying to get them to correct the Escrow payments. I informed them of the error six months back and they never corrected the amount withdrawn monthly yet. Their on site escrow information is horrible. When you get them to correct the information it will be alright for a little bit and then they change the values to some not even close values. Being an escrow account it can only go to 1/6th of the value of the yearly taxes.
I was thinking they were incompetent without intention, now I believe that they are intentionally incompetent.

Regarding the posts on the other thread. The tactics used for the person who ended up stuck with a secondary loan and no property while HLS got the first loan value back from foreclosure and also insurance money from an insurer for high risk mortgages (Radian, is the company they use, I believe from my secondary loan) is beyond me why the company got by with it this far.
It might not be a ponzi scheme but is surely a scheme that in dishonest way, they make profits.

Good morning my peeps...

I have been reading the different forums all day long and I really just can't believe what a mess this whole thing is all across the board. There doesn't seem to be one single lender out there who has their crap together. Not one. And the "we can't help you because you're not late" I read about over and over and over is so riduculous. I'm relieved we aren't going to attempt a mod because it just seems to be a horrible process to go through. How many times do you have to give someone your financial information? Just take the friggin house, PLEASE.

I've said this before, but I STRONGLY doubt we will ever buy again. I know so much more than I did even a month ago, and the thought of ever letting another company have that much control over my life literally makes me sick to my stomach. I just pray we have the strength to make it through the next couple of years with income taxes and our second possibly coming after us. I know our problems could be so much worse than they are (and so much more expensive) and I'm grateful for that. I just really hope this new administration can provide a little more relief for people and help those of you who are attempting mods to make it a little bit easier for you all.

At this moment I am completely humbled. You know how everything happens for a reason, whether you see at the time or not? When I arrived to work the big boss was there. A few us were handed a fifty dollar pre-paid Visa gift card for doing good safe work. Last time I got one I bought a Christmas tree. This time I really didn't give it much thought. So there I am out in the country reading electric meters left to my thoughts. Pondering whether FF/HLS's investors took an insurance policy out on my loan if it defaults. That would make perfect sense to me has to why so many of us by this company have been pushed and shoved toward foreclosure. No amount of pushing back will keep me in my home. Wish I would have realized that several months ago instead of the false hope I put myself through. Then I was having a suck it up talk. Usually a three day weekend I would be jumping for joy. Looking towards this one I wondered if I would lock myself in my room, start packing, get a haircut, see the grandbaby, and what I would cook for Sunday dinner. Now that being said I had to read a billboard in a field today. Parked the wrong way was a POS car. The drivers door was open. I could see a man with his head leaning to one side. My first thought was oh gosh is he dead? While there was a debate going on in my head whether to approach this man or be scared there was soft voice there too telling me to make sure he was okay. The closer I got to the car it was apparent this was his home. He was sleeping. I offered him a cold drink. He gratefully accepted. I'm sure you all know when I went to my work truck to get a soda I knew in my heart where that fifty dollar gift card was going to go. I wanted to thank him for a much needed reality check for my life if you can understand that. Mind you I will be honest I see those guys with a cardboard signs and it doesn't really phase me since they are there pretty much everyday, but this other man for whatever reason was down on his luck. Thank you for the wise words of a quote we can read and apply. It also made me think of what I am letting go of too and what it is just a house really means to me. It has been a place I had the security of knowing my children had a safe place provided for them any hour of any day they could come here. When they were younger at times it was their friends or our friends. I know they young adults now. Mommy needs to let go. That is not what I am talking about or maybe it is. One plan is to purchase a fifth wheel so Bri can use it to travel for work while I either join him or stay here to rent a studio keeping my steady income. Whatever the future holds for the current time being it will be very long time before I can forgive FF/HLS for taking my inner security comfort Mom zone thing away from me. Looking at it from a financial business choice this is right and will happen. I have no control nor can I change it. How I choose to accept it is on me. IF I didn't learn anything I will be debt free ASAP. If I want a new car I will save for it..................after my current one is paid off No more signing my life over. I know it's just four walls, but there is such a deeper meaning to home. I don't fear losing this house for I know we will survive. Today I was doing some research online about taxes, etc., and came across something that when I read it I thought to myself, "Of course. Why not add one more problem..."

We have refinanced several times since we first bought this house in 2000. Well, in all the years of doing taxes (with Turbo Tax) I find out just today that all of the home interest I have been deducting I probably shouldn't have been. Because of the refinance there are limitations on the amount that can be deducted. Of course there is.

Well, now I don't know what to do. Well I do know what to do but I don't know if I should. I have put together some rough figures using the way the IRS says to calculate the deductible interest, and yes it is less than we have been deducting. What I SHOULD do is calculate it the way I think it needs to be calculated for our 2008 taxes and not claim the whole amount as we have been. But I'm really afraid that they are going to get our return and say, "Hmmmmm, well why this year are they not claiming all of the home interest that was reported by their lender? And have they been claiming too much in the past?" I'm afraid it's going to put up a red flag if the amount we deduct this time is less than our reported interested paid when it's always been the same before.

Since the statute of limitations on audits is 3 years, the IRS could go back to our 2005, 2006, and 2007 returns. And I don't think we are talking a whole ton of money, but enough to probably be a pain.

Their home will be wherever you are. As we get older our circumstances change and we have to adapt. Kids grow up, don't need quite the same environment that they had growing up, and we don't need the same environment either. I know what you mean about having a place for them. I have 2 girls, 12 and 5. My 12 year old doesn't want to leave. I tell her we are like the Jeffersons, "We're movin' on up..."

Don't focus on what you won't have. Focus on what you will have. That's what I try to do. I love not dreading paying my bills each week, because I have the money too. I love being able to buy my girls the things they need, and treats once in awhile. I love being able to treat myself, and I love that my husband can treat himself too.

Yeah, we will have a price to pay. Taxes, second coming after us, credit score all jacked up. But those things will be fixed in time. Staying in this house and continuing to pay this mortgage is just toxic. You know the feeling. Just let it go. Everything happens for a reason. I truly believe that. We will all get past this.

And yes, let's make margaritas!
