Help me Indymac Loan Modification

Hi Guys,

I am thankful to have found this site a week ago. I currently have a 5/1 IO ARMS. My reset date is Aug 2012. Although my payment is not schedule to reset until so far away. I have been having hardship with my income.

I operate an internet base wholesale business. Due to the economic conditions my sales has dropped nearly 35-40%. After finding this forum I've browse though several pages looking for others who have account with Indymac Bank. Base on all the information contain on the site I learned some basic steps.

I wrote a financial hardship letter and contacted Indymac Bank to provide it to them. I was turned away. I was told I am current on loan and they are only helping people would are in default. I explain clearly my situation and how my income has decrease due to the Recession and I have been struggle to make my payment eventhough I pay it on time. They still told me there is nothing they could do.

I sent my hardship letter to about 10 email address I found on this website. Someone contact the very next day stating they did not want me to lose my home and someone would be in contact me. I received a telephone call that day. I spoke to someone in Loss Mitigation and he emailed me a Financial Worksheet. He advised me that he would put me on a temporary 4 month forbearance to pay $1900 per month. My current mortgage is $2400 @ 8.5% interest only. I asked how would this effect my credit as though I have good credit. He stated he would put my account on a credit reporting hold. They would not report for the 4 months.

Has anyone else been put on a forbearance who were current on their loans. Did your lender report negative on your credit?

In any case I filled out the worksheet FAXED and emailed it back. However I have not heard anything else from him. I've contacted him 3 times by phone left voicemails and sent 4 emails. Still no response. I contacted others in loss mit. and 2 people also sent emails to contact me ASAP. But still no call.

What should I do?

I contacted the Loss Mitigation Department for Indymac and everyone keeps telling me he's in a higher department in loss mitigation and they can help me because they do not understand the program he put me on. As though I am a current on my loan and he has me on a 4 month forbearance.

Do anyone else understand or can give some insight of the next step for me?

Questions Regarding Indymac

I've been trying to get my loan modified since December. After no response and no help. I decided to do my research. I located several email address and contact numbers of higher ups. Back in Feb 2009 I emailed a lot of people including a couple vp's and within 24 hours I was contacted with somone in loss mitigation. I was put on a 4 month forbearance which lowered my payment to $1900 per month from the normal $2400. Anyhow starting July 1st I must begin paying the full mortgage again. I've been faxing my loan modification packet which I downloaded from their website like 2-3 times a week and no response. I call their office several times and they always state they have not received them. I always include all my bills and debt when faxing. It's average about 40 pages. So I decided to emailed all the people I emailed back in Feb and I then received a email from the guy who put me on the forbearance to start. He requested I do not BBC people anymore that I can work directly with him from now on. In any case I received a call from him today. He told me that he's going to submit a proposal to Fannie Mae my investor for 5.50% for 40 years which would drop my payment from $2400 to about $1600 per month and that will include PITI.

So, my question is normally how long does it take to get a response from the investor once the proposal is submitted. He said he would submit the proposal to them on Friday 6/18/09

Has anyone else been told this and if so how long after did you know if your loan was approved or denied?

I saw on another thread I saw where someone with a FannieMae loan ( w/Countrywide), had their loan submitted to FM on June 10th, and received an answer back today.

I have a FM w/ Indymac too, and would love any of your contact info...I've submitted through NACA, but would still like to be proactive if possible.

If you feel comfy sharing, I'd appreciate it.

I have been trying to get a loan modification since Dec 08' with Indymac...and was denied in Feb, but re-applied for a mod under the Obama plan in April. I've received two letters, saying my file was under review, and letting me know it could take up to 60 days to hear anything.. I also would love any contact info you may have for Indymac, because when I call loss mitigation, I get nowhere.

My investor is Freddie Mac, and I was hoping this may be a good thing, as far as getting my loan modified thru the Obama plan, but now I'm not sure. I would love to hear from anyone who got their Indymac loan modified, using the Obama Home Affordability guidelines.

Kimber2222 and Jule215... Anyway, I told you about the call I received a few days ago. But, today is Friday June 19th and I received a certified USPS letter from Indymac today and a next day UPS letter from them. Surprising huh!! For me too. Two letter in one day and only a couple days since they called me.

Well let me tell you what the letter said. It was a "Loan Modification Agreement" and to sum it all up in short. It stated that My loan will be modified to 5.35% for 40 years fixed and my new monthly payment will be $1556 per month with PITI it requested I take the form to be notorized and sign it and return it by July 1st. Let me tell you what I did, I jumped up took a shower and jumped into my car and headed to the bank to have it notorized. After leaving the bank I chased down a UPS driver and right in the middle of traffic handed him the next day prepaid envelope they sent me. The last part of the form stated that the form will not become valid until the lender has signed the form. Im not sure if thats Indymac or Fannie Mae, but in any case I signed notorized and sent back. The last page I left blank so they could sign it.

WHAT DOES THIS MEAN???? ARE THEY GOING TO MODIFY??? IS IT JUST A PROPOSAL??

I don't know if I should be happy or if this is just the proposal indymac spoke about just a couple days ago. The agreement states I am to make my full monthly payment for July 1st 2009 and the new payment should begin Aug 1st 2009 ... What does this mean????? Are they considering me ?

If there are any people out there with Indymac that received a successful modification. Does this form seem familiar to you? Does it mean they are going to modify my loan? Is it just a proposal to mail to Fannie Mae?

It sounds to me, that if you're happy with the terms, it's pretty much a done deal!!...So a BIG congrats to you!! ( Meaning I believe it's a more than a proposal, it's your modification)...Besides they don't bother to overnight things back in forth if they aren't "important"...I'm sure you're very relieved, and I'm happy for you.

Can't wait to feel that relief myself.

I hope it does mean success.

Im trying to relax and think positive. But I have read on this forum so many times that people were offered a proposal / offer and after mailing it back they were decline.

Many people have stated they had to mail in a good faith payment.

Well on my agreement. It states money from borrower $0 , it looks like the money I've been sending every month per my forbearance they did not apply it to my mortgage instead put it in a suspense account. So it looks like Im behind on my mortgage but I really I am not. I checked my credit today and they have not reported since feb 2009

I will keep everyone informed of new updates.

I've been offered a 4-month forebearance plan and it sounds like something similar to yours. It sounds like when the 4 month is up, then the chances for a modification is pretty good (cross my fingers).

Congrats on your success and please let us know when you find out it's final! Your story gave me some hope.

keepme, id appreciate those numbers too!
im about to contact IM to apply for a mod...
i would have sooner but didnt think id qualify....
1. my loan from 2006 was stated income
2. lost my biz last yr and now i earn 50% less
3. my DTR is 99% if not higher! never thought theyd approve me
4. actually thought they might "call" my loan..since i cant verify the income i stated 3yrs ago
5. ive never been late on ANY pymnts
6. surviving off a heloc i got thru IM

any advice would be GREATLY appreciated!!

I'm still waiting to hear something back from Indymac......
I was wondering if it helps to have Freddie or Fannie as the investor on your loan, or if it doesn't matter at all.....when it comes to getting your loan mod approved.

KeepMe....that's great news about your loan mod approval/proposal. I hope to get some good news soon, but I won't hold my breath. I was wondering if your loan mod was approved using the Obama plan guidelines or a different mod program? I'm still current.....and haven't got to 30 days late yet....but struggling to make the payment....and was wondering if Indymac will help you if you are current, even under the Obama plan ??

Ok guys. Here's the latest update.

For everyone who has been following my thread.

I mailed my modification forms back on Friday and I contact Indymac on Monday June 22nd to confirm they received it and to get the lastest update. Indymac received the forms and I was told my modification was approved.

Today June 23rd I received a next a UPS letter outlining the details of my modified loan and explaining my first monthly payment.

New Loan Details
Loan Amount $302,900
New Interest Rate: 5.37%
Fixed Rate Term: 40 Years
New Payment: $1619 with PITI

Old Details:
Loan Amount $299,315
Interest Rate: ARMS 8.50% 5/1 Interest Only
Type Conventional Stated Income (Im self employed)
First Reset Date was scheduled 8/2012
Old Mortgage Payment $2314

I was advised that I do not need to make a payment for July 1st they basically added July payment to the back of my loan which is why my loan amount has increased. Ok. Whatever! It works for me... My payment is still lower!!

So here's my journey.
After being turned away by 5 banks for refi. I turned to loan modification. But in Dec 2008 I was told I did not qualify because I am current. So I did not proceed any further. When Obama became president I saw the making home affordable on tv I contacted Indymac. I was told I am current and they were not helping folks that were current I asked about the program and was told all the details have not been worked out yet. Indymac is a independant and they are not required to offer programs under the Obama plan but they are trying to help people who have loans whom the investors are Fannie mae and Freddy Mac.

I contacted VP of Mitigation, I received his email from another forum and therefore I used it and emailed him. He was very nice and responded everytime very quickly. I sent him a copy of my hardship letter and explained to him that I contacted Indymac almost 2-3 weekly and nobody wants to help me keep my home. He wrote me back and told me that we want to help me keep my home. Again he responds very quickly. Within 24 hours of contacting him I was connected with a negotiator. He took a brief financials over the phone and emailed them to me to fill out and email back to him. I filled out the forms and sent them back. I had a surplus of about $200 per month give or take. Once he received the financials he contacted within 24 hours and offered me a 4 month forbearance to pay $1900 per month. Ok. I will take that. I was extremely concerned with reporting negative on my credit I was told they would put a credit reporting hold on my account so it would not affect my credit at all. Ok. so whatever! Ok under the forbearance they temporarily changed my terms. My mortgage was now due on the 1st of every month and late if not received by the 3rd. No longer the 15th considered late. I will mail my payment on the first and sometimes it would arrive on the 3rd or 4th and collections people will be hounding you all throughout the day beginning on the 3rd. Crazy but whatever moving on. I contacted lost mitigation to ask about updates and I was always told they can't do anything until your forbearance is complete. I would call almost weekly for updates. But would get the same response. So therefore I stopped calling after a couple weeks. My forbearance ended June 1st therefore I was extremely concerned and I began call indymac everyday and my negotiator would not respond to my emails and I would contact loss mitigation by phone to just get the run around. I was told to go to indymac website and download the loan modification packet as though they can no modify my loan with the packet being returned. So here's when thing got good. Since no one was returning my calls this is what I did. I faxed my packet to BOTH 866-435-7643 and 626-583-1370 EVERYDAY OTHER DAY and when I say every other day, I MEAN EVERY OTHER DAY faithfully starting on June 1st 2009. I would mail my ALL copies of debts, bank records, statments whatever I had. It was a total of 38 pages I would fax. I also went to fedex kinkos and made 7 sets of copies of ALL the documents and I mailed those copies to the following addresses every MONDAY.

I still have copies so I did not even have to use them all. After no response from Indymac I sent a emailed to VP of loss mitigation on June 12 2009 explaining to him the my forbearance has ending and my loan negotiator is not returning my calls and how I must start to pay my regular mortgage payment July 1st 2009 and I just can't afford it and how the forbearance helped me alot to catch up on other bills and my hardship status and how a modification would help save my home. After sending the email to him. I sent a separate email to about ten other people in the loss mitigation department basically I just cut and paste the same email. Sure enough my negotiator contacted me that same day and stated that he's going to submit a offer to the to my investor for a modification and he would have a response within 2-3 days. Ok. So be it. I waited. I waited. He never contacted me within 2-3 days. So I sent another email to all the people requesting a update on my account. My negotiator contacted me on June 18th with the proposal and asked what did I think about the terms before he submit the proposal to the investor. I told him the were good. One June 19 friday I received the loan modification agreement in the mail and I rush off to have it notorized and returned the same day. They received the loan modification yesterday June 22 and I contacted them to see if they received it. I was told it was received in the AM and entered into the system and APPROVED. Today on June 23rd I received a next day UPS letter outlining all the details and I contacted Indymac to very I my mortgage payment for July 1st and thats when I was told I did not need to make a payment for July they would add it into the back of my mortgage and I make my first payment Aug 1st.. Woo Hoo works for me!!! So now. The process was extremely stressful, and you will deal with a handful of rude people but be aggressive. When I contacted Fannie Mae and explained to them that Indymac was not helping me. I was told by the Fannie Mae customer service agent that Indymac is not one of the bank working under their programs but they should help me based on me passing the home affordability questionaire. The customer service agent at Fannie Mae told me to be agressive with them and that was great advice. Because I was very agressive faxing my letters and mailing them to their offices. What I did learn through my experience with Indymac is that after your forbearance they would require a good faith payment especially if you are behind. But in my case since I was not behind this is what they did about the good faith payment. I was on the forbearance since Mar 2009 that was my first payment date. Since May 2009 they were not applying my payment to my mortgage they were putting the funds I mailed to them in a suspense account and when it was time for the modification they used my May and June payment as the good faith payment. So they did not request any cash from me.

So guys I hope that my journey with Indymac was able to help you. Thanks to the LOANSAFE.ORG forum!! It was this forum that saved my Mortgage and I would like say THANK YOU TO THE FORUM because if it wasn't for all the steps and other people experiences I don't think I would have ever got my loan modified. Now I need to send my negotiator a card!!

KeepMe,

Your story and success with Indymac gives me hope, and inspires me to keep up the fight. I also started this struggle back in Dec 08' ....and was declined for a loan mod the first time, but after the Obama plan came out, the loss mitigation dept. said that I might be able to qualify for a modification under those new guidelines.....still waiting, but fingers crossed.

I'm amazed by how much you had to go through, but so glad you were able to achieve a successful loan modification thru Indymac/One West.


I would appreciate any help or advice you could give me or any contact info you may have for loss mitigation or any other department that may help.

I have received two letters from Indymac so far.....one dated May 18th...saying my loan mod application was under review and that I would hear something back within 14 business days. I then received another notice, saying almost the same thing....this was dated June 5th and said it might be another 30 days before I'm contacted. The waiting continues......

UPDATE ON MY LOAN MOD:
Everything is now finally complete. But back when I was put on the forbearance I was told they would not report to the credit bureau. That was a LIE!!! As soon as the 5th month arrived they reported me as 2 months negative. Apparently they were putting the funds I mail into their office into a suspense account instead of apply to my loan. This made my account look like I was not making a payment at all. By doing it this way made it where I did not have to put a down payment as though they used the money from the suspense account as a down payment. But I ended up with 2 lates on my GOOD CREDIT stating more than 30 days late. This actually cause a headache of problems. My good credit ruined. My credit score went from low 800 to 697. My chase credit card limited was reduced. I received a letter from chase stating after reviewing my credit they show recent late payments therefore they reduce my credit line to 10k... I was very upset. I contacted chase and explained the situation and they told me to contact them after the problem was fix and they will recheck my credit to see what they can do. After contacting the experian and equifax for 10-15 days no success I finally sent certified letters indymac/one west at all the addresses listed below. I explained to them I was good customer paid my mortgage on time and I was coarsed into this modification forbearance as the only option to get out my ARMs. I including information about the with fannie mae which is suppose to help people who are current in bad loans. I was current on my loan but they were not willing to help unless I was put on the forbearance. So I accepted the forbearance. In any case 2 weeks later I received a letter from indymac stating they would update my account with both experian and equifax to current never late and it should reflect on my credit report within 15-30 days. However 32 later I checked my credit and it was still showing the lates. I wrote again and sent certified with return receipts to all the addresses listed below and this time including the letter I received from their office stating it would be updated within 15-30 days. Sure enough my account was updated to current never late within 1 week. I contacted my chase credit card and they re-evaluated my credit report and reinstated my credit line. The situation was fixed nearly 3 months after my modification was completed. But don't believe them that they would not report negative. The could put the hold on the account not to report DURING forbearance. But please beware that a loan modification can take anywhere from 4-8 months sometimes longer to complete. After you already gotten approved for a loan mod it takes another 45-60 days for the loan to close. Just like buying a house all over again.

It takes them FOREVER! I emailed a few of the people on the list about a month ago and still have received no response. I moved on to contacting my state representatives and provided an outline of the numerous contact attempts I have made. My attempts are so lengthy it demonstrated that I had been trying very hard to make contact and it helped get my foreclosure date rescheduled.

Keepme and Daglo I don't know what I would do with out you! Thank you for the contact #'s! I had somebody call me back after e-mailing a bunch after I got denied for the third time and I think I could hopefully be in luck! I was told to call them back on Nov 19th and hopefully they can have everything worked out for me. They actually told me to disregard the 2nd denial (" just throw it out") and they are going to re evaluate the gross income. This is what messes me up, they keep using the year to date gross which includes some weird OT pay/ hurricane relief work that my husband is never going to get again that he got at the start of the year, this bumps up his year to date which they have been dividing by 12 ) I told them I could fax all the paysubs since mid Feb-March to prove he doesn't make as much $ as they think, and the rep I spoke with told me they shouldn't be using the year to date after all. I said I know, what about people who lose hours or take a decrease in pay, their year to date gross will be higher too, they need to look at what People are making now not what he made in January! I have been working on this since March, it seems they are finally getting faster but then again I am now really behind ( 4 months) so they really want their $$$ Good luck to everyone!
