I hired an attorney who was marketing himself as a "loss mitigation" specialist...loan modification specialist...back on August 5th. He had requsted a fee of $1200...$600 to be paid the day we met and signed the "papers"....the other $600 to be paid in 30 days. Since then, I have had a terrible time getting any contact from him. I HAVE to talked to him a handful of times since August and he always gave me the same "story"...."Countrywide is just overwhelmed with foreclosures....it will take time". This attorney DID file a response to the foreclosure lawsuit...and IS on record now as my "counsel" with the courts. I have been trying to get ahold of this most recent time since mid October. I have left messages on every number I have for him (I believe he works from home?) and have sent emails to every email address I have for him but he DOES NOT RESPOND. I don't know what to do at this point.... He MAY very well be working on this....but why won't he return my calls? I am now 12 months behind on my mortgage and I don't want to just sit back and do nothing.... BUT, if he IS working on a loan modification....I don't want to interfere or hinder or hurt anything he MAY be trying to do. I thought about calling Countrywide's attorneys in my area who are handling the foreclosure on Countrywide's end....just to see if this lawyer of mine HAS in fact done ANYTHING...but someone told me that would probably ruin anything he has done (IF he has done ANYTHING).... What do I do? Does he seem like a "fraud" or "scam artist"? Why would he bother to "answer" the lawsuit on be my "counsel on record" if he was a "scam artist"? He never even billed me for the remaining $600 of his fee either. No, I haven't paid it...but I DID send him an email telling him I wanted to "settle up" and pay the rest of his fee...and he STILL didn't respond. I just don't know what to do at this point. And if I HAVE been scammed....what recourse do I have against him if any?? |

Wouldn't that ruin any hope of him completing what he has started?? If he's started anything?? And if I do report him...where do I go from here? Just try to negotiate with the mortgage company on my own? Or hire someone else? I can't really afford to pay someone else when I'm out $600 I gave to him! Plus, I'm nervous cause he has a signed "limited power of attorney" from us.... |

Well the part about him working for you or not you may know if he instructed you not to contact the lender on your own..............has he done that? Maybe some info about the loan will help......... Countrywide is the servicer........... What is the interest rate at? Is it fixed or adjustable? If adjustable, when is it adjusting? Are you paying interest only? What is the loan amount? Is it one loan or two? Is this the only property you own? Is it owner occupied?

As a matter of fact....back in September, I was having a hard time getting ahold of him then, too, and I DID call Countrywide to see if they had any record of him contacting them or of the power of attorney I signed. Now, I only called Countrywide's regular customer service line and they told me NO....they had no record of him ever calling them and had no record of a power of attorney. When I FINALLY got in contact with my attorney and questioned him on this...he told me that it was because he's been DIRECTLY in contact with Countrywide's Lawyers who are handling the case since the lawsuit was filed....that does make some sense...but I don't know if it's true... I've always felt from the beginning that this guy IS NOT a scam artist...I still don't understand why he would file the response to the lawsuit if he was. But, if nothing else...he has VERY poor business practices. But, that's why I don't know what to do...if he IS working on this....then I don't want to undermine what he's doing.... To answer your other questions.... The interest rate is 6.875 fixed. I was paying principal and interest before we missed our first payment. No payments have been made since January of last year on the advice of both the credit counselor's we dealt with and then on the advice of this attorney as well. We are now 12 months behind. When we defaulted on the loan we owed about $88,000 I believe. It is only one loan It IS the only property we own and it IS owner occupied... We originally had applied for the HEMAP program in Pennsylvania when we were two months behind. It took 90 days to receive and answer and we were denied. We appealed because I honestly believed we had valid grounds for appeal. The appeal process took another two months and we got denied on the appeal sometime in July. That was when I decided to hire this guy because we were already 6 months behind at that point and I knew we could never catch up on our own. He said he felt "very confident" that he could get us a loan modification with a lower interest rate...extend the loan back out to 30 years and actually (hopefully) get our payment LOWERED a bit. That's what we've been hoping for. Is there anywhere on here I could post his "company name" or his name to see if anyone else has dealt with him. Maybe someone could tell me if they had a good or bad experience with him? |

No you will not be able to post his name here because this forum is sponsored by the attorneys that are on our home page which we have authorized to be there so that we can offer what we do on this forum for free. You are in a catch 22 here and I don't know what to tell you..........any advice that we can give here or any other avenue that you can take, ...........it seems you won't want to take, because you don't want to mess anything up that your attorney is doing.............but you have every right to make sure that he is in fact in contact with CW and you need to hear that from CW. If you have any copies of the foreclosure notices it should have the contact info for the attorneys for CW..............you can call them and find out if your attorney is working with them................it just seems odd that he isn't even giving you updates at all.

This lawyer I hired has does NOTHING other than file the reponse to the lawsuit back in September (it STILL doesn't make sense why he would even DO that if he was a scam artist). Anyway, it looks like I'm on my own, for now. I have NO idea what to do or where to go from here. I thought I had done the RIGHT thing by hiring this guy....and now it seems I've only made everything worse! When I hired him back in August, we were only about 6 months behind and no lawsuits had been filed or anything and now, after messing around with this guy for another 6 months....everything is coming crashing down. Countrywide's attorneys even informed me that a Hearing for a Summary Judgement has just been set for Feb. 12th. I told them that I had been scammed and that it has ALWAYS been my intention to try to save the house...but now it appears as if I have been sitting back and doing NOTHING for the past six months, when in reality I thought it was being handled by the attorney I hired. Why me? As if it's not bad enough that I'm losing my house with four small children, but of course, I HAVE to SCAMMED too! Countrywide's attorneys told me I could submit a loan modification "proposal" to them and they would forward it to countrywide...but I have NO idea how to do that! THAT'S why I decided to hire an attorney in the first place!! They also told me I could call Countrywide myself and try to negotiate, but I did that several months ago and all they would offer me is a payment that was $150 HIGHER than the monthly payment we were ALREADY struggling to make. I just can't afford that. What do I do now? I'm SO tired of all this, and just want it to be over! If I knew for sure that I could find somewhere to rent that could accomodate a family of six and would rent to someone with crappy credit....then I would probably just leave at this point. I just want all of this to be over. And what about Chapter 13? I THINK we can file for that, but I was told that we would have to be to AFFORD 100% of our bills? (Whatever the hell that means) And IF we could AFFORD 100% of our bills...why would we be in this situation in the first place??? I'm sorry for the long post and the rant...but I've been dealing with this crap for over a year now and I think I've finally lost it. |

One mortgage only, owner occupied home, fixed rate of 6.875, convential mortgage, I believe it was done at 80% loan to value. We purchased the house in 1999 for $72,000 with another lender. In 2001, I believe, we took out a home equity loan to pay off credit cards (mistake, I know). The home equity loan was for about $20,000. In 2002, we decided to refinance and roll the two loans into one mortgage with countrywide. This new loan was for around $95,000 at the terms I mentioned above. At that time, the house appraised at $108,000 which I thought at the time "I could NEVER sell my house for that". But I didn't care, cause I wanted the loan. At the time, I thought I was getting a pretty fair deal and had no complaints. Over the next few years, our mortgage payment just continued to go up....not anything having to do with Countrywide, but due to increases in taxes and insurance. Countrywide kept raising our escrow in order to cover these increases and over a 5 year period, our Mortgage payment rose by over $200...but our income did not. That's when we started having trouble making the payments. We were at the top of our budget when we first got the mortgage and just couldn't seem to swing the extra $200 once it rose that high. So, we missed our first payment in January of 2008. I actually DID make a payment at the end of January 2008, but it went for December's payment. At the beginning of March 08, I got the Act 91 notice and immediately met with a Credit Counseling Agency. They helped me apply for the HEMAP program in my state. We were denied. I really thought we had grounds for appeal, and so did the credit counselor, so we appealed the decision. We were denied the appeal as well. But, this entire process, including the appeal, took over 5 months. It wasn't until mid-july that we finally got the answer on the appeal. We were now 7 months behind. The credit counselor we were working with told me that she could help negotiate with Countrywide on our behalf, but that we would HAVE to be able to afford an EXTRA amount each month to pay off the arrears. She said the lenders weren't willing to do any type of "loan modification". Well, I started doing some research on the internet (too bad I didn't find THIS forum back then) and I found a bunch of those so-called "Loss mitigation companies" or "Loan Modification Agents" who claimed to be able to get your interest rate reduced, term extended, and get your payment LOWERED. That's what we wanted, that's what we needed. It has ALWAYS been my intention to try to save my house. So....I hired one of these "companies" and the guy also happened to be a real attorney (which I did verify with the bar association). Anyway, I hired this guy back in August and was relieved that HE would be handling most of it and I wouldn't have to worry about it TOO much. I have four small children and just wanted the "burden" off me. To me, that was worth his fee. Well, he turned out to be a complete SCAM and has done nothing! I really just found this out for sure TODAY. You can read all about THAT in this thread if you like, but it's really here nor there at this point. No contact from my attorney...what to do? I am now 12 months behind on my mortgage and I've just found out that a hearing for a "summary judgement" has been set for 2/12.....I have no idea what that even means. I DID try to call Countrywide myself about 2 months ago when i wasn't getting any communication from this so-called lawyer. They took all my information for a "loan modification" and said they would send the paperwork out. About 3 weeks later, I received a packet in the mail with something that I THINK was called The Home Savers Advance Program. Basically, it said I could resume regular monthly mortgage payments the very next month, and then in 6 months, I would have to start paying an extra $150 a month for 20 years I think, to pay off the arrears? Well, I called and said, "What about the loan modification"....they told me I didn't qualify for that and that's why they sent this out instead. I told them I needed to think about whether this was a viable solution for us. You have to remember that, at this point, I still thought this attorney I hired MAY be working on the loan modification on his end. A few days later, I called countrywide back and told them that we would RATHER have a loan modification if possible because we were struggling to make the original payment and could never afford the extra $150. THIS lady I talked to, told me YES we MAY qualify for loan mod and she didn't know why the other lady told me we didn't. But, at this point, I did nothing, because i was still putting faith in this attorney we hired. We're getting down to the wire now and I don't know what to do or where to go from here. Countrywide's lawyers, whom I contacted today to find out if this so-called attorney had EVER been in contact with him...which he of course HAS NOT...told me I could write up my own proposal and send it over and they would forward it to Countrywide. I have NO IDEA how to do that!! I need advice...do I go back through the Credit Counselor who originally told me that a loan mod wasn't even possible? Do I call Countrywide directly myself? Do I try to hire another lawyer? Or should I just throw in the towel and file Chapter 13? And what are all these programs you guys talk about on the forum. I've read about some of them...but it doesn't appear to ME that I qualify for them? We ARE severely behind, we don't have an ARM....and that seems to be what most of these programs are for? Our credit sucks. I don't understand ANY of this. All this legal jargon is like a foreign language to me. I never wanted to do any of this on my own which is why I hired this "attorney". I'm just not capable of doing this alone. And I'm afraid to "get things started" so to speak, with a bunch of different agencies or whatever, cause won't that hurt what one is trying to do if there's a bunch of other's working on it too?? ARghhhhh...I'm SO confused. btw...no sheriff's sale date just yet...but I'm guessing one will be set at the hearing on 2/12? And do I have to GO to that hearing? Do I need an attorney there with me? And how the hell am I supposed to pay an attorney when I can't pay anything else. One more piece of information....if I am totally HONEST about our income/debt...we are probably about $500 in the whole each month...if not more. Sorry this is soooo long, but it HAS been a year and there's alot to tell.... |

Hi Mikelry, I'm sorry for all your hardship and getting so much run-around for the past year and that you ended up working with this dishonest lawyer throughout the process! That's so stressful for you and your family. It sounds like you may have a Fannie Mae (investor) loan, if CW is offering a Homesaver Advance to you. For more information about that program, go to Media: News Releases > Fannie Mae Introduces HomeSaver Advance It is an unsecured loan that Fannie offers, and it may be worth pursuing it with CW as it will help cover the missed payments and get caught up so you can get a fresh start. I'm sure that *** will respond to the rest of your questions. I just wanted to let you know about that link as it may be of immediate help for you through CW. I just don't know if it's a viable option for us because we couldn't afford the regular payment. BUT, I DID look at it as possibly a temporary solution until we could do something else? Yes, it could definitely help as a temporary solution and give you some time to also pursue a loan mod to reduce your payments through CW with the new Fannie Mae Streamline Loan Mod program. The reps at CW still don't have much information about this... it seems to always take a few months to get these programs off the ground. There is info about this also at the Fannie Mae website: Act Now to Prevent Foreclosure I would suggest that while you are pursuing and securing the Homesaver Advance unsecured loan, you also let CW know that you are VERY interested in the Streamline Loan Mod program-- so that they put that in your notes. Keep calling and checking on its availability and remind them of your interest in modifying your loan that way. If one rep doesn't make sense to you (or gives you non-answers), hang up, call back, and talk to another rep :^) Good luck Mikelry, and hang in there! |
