My Dad who is a WWII vet, and retired government officer, was approved for a loan modification in May 0f 2008. He was told what to pay monthly and for the next 12 months. He signed the modification, had it notarized sent in the payments on time since then. In September of 2008 he received another loan modification different terms. I called GMAC to find out what it was about, they said the investor did not buy the loan. At that time I asked them for a fixed rate mortgage, my Dad gets a VA pension and a Govt. retirement pension. GMAC said they would get the paperwork together and FEDEX it.......2 months later, he gets the same modification papers he got in September, same terms etc. I called again they said they were so behind on fillling out there paperwork that the proper department didn't get the paperwork done yet. In the meantime he hasn't missed a payment of $2490.88 per month since he signed the modification in May. He is still getting default letters, (which he is told to ignore) and before they accepted the original modification he had to give them about $10,000. I know this is a long story, but I really need some help in getting this resolved for him. Yesterday he gets a letter from GMAC saying that the modification was rejected because he didn't send back the modification paper he received in November. I found Mr. Javid Jabari's e-mail address on this site, the e-mail came back 3 times saying the box was full. I found a Mr. DeMolina's (CEO) e-mail address on Hoovers site, and Mr. William Muir (Pres.), none of the e-mails are legit. They must have been in undated and changed them to unpublished ones. In the meantime I spent hours faxing letters explaining the situation to Loss Mitigation, and the corporate office to Mr. DeMolina. NACA said they can't help because now he's not behind on payments, VA can't help because the value of the loan is higher than the appraisal. I need to save my Dad's home. I don't know if the faxes I sent are actually getting to Mr. DeMolina himself. Any suggestions would be greatly appreciated. It's getting me paralyzed with fear. Ye |

I'm sorry you and your father are going through this run-around, and it does sound extremely unfair. *** or Moe will be by as soon as they can to give you some advice/direction on where to take this. With NACA you don't have to be late..........so I am not sure why that was said............everything gets submitted online and it may be the only way for your dad to get another modification proposal......... the modification given are up to the investor on the loan........if this is a VA loan, then they would be the investor, but the servicer, GMAC, would be the one to take care of the modification.............which is does not sound like they are being very helpful. You may want to try NACA again by submitting the info onlin and scheduling the counseling appointment if you dad is not near a NACA office............click on the link to get started.......... https://www.naca.com/refinance/refinanceSubmission.jsp

I wondered if anyone has current e-mail addresses for any of the people in loss mitigation or the corporate offices of Mr. DeMolina, If I have learned nothing else from this, it is to follow up everything in writing and faxing it to them, asking that they add it to our file. I would very much like to get a confirmation from them that they have received the faxes and I figured e-mail is the only way to go. I called earlier, was on the phone waiting for 2 hours only to be disconnected....again!! |

Like all of you that have gone through this ordeal, it is mentally and physically exhausting, I have to be strong and persistent, I can't let them take my Dad's home!!! |
