Loan audit one big violation. Mod denied because investor is not modifying. The letter I recd from the bank said the reason was because I am not late on payments....I have Indymac. Ok, so which is it? Anyway, we are trying a more stern approach, a letter is sent, wait to hear. Well, I have a second, also current. I get a call from a gentlemen in the attorney's office yesterday to talk about the possibility of trying to settle the second. I'm not opposed as long as I know a few things first. One, what does that do to my credit and two, am I going to be 1099'd? Three, if I had the cash available then I probably wouldn't be looking to mod, right? When I asked these questions, I was told "I don't know, I'll try to find out, but the taxes on 80,000 (second) won't be that much and you can make payments to the IRS"....come on really? Is this really good advice? What if I had followed it? OMG, I'm scared for ths kind of advice, unless there really is something I don't know....thoughts? ideas? suggestions? |

When this happens and there are legal violations that are ignored by the lender, the attorney needs to discuss possible litigation on how to proceed. I see denials all the time and you all need to show them that you will not put up with that. To me, who cares if the FDIC is running the failed Indymac bank. Paiva should sue the FDIC if your loan has legal violations and they are not assisting you. But you have to work that out with your attorney and I recommend you demand help in that area.

I have posted this in another new thread today, don't mean to double post, but I thought this was appropriate as it goes with this original topic and help would be appreciated. Well, here we are Friday 12/12. I had been trying to contact Paiva's office for days and finally got thru to the 951 number and was told their systems had been down all week. Anyway, nobody there ever notified me of the status of the modification. I recd a second denial letter from Indymac this week for the same reason - I'm current. Well, gee, thanks. I was told there was nothing else that the processing center for Paiva can do for me and that my file had now been passed on to the attorney. Isn't that where I started in the first place? I'm confused. I was given the attorney's direct office number but I am feeling really lost and frustrated and honestly somewhat annoyed and left hanging. I have the TILA violation in the loan docs that I suppose should and could be persued, but who does this and at one point? I need some help and guidance with the next steps. I am pretty upset because I feel like they are blowing me off now. Is there a good contact person? |

It would help to keep all your info/questions to one thread in order to answer them. Many of the folks you are reviving/questioning are no longer involved in the forum.

It may be a shot in the dark, but if they respond, any information is good information for me right now. |

It seems like it is taking forever and I have thought about going to someone else. I'd have to pay all over though. How about you? |
