    ** NEED HELP ** FHA HAMP 13 months of trial payments & BofA now requesting updated financials?!?!?!

    BofA wants me to fill out a new application and submit updated financials after I've been approved and in trial payments for over a year. I really don't have it in me to start the process all over again...

    Is this normal procedure for a FHA HAMP mod from BofA?

    NO, you should not have to resubmit a whole new package for them to complete the modification. I would contact the executive's office immediately and let them know you have made 13 trial payments waiting for a decision and if they try to make you resubmit anyway I would tell them you are going to file a complaint with your state AG, senator, OCC, etc. This is absolute BS and for no reason should you need to provide a new loan mod application..

    It is the executive team that is telling me to fill out the new forms and send them new financials. They are saying that it is NOT a new application, but the forms are identical and I thought that with HAMP, once you are approved, you are approved! Can they force me to supply a new package even after I have been approved and in trial payments for a year?

    You should not still be on FHA HAMP trial payments one year later, you should have already received a permanent modification.

    Here are some steps you can take to get help for an FHA loan;

    1) Call the FHA National Servicing Center (“NSC”) at 877-622-8525 to file a complaint:
    They are responsible for assisting FHA borrowers who have had difficulty working with their lender. You will need to provide the NSC with your FHA case number. Get your case number from your lender, or your FHA case number can be found in the top left corner of your HUD 1 settlement statement received at closing.

    2) Contact FHA Commissioner Carol Galante:
    Carol.J.Galante@hud.gov
    Direct: 1-202-708-2495.

    3) Call the FHA Outreach Center:
    1-800-CALL FHA (800-225-5342)

    Thanks Cat. I've been speaking to the FHA National Servicing Ctr rep assigned to my case. She is not very helpful at all. She stated that they are aware that BofA is running behind and sent me to BofA's executive escelation team who want me to resubmit my information / application for conversion to a perm mod. FHA National Servicing Center stated that there is nothing else they can do but refer me to BofA's escalations.
    I will call the FHA commissioner today. I will also call the FHA outreach hotline but I do not think they will be of much help.

    I want to get an attorney but I don't know if that will help.

    I wish I never applied.

    I am sorry to hear that they haven't been any help to you. I am pretty sure you should get a response out of commissioner Galante's office, hopefully with some help, as she is getting pelted with complaints as to why FHA loans are having such a hard time getting restructure help from NACA.

    Quick Update

    Quick update:
    Yesterday someone came by my house from B of A to take pictures of the outside. She said she has been by a few times and hasn't caught me or my wife (either one of use are always home which is weird why she said she could catch anyone home..) She took some pictures to "prove that someone was living here".

    Is this a good sign or a bad sign?

    This is the norm in any case, lenders will send someone to check occupancy periodically to make sure the property hasn't been abandoned.

    Exclamation ***update*** 10/3/2012

    BofA claimed they were sending the perm docs first week of August. They never showed up.
    So the update is...nothing.
    I'll just keep making trial payments. I'm about ready to give up.

    What did the FHA outreach center say when you contacted them? Have you also contacted the FHA commissioners office as well?

    I contacted the FHA commissioner's office and spoke with a nice woman who contacted BofA.
    She told me that BofA said they would send it in August. When it didn't come, they gave her another date, but nothing has happened yet. I don't think FHA has any authority over BofA. I'm sure she's used to getting the runaround just like me.

    HUD/FHA does in fact have authority over the servicers and how they handle FHA loans, which is why they have the complaint process in place if you are having difficulty with your servicer. If it were me, I would call back the NSC and get a different rep if the one you are working with is incompetent. Or contact a HUD counselor in your area to see if they can help;

    Thanks. Cat. Will do. I have a feeling that it's more than just being backlogged. The fact that they requested I re-apply after 13 months of trial payments makes me feel that my paperwork was lost. What would happen in that case? Have you ever seen that before?

    Yes, unfortunately I have seen that many times from BofA especially. Most members will just reapply, but in the case of FHA HAMP, the arrearage can not exceed 12 months PITI. Which is why it is important to try to get the initial trial in this case converted to a permanent modification using all available avenues.

    wow, I've been in trial payments for a lot longer than 12 months. I will keep you all posted as to the outcome.
