    Modification denied BoA 3 times and foreclousure date 7/9/2012, 24months past due

    Moe Benard ,
    I really need your help now.
    I short sale my house in 2011 after three attempts for Modification (old post here"2 properties 3 loans w/ BoA) Came back to live in my condo which I am trying to save. Denied HAMP, MHA, and now denied National Homeownership Retention program...which is specially for 4-option ARM loans, like mine. President of the bank Barbara Desoer said that will modify all 4-option ARM loans..so called "trouble loans'...and is not happening to me.
    They said" loan is not elegible for modification because we cannot create an affordable payment without changing the terms of the loan beyon limits of the program"
    loan balane 349,000 + 38,000 behind (24 months past due) dated 2006
    reporting 6,500 combine gross income a month

    Please Moe tell me what should I do. I placed a voice mail today to the negotiator Cesna Niko to call me as soon as possible...have foreclousure date for 7/9/2012 and been holding there because of current process....posponed from 2 previous dates already...but now what else I have...can I appeal?...what sources I have...i read about HOPE Team that escalated a case to US Treasury.....how do I do that?....

    may be they will ask me for the 38K past due not to sale my home

    Hello Katita,

    You can definitely appeal their decision and reapply for a modification right away. Do you happen to know who owns your mortgage? If BofA owns your mortgage as well you may be able to qualify for the new national mortgage settlement/DOJ settlement which may offer principle reductions to underwater borrowers.     My home soold Evan...8/20....they did not have mercy. loan manager said she scalated for review but never got fedex package she said she sent. ...I just posted " Wronful Foreclousure?....I can't see it on the new posts....please reply to that one....thanks.
