Well, I thought I had it planned out on how to go about fighting the rejection of our modification, but now I'm not so sure. I had contacted an attorney who advised me to send 2 letters, one regarding the TILA and one regarding RESPA. He advised not to make the house payment and when it gets filed with the court, then we bring him on. Our charge would be what a more affordable house payment would be for us ($800) and that would be put into a trust each month with expenses subtracted from it. I researched and can only find a QWR, so I put one together and emailed him to look over and let me know if it would suffice. At that point he said he can send the letters for me, of course for a charge, and recommended that we try to make some payment. I said that my bank will not accept a partial payment and he said that it is showing that we are trying and could delay some things. I don't know which way to go right now, I am wondering if I shouldn't try for a modification again? I don't know what figures they were looking at, but said we were paying out more than bringing in...which is not what my worksheet showed. What else can I do on my own to fight this rejection before allowing my house to go into foreclosure for anything to happen. I'm afraid that even if it does go to the foreclosure point and with an attorney, I could still lose my house. We do not want to lose it! We have 4 children and it is not that easy to find somewhere big enough to rent for a family of 6.
