BOA trial mod but will net send packet,HELP!!

On sept.15th i tried to get a trial mod. thru the mha but was told i did not quilify for anything they had NOTHING..The man gave me the figures he had and after i hung up i figured out he had mysteriously added in $1,036.wtf?
Then on sept.16th i got a call and i now prequilified for the mha which now brought my payment down from 2066.00 to 1200.00.Asked if i could make the payment on the 30th ,i agreed and i did. that was on a saturday and i was instructed to call boa by the 30th for further instructions and to make my paymt which i did.The woman said i did not need to get a packet,they were not doing that anymore.I didn't really understand why but i beleived her.She asked me to write down a fax number and told me everything i needed to fax.I faxed everything over on october 12th.
I have called to check and i have spoken to very rude people to teh point of 1 guy telling me if i paid my bills i wouldn't have to talk to him.I'm in a trial mod so i am paying my bills dumb ass
so i get a call fri. nov 13th from boa,i call sat. to find out that yes i should have gotten a packet.The the guy says that my trial payments were due on the first of the mth and i made mine last mth on the 15th.OMG, I made 1 pmt on sept 30th so what your telling me is i was suppose to pay another 1200.00 on the following day? thats $344 more then the mtg payment i can't afford now.He said someone made a mistake & they have no record of me faxing anything over to them(big surprise) anyway he said they now have a new dept as of oct. so thats probably how they got lost.
My ? is why won't they send me a packet? I have no proof i am in a trial mod at all.They charge me $87 a mth in late fees and $15 to make the payment over the phone.
My fiance's income gros is $3,960.mth.. My nam is not on the house but i did contribute 620.00mth in child support when my ex sent it and now it's been over 5mths with nothing.Also my fiance's a/c bussiness has taken a major blow from teh economy and thats why he had to find a hrly paying job.So are hardship is the loss of 620.00, about 1800 from company.
So i know we quilify for the mod but the guy said this is my 3rd payment and time is up.WTF,sept 30th to now is like 42 days not 90..
I am really confused and with 4 kids and a very stressful last few mths i just don't know what to do..
Oh and I told the guy that my mtg is for $280,000 my county market value is at $159,000 and unfortunately i have a registered sex offender who built his home right next door to me so now i'm guessing it's worth maybe $130,000 what do you think? He asked do i want to stay in my home ,well of course i do but we need to come together and find what will work for both of us.I just am so lost ...any advice is much appreciated

Kim, take a deep breath so you can clear your mind and think clearly.

It doesn't sound like you were on a HAMP mod b/c you would definitely have received it in writing. Also, all HAMP trial mod payments are due on the 1st of the month; not the 30th or the 15th. Find out what plan you were actually on as it may just be a forbearance for 3 months (3 months at reduced payments to help you get back on your feet). Under HAMP, if you were notified on September 16 your trial payments would be Nov, Dec and January all on the first day of the month. You may have just been tricked into making a payment.

It sounds like there is nothing pending so you may want to get your HAMP application faxed in.

Thank you darkdays, and yes i agree i think the little india lady tricked me.
But when i have called they still say i am in the mha program but i do not need a packet...
I will be calling them first thing tomorrow..
