Hi. I have HEARD that they can. I have not experienced it myself. Try calling Kevin Winn at NACA 617-250-6222 extension 1254. You will need to leave a message. Tell him you are not a NACA client yet but have an imminent foreclosure and what should you do.
There is also a spot on the NACA site (naca.com) where you can send an e-mail if you are in imminent danger. Try both and good luck.
That's about all NACA has done for me....They got two foreclosure dates postponed. I just went online to the section for persons who have a sale date.
They respond to that but they haven't done anything else as far as negotiating or responding to any correspondence.

NACA stopped mine. (June 2009) and I'm still here.
How long was it before you heard from NACA? I filled out the sale/auction form back towards the beginning of the month but haven't heard or received an email confirmation. I tried to submit the form again and it said that they had received my previous submission. I didn't see in the member area that they have received anything I've submitted so far. My sale date is 11/30 and I couldn't get a phone consult until 11/23.
Are they not actively negotiating your case then?
NACA normally requires you to attend a free four-hour Home Save workshop (if you live within 100 miles of a NACA office). However, if your auction date is imminent, they will still help you. I was already a NACA client when I received my foreclosure notice. I filled out the online form as you did, but also took it a step further. I'm not sure what state you are in but here in Georgia almost all foreclosures are non-judicial, which means they aren't heard before a judge. I found the online version of our County's legal paper and the advertisement for my home. The ad should give you the attorney handling the foreclosure (which also should have been mailed to you, regular and certified). Call them and tell them you have called NACA and need to know if the lender has called off the sale. Then call your lender as well to let them know NACA has your case information. Mine was called off less than 2 weeks before the sale (June 2009), and has not been rescheduled as of yet.
The last time I spoke with someone at my lender (Wachovia/Wells Fargo), they advised me that the loans for people NACA is working with are handled by someone other than the regular Loss Mitigation folks. Probably they handle NACA ones more carefully. Last fall, along with other NACA clients, we marched to Fannie Mae headquarters in downtown Atlanta and demanded to see the CEO. (LOL). We left about 20 giant trash bags full of clothes, toys, etc. symbolizing the personal possessions that are thrown onto the front lawn when a home is foreclosed on. NACA also has the home addresses of the bank CEOs and photos of their homes on the website. They are very aggressive at targeting unscrupulous lenders.
I can't speak for everyone but am certain that if not for NACA my mod would be unread in a stack of paper at the bank!

Are you working on a modification through NACA? How far along are you in the process?
I am making a gamble that they will not foreclose on Thursday. I had to come up with $9000 by Thursday in order for Chase not to continue to continue to foreclose.
I am 10 months behind and even if I pay the $9000, I would owe an additional $20,000 in back pay. The only thing is if I had paid the $9,000 I would have the option of filing a Chapter 13 after a Chapter 7.
I jut got off of the phone with NACA and they said that they submitted my suggested modification package to Chase yesterday and got a response saying that they received notice from Chase this morning. The lady at NACA sounded VERY surprised that Chase responded so quickly.
I will be praying MANY prayers ....
I am working on a modification through NACA. They advised me to take the HAMP my lender offered (with trial period). They told me that I don't have to take their final offer if I don't like it they can still negotiate. The NACA website states for my account the servicer proposes 5 years at 2%, then the rate would step back up, but would be capped at 4.8%. I reported to NACA that I accept the agreement, but haven't seen official papers from the bank yet.
I was also 10 months behind when they scheduled my foreclosure date. However, at no time was I asked to pay a lump sum to do the modification.
I know this is not always the case. My NACA counselor told me to hope for the best, but always prepare for the worst. In other words, don't send your last dollar to the servicer without a written agreement. Then you could be left high and dry with no money to move or rent a place in the worst case scenario.

They are not asking for $9000 in order to modify. When I filed Chapter 7 bankruptcy, Chase filed a motion to lift the stay. I had my BK attorney file an answer and they came up with the agreement that I pay $9000 on then file a Chapter 13.
I decided to gamble and instead work with NACA.

I have already filed Chapter 7. My attorney is allowing me to file a Chapter 13 with a Chapter 7.

I too am in Atlanta and have IMB as a servicer with Wells as a investor. I just finished my process with NACA so it is all in their hands. IMB this week acknowledged they recieved something from NACA but havent received my proposal from them yet. My forbearance is up Dec 15th. NACA said for me to keep sending in my forbearance payment amount even after it expires. Are you sending in anything now? It sounds like you still are not modified but close right?
