Angry Always Current YET being harrassed by Wells Fargo

my experience with Wells Fargo has been a nightmare!!! Never late EVER and asked for a modification due to me being out of work for 2 years (husband is only income), we denied their first offer of HAMP because they increased our income by over 1500.00/month. Obviously they do that with a lot of people from what i am reading. Since the day we asked for a modification they have called my home 4/5 times a week asking stupid questions that have already been answered. Even calling to remind us to make our payments. AGAIN, we have never EVER been a day late or a dollar short on our mortgage! There are obviously now deeply afraid. I have only called them 3/4 times and they have called our house probably 40 times in the last 3/4 months... It has honestly been a nightmare, i am soo tired of them calling when i have done nothing. They call us even on Saturdays and Sundays first thing in the morning!! We get recorded calls saying please hold and then when someone comes on they give me their speel and then say ohh i am sorry i see from the records we didnt need to call you...then they hang up on me. They are out right harrassing us and we have done nothing to be treated this way. After denying the hamp they said they would re-evaluate it since the income was wrong, of course i am finding out that has never been done as stated by the supervisor i spoke with. After telling them repeatably when they call that they have screwed it all up they are now claiming they will have an answer in 10 days since i told them I was going to give them a reason to call and continually harrass me pretty darn soon! We want to keep our house but they are pissing me off so bad I am about to tell them they can take the house and shove it due to their harrassment...

Any Advice on how to handle this?

What a nightmare! Have you escalated this to a supervisor at Wells Fargo? It almost sounds like you have some kind of case against them possibly in small claims depending upon the laws in your state. Do you have a log of all the calls? Could you ask them to only contact you in writing because they are now harassing you?

UGH, just got another 8:05am phone call to remind me of my 3rd trial payment due december 1st!! HELLO, I NEVER SIGNED THE HAMP PAPERS, SENT THEM BACK UNSIGNED AND SENT THEM A OVERNIGHT LETTER TELLING THEM WHY I DECLINED IT AND THAT WAS 2 MONTHS AGO!!! The gal said even though i didn't sign i am still signed up for it in their system. WTF! Seriously i am going to go wacko with all this, i chewed her out and told her that if they call me again i will stop making my house payments. Her response: i will document it ma'am! HELP, CAN SOMEONE TELL ME IF I CAN GO AFTER THEM, I would love to be able to quote some law at them. Should I call the executive team? I haven't called them yet but tried this morning but their closed since its Saturday. This is just unbelievable, its making me sick!

I would send them a certified letter with a copy of your mortgage statement showing you are not behind. I would include a copy of all paperwork you have already sent them for the mod requesting that it be reevaluated, and why. Also explain to them about the 10 call a week and you would appreciate the time being spent on evaluating your modification, not harrassing phone calls.

I would also state that you request that all communication be in writing as you are getting conflicting information concerning your loan, modification etc., and if they continue to call for collection on an account that is current you will consider any call as harrassment and will pursue that avenue.

I think there is something going down at Wells, and they are trying to put their ducks in a row. An Arizona bankruptcy judge requested that Wells testify as to the loan modification criteria and practices. I haven't been able to find that testimony yet, but They are also being sued by the investors on some of their mortgage packages.I think they are being forced to make changes internally and they are trying to be preemptive. It's either that or they are doing something with that really bad MBS's they have

First of all, you only get one chance at the HAMP. Since you declined their offer you will not get another chance. The HAMP is the best mod program out there, if you qualify for an in house program it is not going to be as good as the one you let get away.
The lenders use 1 month worth of your most recent pay stubs to figure out your income. The numbers are right there, supplied by you, how could they screw that up? You do understand they use your GROSS income right?
The new payments include principle, interest, taxes and insurance and will not exceed 31% of your GROSS income.
If you don't want to take the calls you don't have to. That is the cool thing about phones, you don't have to answer them if you don't want to. You would want anything they have to say in writting anyway, so if you get something in the mail open it, otherwise ignore them.
It's just not as easy as telling them to to take the house and shove it. You signed a legally binding contract with them when you signed your loan papers. They have the law on their side. The house would have to be on the market for 6 months with no offers before you could do a deed in lieu.

imlars you are incorrect, you can only accept 1x but in our case they made an error so they have to re-submit it for approval, they even acknowledged that. If we only got one than they would be inflating EVERYONES income to be on the winning side. And yes, they had the income right in front of their faces and still some Einstein added 1500.00 a month to it. It was that simple and they still screwed it up and admitted to screwing it up. They also took our 2nd mortgage that has a payment of $322.23 and turned that into a debt of $3,222.30 a month. So no i am not the stupid one here, they are.
We make our payments and will continue to do so but qualify for a modification based on the income. we have pulled from 401k's to make our mortgage and will stop when we see fit. Yes I dont have to answer the calls but with a newborn in the house and 3 other kids in school during the day I need to be there for them when they call, i choose not to ignore. And since I have never done anything wrong where my mortgage is concerned I have no reason to turn off my phone and hide!

Its more the principal behind their unnecessary calls than anything!

They are breaking the law and I would call the Attorney General's office for your state.
They will put a stop to that.

Also, file a report with the BBB.

Correct. If the agreement wasn't signed, she was NEVER on HAMP.
In the past, where both (servicer/borrower) signatures for the Trial Period Plan were still required, the borrower could even re-apply AFTER signing the agreement UNLESS the servicer provided the borrower with a signed copy.

Same reason: According to the Trial Period Plan, the agreement is not in effect unless the lender provides the borrower with a signed copy.
