nativelasvegan, thanks for the support. I will try to start my own thread. BOA has never sent anything to me regarding the status of my home. I did have a gentlemen assigned to me at one point that is how I got a forebearance agreement, however at the end of the agreement he was no longer with BOA and that is where the ball dropped!

I am trying to get an in house mod w/BOA since I don't qualify for MHA. My paperwork has been submitted several times and I keep getting denied because they keep trying to qualify me for a MHA and then told me verbally that I didn't qualify for an in-house mod. I have only dealt with the home retention team so far. I am in foreclosure with a sale date of 11/30.

Today I have called several times and am getting the run around from the home retention team that I keep getting transferred to. Apparently every time I called today there system was down so they weren't able to see if I'd qualify.

Would you recommend contacting OOP via email to get my file in front of an actual negotiator or keep trying with the home retention team? I just want to make sure that I'm contacting the right people, in the right order.

I would not waste anymore time on them and email OOP...that is the only way I ever got a negotiator I could speak with. Do understand that they are extremely overwhelmed so be sure to mention your sale date and you need this escalated when you send the email. Also make sure to include your loan number and a phone number. I talked to my nego today and he told me he was out of the office yesterday and had 65 new voicemails to go through plus God knows how many emails. So, while time is of the essence, do realize that they are busy and working hard. My nego is often working long hours and while we the homeowners are under stress, their job must also be extremely stressful. I have found being nice and understanding has helped me build a rapport with my nego and if he doesn't always get back to me right away, I can safely assume he was out of the office that day so I just try again the next day. Of course, each one is different so get to know yours. Good luck to you!

nal -- who is your investor? I agree with ama. Definitely contact the office of the president (OOP) and explain your situation briefly. Use facts and try not to use your personal emotions. I would start it with the date of the foreclosure and the necessity for them to respond to you due to a real "time is of the essence" clause. I am so sorry to hear about your situation.

Why are you denied under HAMP? Did they give you a reason?

You definitely need a specific person "negotiator" aka bank employee to communicate with. I have heard that NACA can stop foreclosures. This might want to be another avenue you pursue. I would first try to get a negotiator. You obviously do not have much time. Any chance you can retain a good, reputable real estate attorney who can stop the foreclosure or at least postpone it?

My post from yesterday didn't show up. Weird. . .

Thanks for your advice ama and native. I will start emailing OOP and I have submitted my information to NACA. I am not sure who my investor is. I have a FHA loan that I obtained through Home123, it was sold to CW and now with BOA. It's not Fannie Mae or Freddie Mac.

I don't qualify for HAMP because my payment is only about 29.5% of my gross income. It's about 46% of my net income but of course they don't take that into consideration.

I've been calling my negotiotor to find out about the status of loan modification and so far have no luck getting a hold of her. Last time she told me that I'm pre-qualified for the trial modification and just need to wait 3-4 weeks for paperwork. I called the loss mitigation to see if there has been any update and they told me that they're just waiting for the investor to get back with them. I asked if when the investor gets back with them with an approval is that when I would start the trial mod and they told me that since I already went through the forbearance process i wouldn't have to go through the trial mod and it would be a permenant mod. Does anyone know if this is true or not?

I'm terribly sorry about people who are still getting the run around with BofA. I was one of the lucky few who was put on forebearance so I can qualify for the terms set by my lender and with the end of my forebearance my loan was just modified to 2.125% fixed for the first five years and 5% for the next 35 years. I'm pretty pleased with how it all turned out and my only advice for you is to stick with it and perhaps reach out to those people in their consumer relations department. Fortunately for me, I didn't have to but i couldn't hurt. I started my process in early June and I was approved last week after going through a 3 month forebearance...so I guess my situation was not so bad all things considered.

I got a call from a Juanice Neal she said she is in the department of the chairman. She requested I send her all my current information so I did today. She is supposed to get me a negotiator so....that where I am which is better then I was before.

Side note: I told her that a customer service rep had directed me to NACA she said they were going to investigate because that is not supposed to be happening.(who knows if that is truthful).
