I am at my wits end with the problems with its implementation. Worse yet I am hearing about many foreclosures against all the directives at the same time many of us are making trial payments and trying to get HAMP modifications. People are having homes sold immediately upon denials often for reasons that don't make sense, with no time to pursue other options such as Chapter 13 etc. This is going on frequently even though against all the directives of Treasury and HampAdmin. This is causing huge emotional distress for many of us desperately trying to save your homes for our families. The proof of this going on is evident from the thousands of reports on various web forums with desperate homeowners reporting their experiences. What makes me even more scared are reports such as: On 9/11/09 National Consumer Law center said "Participating servicers violate the HAMP guidelines by selling homes at foreclosure while homeowners are negotiating loan modifications, requiring waivers of homeowner rights, and refusing to offer HAMP modifications to qualified borrowers. Lack of transparency in the application, review and turn down process exacerbates these problems." Attorney Jeff Barens warns in article of 9/11/09 “BEWARE THE “END-RUN” (SNEAK) FORECLOSURE” at Foreclosure Defense Nationwide - Mortgage Foreclosure Help - Free Advice It reports the widespread practice of servers telling customers not to worry about the foreclosure notice, messes up the paper work and trustee sale is completed! We need another foreclosure halt that can be enforced while under HAMP trials AND if denied at least 60-90 days before a sale can be done while other options are considered. The problem isn't homeowners not contacting servicers and sending info, its the servicers being overwhelmed, losing paperwork that is sent in many times, and servicers not following the directives from HAMP/Treasury that is the real problem. Few homeowners qualify for the refinancing programs since most are underwater. But HAMP modifications could be very successful with more servicer and investor cooperation. The Congressional Oversight Report of 10/9/09 clearly shows the problem of HAMP is not the homeowners but with the implementation. As pointed out 2MP for second mortgages is badly needed but there is not enough funding for incentives to encourage participation. Instead of allocating more billions for new homeowner credits, more should be done to and save the millions of us that are so desperately trying to save our homes but face huge obstacles with trying to get HAMP modifications. We are the hurting desperate citizens who can afford to keep our homes under HAMP. Fix the HAMP and 2MP broken programs instead of rewarding new buyers that are not hurting like we are. HAMP and 2MP are very good programs, it is the implementation that is broken. Instead of blaming homeowners for not responding to find out what is really going on in the real world just read the Congressional Oversight Report at http://cop.senate.gov/documents/cop-100909-report.pdf. If someone just took an hr and did some reading on this site they would get a better idea of how the program is really working (NOT) It amazes me that no one in government has the guts to hold these banks accountable. The first bailout wasn't enough...so give them more. These lose money..so still give them a bonus because we don't want to lose them to the competition. SO WHAT!How much of your "losses" goes to bonuses? If I s***ed at my job, I'd lose it...If I ran my company into a loss...I'd lose everything. OBVIOUSLY the program is not working, a look at this site will show a good cross section of how it seems to benefit the banks. But how do we get anyone to notice? I have requested to appear before anyone at a hearing, but have heard nothing. How do we get on the list to talk to congress etc.? They need to hear from REAL people. |
