Does anyone know if the lenders will refuse to work with you on a loan modification if you have been discharged in a bankruptcy, but the actual case has not been closed on the bankruptcy docket? I received a discharge (Chapter 7) last month and was told by both Wachovia and OneWest that nothing could be done until the case has been "closed." I find this to be odd and maybe just a delay tactic. I continued to make mortgage payments during the bankruptcy so the mortgages were not part of the discharge. My attorney tells me that the discharge ends the case and that the bankruptcy docket should be changed to state that the case has been closed soon. Thanks for any input. |
