I need advice

I need some advice on what to do. Last year, my husband was diagnosed with colon cancer and due to complications from chemo, he was not working for about 7 months. During those 7 months, I tried everything possible to keep my mortgage in tact -- borrowing from credit cards, savings, and basically used every avenue I could. I went to Wells Fargo and explained the situation and they said there was nothing they could do to help us. Back in May I filled out all of the paperwork for a loan modification with Wells and I received a letter on June 22 stating that they had all of the information they needed and were "reviewing" our account. To this date, they are still "reviewing" our account. I have maxed out all of my credit cards and instead of paying my mortgage on the first of the month, I am now paying it on the 30th of the month. However, it will eventually catch up with me because with all of the other bills, including a lot of medical bills since he is having to go back and forth to the doctor so much, I will eventually NOT be able to make this payment.

Wells Fargo has provided me no help whatsoever. I constantly call and ask them what is going on and they said it's still under review. If I were to sell my house now, I would be upside down. However, when we originally took out this loan 3 years ago, we refinanced from 30 years to 15 years and you can imagine what my house payment is. However, during the last 3-4 months since this was done, I have paid down the principal on the house over $100k. I asked them if they would consider doing a loan modification on what my current mortgage balance is at this point because this would save me an enormous savings per month by doing this reduction.

I am at the point where I feel that as long as I am making my payment, they are not going to help me at all. My credit card companies won't help me. They have basically cut off my credit since I am only making the minimum payment. That's okay.

I asked them about a 3 month forbearance because if I could get their permission to not pay my mortgage for 3 months, then I could use that money and pay off my credit cards and then I would be okay and be able to make my mortgage payments in the future. However, I cannot get an answer.

However, I don't know what to do now. If I were to not be able to make my payment for August and tried to make it sometime in September, would and could they refuse to accept my payment since at that time I would be due for August and September 1st payment?

Any advice? It's hard enough dealing with cancer hanging over your head and now how to deal with this. I cannot let my husband know what is going on and cannot afford to lose my house during this process because he has enough to worry about besides this.

Looks Like BK may be comming, I would go to www.naca.com apply ASAP as any of these bankers will only spin you in circles...

Main thing is Keep making mortgage payments...Credit Cards can wait..

First i pray that your husband recovers and for you that God blesses you with strength and from what I have been seeing and going through with these banks alot of patience. I have been trying since march to get mod. Don't accept no for an answer from them. Call Naca try to get every piece of paper to them that they need right away. you can find the office of the president for your bank giving them a call helps to. Thats what i am waiting for right now. Basically i think they really review your situation. Not just say sorry we can't do anything. I don't see why they couldn't help u do you have multiple homes? You def have a hardship, you could definately have it spread out to longer terms doesn't really make sense. Oh wait you probably have equity I think that hurts sometimes when your trying to do mod because i have equity and was told that the bank doesn't care if you foreclose as much when you have equity because they get back 75% of the current market value of your home if that was to happen. You do have options to keep fighting search on here for your banks OOP if i come across it while i'm searching i'll let you know. As far as if you go behind one month to pay credit cards down right now from my own experience they aren't sending back the payment there taking it. But i have bank of america. You have a lot on your plate right now. I would definately contact NACA. They can help do some of the busy work that you may not have time for. You NEED to get a hold of the executive office and speak to someone there. You have the very situation that they should help for. They can't let you loose your house when your husband is fighting for his life. Tug at their heart strings. Let them know that you have not told your husband because he cannot handle this right now!

Do not pay your credit cards until the housing issue is settled. They have already cut you off. It is unsecured debt and they have no recourse at this point but to threaten you and you have more important issues. When the house is settled, then offer settlements to the cards for what you can pay. They have already reported you, and once it goes to 90 days late it won't hurt your credit any more.

Hang in there and fight to kep what you and your husband have worked so hard for!

Thanks to everyone for your kind words. I will not let them get the best of me. Bankruptcy is not in the cards -- I will get a part-time job if I have to. That is out of the question. I need my home because where would my husband be if we didn't have a home. So I am not looking to file bankrupt.

I logged onto Wells Fargo on Friday and now I am getting a message that says through the wellsfargo.com/assist website that information regarding my account cannot be obtained through the website at this time. Is anyone else getting this message or could this possibily mean that they are trying to help us now. I also spoke to someone and he said that they need 1 paycheck stub up to date from us. So I will fax this tomorrow. They also said that they have been able to get their investors to work with them better so that the loan modification process speeds up a little bit more. I hope this is the same.

What really aggregates me is that my sister was able to obtain a 3-month trial modification from her lender, GMAC Mortgage, in 2 weeks. I am not kidding you. Her house payment is dropping from $1784 to $1098 for 3 months during the trial.

I am really hoping that they do something. There are lots of options for us. We currently have a 15 year mortgage with only 11 years left. So if they were to push it back up to the 30 year mark, that's okay with me because at least I would still have my home and that would probably cut my house payment almost half.

Once you reach the secretary or switchboard operator, say the following: "Hello, my name is ________. Well, here's the latest. I just found out that Wells Fargo denied us today. I called to find out why and they said it was because they requested information and I never sent it. I have a redwell full of faxes and other correspondence sent to them to prove it. The latest was last Friday when I called in (which I have been calling every day for the last 3 weeks) and they said they needed one paycheck stub from my husband and I -- only one. On Monday morning, at 9:00 a.m., I faxed the paycheck stubs. I called this morning to verify that they received and they said yes. Then 3 hours later, they denied us because of lack of information. They stated that they will "TRY" to put us back in line. I got fed up and called the executive office and they basically were worthless also since they stated to me that the "norm" for a loan modification is 120 days. What a crock of bull.

All these bankers tell almost everyone on this site they Lost, cannot find or we never sent the info in..This is why we and many suggest NACA they have a better set up to get all your DOCs in to them...
