I am new to forum. I am hoping to modify my 2nd mortgage so that my payments are smaller. I'm not near foreclosure but my husband got laid off and we can't live on my pay and his unemployment. We will start defaulting if we don't get help. My 1st mortgage company won't/can't do anything since my % is already low. If I could just get a modification to the 2nd mortgage, we might be ok. The bank said to send a Hardship Letter. I reviewed this forum and got some great ideas. I have written a letter and would like some feedback. How is this:

Hello,

I came across this forum, and I want to thank everyone for the amazing questions and answers provided. It's a great resource to what steps homeowners need to make in getting help. Plus, as a first time homeowner, it's comforting to know that one is not alone!

Was looking at the hardship letter examples here and drafted the following. Would anyone be so kind as to provide feedback? I know I should keep it short and sweet, but it's difficult when you're dealing with a mortgage company who seems to give me different answers each time I call. Plus, I had already submitted the application to my mortgage this past May (MetLife Home Loans), got a confirmation, getting pressured by phone to make another payment (since I could only afford to make a partial), then being told to submit the application again, this time with more documentation!

I mention this situation in my draft below, but if permissible, I'll post a separate thread since I am curious if anyone was asked to submit an application for a modification twice.

To Whom It May Concern:

I am writing this letter to ask for your assistance regarding my mortgage. While I have done everything within my power and resources in the past couple of months, unfortunately I have fallen short and would like to explore options such a modification of my loan. I am hoping to achieve two goals with this letter: to have an opportunity to work with MetLife in finding a mutually beneficial solution, and second, to be able to keep my home, as I am a first time homeowner.

The main reasons for my delinquency are following:

1. Salary freeze = negotiations between my employer and the union group (whom I am affiliated with) took place in January 2009 and concluded on April 2009, with the announcement that salaries will be frozen at their current rates.

2. Rising rates = in order to pay my mortgage payments in full (and maintain good standing with MetLife), I reduced my minimum payments to my other monthly obligations beginning in November 2008. By February 2009, I had to rely on my credit cards to cover my other expenses in order to pay my mortgage each month. These in turn caused my interest and payment rates to increase by April.

With these factors, I came to the realization that so long as my bills continue to increase their rates and minimum payments, it was a matter of time before I will start falling behind. This became a reality in June 2009, where my budget could only afford my sending $826 out of the required $1440 monthly payment to MetLife.

Despite this current situation, I tried the following options in the hopes I can continue to make my mortgage and other monthly payments.

1. Between January and April 2009, I took on a part time job to supplement my income during the negotiation process. Due to conflicting work schedules and demands from my full time job, it did not work out. In spite of this setback, I continue to actively look for part time work as well a full time job with better pay.

2. I do monthly reviews of my expenses and have been reducing my expenses to basic necessities, just to ensure that my take home is used solely for my monthly obligations.

3. I am trying to negotiate with the credit card companies on payment options and/or possibly reducing my rates. Currently, I am restricting myself to using only my checking account.

4. In June 2009, I took a loan against my 401(k) to cover some unexpected bills and to help me provide payment to my mortgage. While the loan helped cover the expenses (and submit the $826 payment mentioned earlier), this meant approximately $142 would be deducted from my take home, giving me a take home of about $3013.

Despite these measures, I feel that I have exhausted all my available resources. I have no savings to use, and my creditors advised that I await a decision from MetLife before exploring other payment options.
I sincerely hope that MetLife will give me a chance to modify my loan so that I may return to submitting my payments promptly and in full.

Please note I have already submitted in late May your application form, which I received a confirmation letter on June 12th stating that it is under review. Per recommendation of one of your counseling agents (Mr. Robert Patzwall) to complete a new packet, I am hoping that this letter, along with the application form and required attachments, will be viewed as updates to my initial submission.

New here and not sure where to post this

I am one month behind on my payment and need advice on my hardship letter. This is a draft before I send it in. Do I contact the bank and talk to someone first or do I just send my letter? I would greatly appreacte any feedback. Thank you

The main reason I have fallen behind is as a result of my domestic partner of 12 years losing his job last year. He is our main source of income since I am disabled. We live in Florida, but the only employment he was able to obtain is
in Ohio, which means he will need to travel considerably and incur duplicate living expenses. We had to use up our savings to support his job search as well as come up with first, last and security on his apartment in Ohio and pay for travel expenses related to this relocation. His new employment is with a company that is global and he plans on transferring back to Florida as soon as possible

I would appreciate if you could work with me to possibly defer 3 to 6 months of mortgage payments and tack them onto the end of my loan.
I truly hope that you will consider working with me so that we can settle this and I can keep my home.

I believe our situation will be improved now that he is once again employed, and feel a loan modification would be of benefit to both Bank of America and me. This would allow us to get back on our feet and return to the very timely payment pattern you will note I've had on my mortgage in the past.

Hello, First time posting. I am with WFargo. Our situation looks like it may not fall into this catagory yet but, when I spoke with a rep for Wells Fargo she told me this was the best way to go first So, I have drafted a hardship letter and would like some feedback if at all possible. Thanks to everyone who is trying to help each other here and good fortunes to all.

To Whom It May Concern:

I am writing this letter to explain my unfortunate set of circumstances that have caused us to become delinquent on our mortgage. We have done everything in our power to make ends meet but unfortunately we have fallen short and would like you to consider working with us to modify our loan. Our number one goal is to keep our home and we would really appreciate the opportunity to do that.

The main reason that caused us to be late is the increase in our mortgage payment due to an escrow shortage that we were not aware of. From the beginning of the process we told our previous lender that we wanted our new home payments figured on an improved lot which, we were assured was the case. We even questioned the fact at the closing table and again, we were assured by all present that was the case. We were straight out lied to. Our payments have increased by $400.00 a month. Also we have encountered large medical and dental bills for which we were not prepared for since most of our savings had gone towards our escrow shortage. I have been working anywhere from 146 to 200 hours per pay period to try and keep up. I have been informed by my chief that this will have to stop as it is both bad for my health, the department and safety issues. Soon after being late and our income not being nearly enough, we have fallen further and further behind. Now, it’s to the point where we cannot afford to pay what is owed to Wells Fargo in a timely manner. It is our full intention to pay what we owe. But at this time we have exhausted all of our income and resources so we are turning to you for help.

We started feeling the pressures of our situation in May of 2008. That is when we realized that our escrow was not nearly enough to cover our yearly commitments. Also during this time period we have had to pay for three root canals, tooth extractions an MRI and a *** scan. At the present time I feel that our situation will continue to worsen permanently without help.fficeffice" />>>

We feel that a loan modification would benefit us both. We would appreciate if you can work with us to lower our payments so we can keep our home and also afford to make amends with your firm.

Hello all and Moe... please read my hardship letter and let me know where I need to improve before I send it in.

First, I would like to thank ****** ***** for taking the time and possibly working with us to create an affordable mortgage payment for our home. Our number one goal is to keep ourselves and our children in our home.

Unfortunately, we have found ourselves being another statistic of the downward economy. The downturn for our family started the beginning of ‘08 when the economy really started to crumble. My husband found that he was not working as many hours, gas prices went through the roof, our utilities almost doubled due to increases, insurance and groceries became more expensive, as did almost everything else. We were managing but our savings was depleting… fast. Then in the fall I took my 5 year old to the dentist who needed extensive work due to extremely soft teeth which set us back almost $1,000 just for our portion and I started having “female” issues which was sending me to the doctor for even further expenses. Recognizing where our savings was headed I started using credit cards to supplement. This was a short term solution and only made matters worse. Due to my female issues I had to have a total hysterectomy which meant more money that we had to come up with (for our portion). Now, it is to the point where we can no longer afford to pay ****** ******* in a timely manner. It is our full intention to pay what we owe, but at this time we have exhausted all of our income and savings so we are turning to you for help.

We have been actively adhering to a strict budget for expenses and feel with your help our situation is something that we can recover from if given the chance. My husband is the sole provider and though I have been a stay-at-home mom I have been applying everywhere and hope to have employment soon (fingers crossed). My 5 yr. old is starting Kindergarten this year so that will void any daycare fees. I have cancelled my credit cards and got on repayment plans . We have created customized accounts with our utilities to save energy and reduce our bills and I am now able to take my 5 year old to the “big people” dentist for work which has reduced the costs drastically since she no longer needs to visit a pediatric dentist. At the present, I am exploring alternative insurance companies to find a lower premium for our vehicle and homeowners insurance.

Our credit is very important to us and we want to have good standing with our obligations as well as protect our main asset, our home.

Again, thank you for your time and consideration. We look forward to working with you to resolve our situation.

BUZ2004.... I watched the video and it's very interesting. I have heard of the "produce the note" tactic before and that it is so frustrating for the banks because notes were sold so much during the peak that it is so time consuming for them. For those of us that are trying to stay in our homes this is something to definately pursue (or at least to stall the foreclosure process if they decide not to work w/you).

Karil.... I ended up re-doing my letter because I felt like it gave too much info in some areas and also just not enough (to me it wasn't personal enough). I took my revised letter to my appt. w/ NACA and they chose my revised. If I were you I wouldn't mention the surgeries that you had done. I would take that whole sentence out. Leave sentence... surgeries of my own...For each of those surgeries.... and I probably wouldn't add in there about the older cars because if I were a moderator I would be thinking "well, if we revise it the cars are still old and still going to need work". I would probably say... Our vehicles needed some repair and more medical costs incurred when our son needed an emergancy appendectomy. All of these medical costs have piled up to the point that we are unable to pay the.....(so on).

Lastly, I would start your finishing sentence.... We have every intention of fulfilling our obligations but at this point we have hit a bump in the road...

Sorry if I came across nit-picky but I read it as how I would take it in... plus, we all need each others constructive criticism if it is going to help. Meanwhile, maybe to give you some time you should also look into how to do the "produce the note" and buy you some ammunition. Also, have you checked out NACA?

Thank you Corrina! Not nit-picky at all...that was exactly what I was looking for! I really have no idea what it is I'm doing. I will revise the letter and repost to see what you think then. Again thanks so much for that!

I have no idea what the NACA is. I've seen it mentioned here and there on this site but other than that have never seen it referenced before. So if you could clue me in or throw up a link it would be much appreciated!

Again thank you. I'm just so stressed right now...I couldn't figure out how to word that letter without sounding whiny.

www.naca.com - They are a non-profit agency that has had great success at helping people with their home mods.

I too had a hard time with the letter. It is mentioned to be direct and to the point but then it just comes off as un-personal. I wanted to lender to have an idea of what type of person I am and how we ended up in the situation we're in. That we are not investors or house-flippers, just a couple who ended up having an unfortunate set of circumstances happen within a short time frame that depleted our savings. (hey.. that might be a good sentance to add

How about this..... Appendectomy. Due to a reduced income the medical bills piled up and we could not afford them therefore, our wages are now being garnished.

Thanks again Corrina! I'm glad you caught that typo...I think my brain was getting a bit ahead of my fingers! I actually had to reread that paragraph 3 times before I actually saw it!

Could you please review my hardship letter? Also, is it possible to modify my smaller HELOC with terrible terms as mentioned in the letter?

To Whom It May Concern:


I am writing this letter to explain our unfortunate set of circumstances that have caused us to fall behind on our mortgage. We have done everything in our power to make ends meet, but unfortunately, we have fallen short and would like you to consider working with us to modify our loan. Our home is our #1 asset and investment, and it is our goal to keep it. With some modification, that should be possible.

Being self employed with a small computer consulting business, we initially began falling behind financially in the autumn of 2007, when we lost 3 small clients, and our primary client dramatically reduced available hours. We were forced to discharge 1 employee, and a subcontractor, and reduced pay to our only two employees: me and my husband, BXXX.

We were able to stay current by selling assets and using credit cards. Now with assets sold, escalating interest rates and the economy as bad as it is, we are falling behind. Current family medical expenses- a child’s broken bone, and a possible need for outpatient surgery, are also straining our weak budget. My children help where they can, with part time jobs. It is our intention to fully pay what we owe, but at this time we need some held to recover from these tough times.

Our mortgage is currently fixed at 6.375%, which is $4118/month. In addition, the 2nd mortgage with Bank of America is $406-interest only - adjustable 5%, but with a cap of 18%, converting to P & I in November 2009!
Our situation has improved as the 4 children – 3 teens and one age 21 in college, are becoming more independent, and self sufficient. We have made it a priority to stop using and pay down our high interest credit cards. BXXX and I are expanding our skills, and have potential new clients on the horizon. Please work on a loan modification with us, so that we can become current on our finances again!

We hope you will consider working with us and we are anxious to get this settled so we can keep our home, and focus on more pleasant things!

Hello, I am new to this amazing forum as well and have attached the letter of hardship I am submitting this morning. I have to admit that it wasn't until I found this forum last Friday that I got anywhere with BOA on my loan modification. I emailed all the execs mentioned on a different thread and 4 hours later received a call from someone in the executive division willing to hand carry my modification through it's process. Yippee!! Initially, we contacted Countrywide on April 20, 2009 about obtaining a modification and all the documents requested were faxed then. Since then we have been in contact with Band of America and re-faxed pay stubs, income/debts and Hardship letter on July 1, 2009. We have been calling every week to get information or status and are continually told that it is in review.
To give you a little background, my husband had been employed with Winnebago Industries for almost 15 years in the Engineering dept. and in the last 2 years of his employment they were faced with much down time and then finally he was laid off last October 27, 2008, along with 3000+ other employees. To compensate for the lost income during those last 2 years he had been working part-time at Wal-Mart. When he was laid off, Wal-Mart offered him full time employment. While this maintained his working 40+ hours a week it has resulted in a 56% loss of his income. There is a light at the end of the tunnel though, he is being considered for management training and so there is the possibility of a major increase in income in the future. I have continued to work for the same company for almost 5 years and we are trying to survive and be competitive in these economic times. We have 2 children at home and 2 out of college with the eldest attempting to enter medical school.
Our motivation is to be able to continue to maintain and live in our home and meet our obligations. Currently our mortgage is $169,000 with interest fixed at 9.375% with a 30 year term. That makes our payments 1450.00 and that is without taxes or insurance. Because of the dramatic decrease in income it is increasingly hard to make our mortgage payments and we have recently fallen behind. Also, our payment has just been adjusted to over $1700.00 in order to compensate for tax property impounds. It is our full intention to pay what we owe. But at this time we have exhausted all of our income and resources so we are turning to you for help and we feel that a Loan Modification would benefit us all.
What we would like to propose is that our loan is modified by reducing our interest rate for 5 years to 3.25% or less and then making it a fixed rate of 5.75% or so, for the life of the loan. I am certain the LTV is 5% or less and so reducing some of the principal would be ideal as well. We are hoping that by writing to you, this process can be expedited. We are a hard working family who enjoy our home and have worked hard to make it a beautiful, inviting haven. Please, please work with us in order to help us keep our home and meet our obligations. Being a 2x breast cancer survivor, I have the fighting spirit to survive this and will continue to fight hard to keep our home.

9.375%?!?!? Can you just do a simple refinance? (i.e., do you have at lesat 20% equity in the house?) Interest rates are pretty low these days.

No, I wish we could, it is probably upside down as far as LTV. We live in the county where Winnebago Industries collapsed and we just heard the Cummins plant here is closing and another 400 will be losing their jobs. All of this really impacted home values. I know 9.375 is SO high, that's why we are hoping for a modification. It was the only rate we qualified for after huge medical expenses.
