Indymac is not modifying my mortgage

I have hired an attorney for loan modification and it has been about 6 months. After sending all the paperwork, Indymac sent me a letter, stating they have no modification program for me because I am not late and I have not been late. I provided proof to Indymac, that all my credit cards are maxed out because I kept borrowing from my cards to pay my mortgage. At this time my expenses, my bills and mortgage are 90% of my income and I am short over $1000 every month. I can not borrow money anymore yet I am struggling to keep my house and not to go to forclosure. I have a fixed salary income. What I have decided to do is to just take indymac to court. I have been waiting for my attorney to do something for me and I can not even reach him and my calls are not being returned.
