Nominated 0 Times in 0 Posts TOTW/F/M Award(s): 0 | I bought a home in Sarasota Florida back in 2007! I am a victim of predatory lending! I have 3 small children so I have decided to fight! I have been reviewing and researching my options and found the following! My attorney is very active in Foreclosure Defense. And while I will admit attorney's can be costly I have decided that because I am not making payments right now then I can afford the attorney! After reviewing my loan docs I have found several things that raises serious questions. My mortgage broker was grossly overstated my income with out any docs. He inflated my selling cost to cover his profits. He made about $31,000 in profits. The lender is First Franklin and they keep telling me they are going to modify but they want me to start sending them $5000 a month for 90 days and then they will consider redoing my loan. I don't believe them. They have stated in the summons that I had not made a payment since August 2008 when in fact the last payment I made was Nov 2008. They have made many claims that are very inaccurate. They have also stated that they can't find my original note. When I hired my attorney I told him my over all goal was to drag this out for 2 years. By doing this it buys me time to see if O'Bama changes the BK laws or the government buys my loan and refinances the loan at a rate that I can afford. People don't give up there is hope for all. Get an attorney and I bet within 1 year your bank will be begging you to refinance with them at terms that are in your best interest. Info on First Franklin- In the state of Florida they are being operated as LaSalle Bank. Have your attorney run a search on LaSalle and they will find that they are not even liscened to do business in Florida. If they are not liscened then they can't bring claims or lawsuits against people in Sarasota. |
